S.I. No. 288/2002 - Local Government (Superannuation) (Consolidation) (Amendment) Scheme, 2002

1. (1) This Scheme may be cited as the Local Government (Superannuation) (Consolidation) (Amendment) Scheme, 2002.

(2) This Scheme and the Local Government (Superannuation) (Consolidation) Scheme, 1998 (

S.I. No. 455 of 1998

) shall be construed as one and may be cited together as the Local Government (Superannuation) (Consolidation) Scheme, 1998 to 2002.

Commencement.

2. (1) Article 4 shall be deemed to have come into force on the 29

th

day of September, 1998 as respects the provisions of subparagraph (i) of the definition contained therein.

(2) Article 4 shall be deemed to have come into force on the 30

th

day of January, 2001 as respects the provisions of subparagraph (ii) of the definition contained therein.

Interpretation.

3. In this Scheme:-

“the Principal Scheme” means the Local Government (Superannuation) (Consolidation) Scheme, 1998 (

S.I. No. 455 of 1998

).

Amendment of article 3 of the Principal Scheme.

4. Article 3 of the Principal Scheme is hereby amended -

by the substitution of the following definition for the definition of “local authority” contained in sub-article (1) thereof

‘ “local authority” shall have the meaning assigned to it in

section 1

of the

Local Government (Superannuation) Act, 1980

(No. 8 of 1980) and, in addition, shall include a body within the meaning of section 2(9) of that Act, subject to the provisos that —

(i) with effect from the 29

th

day of September, 1998, it shall not include a vocational education committee as respects a person referred to in article 3(2) of the Vocational Education Superannuation Schemes (Transfer of Departmental Administration and Ministerial Functions) Order, 1998 (

S.I. No. 362 of 1998

), and

(ii) with effect from the 30

th

day of January, 2001, it shall not include a body referred to in article 3(2) of the Education Sector Superannuation Scheme (Transfer of Departmental Administration and Ministerial Functions) Order, 2001 (

S.I. No. 14 of 2001

);’.
