1. This Order may be cited as the Companies (Auditing and Accounting) Act 2003 (Commencement) Order 2007.

2. The 1st day of March, 2007 is appointed as the day on which paragraphs (

) of

section 37

of the

Companies (Auditing and Accounting) Act 2003

(No. 44 of 2003) come into operation.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order fixes the 1st March, 2007 as the date on which Section 37(

a

), (

b

), (

c

) and (

e

) of the Companies (Auditing and Accounting) Act, 2003 comes into operation. Section 37 amends

Section 194

of the

Companies Act, 1990

. The substance of the amendment is to amplify the requirements at subsection (5) of section 194 relating to possible indictable offences such as to require auditors to furnish further information, and provide access to books and documents, to the Director of Corporate Enforcement.
