S.I. No. 51/2017 - Sea-Fisheries (North Western Waters Landing Obligation) Regulations 2017.

1. (1) These Regulations may be cited as the Sea-Fisheries (North Western Waters Landing Obligation) Regulations 2017.

(2) These regulations shall cease to have effect on 31 December 2018.

2. (1) In these Regulations-

“Council Regulation” means Regulation (EU) No 1380/2013 of the European Parliament and of the Council of 11 December 2013 (as amended by Regulation (EU) 2015/812 of the European Parliament and of the Council of 20 May 2015);

“Commission Regulation” means Commission Delegated Regulation (EU) 2016/2375 of 12 October 2016.

(2) A word or expression that is used in the Council Regulation or the Commission Regulation and is also used in these Regulations, has, unless the context otherwise requires, the same meaning in these Regulations as it has in the Council Regulation or the Commission Regulation.

3. (1) The master of a sea fishing boat which appears on any list of vessels provided for under Article 4 of the Commission Regulation shall comply with Article 15(1), (4), (8), (11) and (12) of the Council Regulation in respect of North Western waters.

(2) The master of a sea fishing boat referred to in paragraph (1) may not discard catches other than in accordance with Article 2 or Article 3 of the Commission Regulation.

4. The Sea Fisheries (North Western Waters Landing Obligation) Regulations 2016 (

S.I. No. 8 of 2016

) are revoked.

This instrument implements the Landing Obligation contained in Article 15 of the Common Fisheries Policy Regulation 1380/2013 in respect of Demersal Fisheries in North Western Waters which is given effect by Commission Delegated Regulation (EU) 2016/2375 of 12 October 2016. These regulations cease to have effect on 31 December 2018.
