S.I. No. 247/2012 - European Communities (Audiovisual Media Services) (Amendment) Regulations 2012.

1. These Regulations may be cited as the European Communities (Audiovisual Media Services) (Amendment) Regulations 2012.

2. The European Communities (Audiovisual Media Services) Regulations 2010 (

S.I. No. 258 of 2010

) are amended

(

a

) in Regulation 3, by substituting for paragraph (1) the following

“(1) These Regulations apply to media service providers established in the State in accordance with Article 2(3) or (5) of the Directive or under the jurisdiction of the State in accordance with Article 2(4) of the Directive,”

and

(

b

) in Regulation 17, by substituting for paragraph (6) the following

“(6) Without prejudice to this Regulation, the BAI shall ensure that the modalities and conditions regarding the provision of such short extracts are defined, in particular with regard to any compensation arrangements, the maximum length of short extracts and time limits regarding their transmission by the development of a code of practice. Where compensation is provided for, it shall not exceed the additional costs directly incurred in providing access.”.
