S.I. No. 403/1998 - District Court Districts and Areas (Amendments) and Variation of Days (No. 14) Order, 1998

1. (1) This Order may be cited as the District Court Districts and Areas (Amendment) and Variation of Days (No. 14) Order, 1998.

(2) This Order shall come into operation on the 19 day of October, 1998.

2. In this Order "the Principal Order" means the District Court (Areas) Order, 1961 (

S.I. No. 5 of 1961

).

3. The First Schedule to the Principal Order, is hereby amended by -

(a) the deletion of the matter in columns (2), (3), (4) and (5) at reference number 35,

(b) the substitution for the matter in column (5) at reference number 41 of the following

"The area comprising the District Electoral Divisions of Aghern, Castlecooke, Castle Hyde, Castlelyons, Coole, Fermoy Rural, Fermoy Urban, Glanworth East, Glanworth West, Gortnaskehy, Gortroe, Kilcor, Kildinan, Killathy, Kilworth, Leitrim, Rathcormac, Ballyhooly, Castletownroche, Clenor, Kilcummer, Monanimy, Shanballymore and Wallstown in the county of Cork.", and

(c) the substitution for the matter in column (4) at reference number 41 of the following

"Fermoy -

Second and Fourth Monday of each month at 11.00 a.m.".

4. The Second Schedule to the Principal Order is hereby amended by -

(a) the deletion of the matter in columns (2), (3), (4) and (5) at reference number 30,

(b) the substitution for the matter in column (5) at reference number 36 of the following

"The area comprising the District Electoral Divisions of Aghern, Castlecooke, Castle Hyde, Castlelyons, Coole, Fermoy Rural, Fermoy Urban, Glanworth East, Glanworth West, Gortnaskehy, Gortroe, Kilcor, Kildinan, Killathy, Kilworth, Leitrim, Rathcormac, Ballyhooly, Castletownroche, Clenor, Kilcummer, Monanimy, Shanballymore and Wallstown in the county of Cork.", and

(c) the substitution for the matter in column (4) at reference number 36 of the following

"Fermoy -

Second and Fourth Monday in each month at 11.00 a.m.",

5. The Schedule to the District Court Areas (Amendment) Order, 1970 (

S.I. No. 161 of 1970

), is hereby amended in column (4) at reference number 20 by the deletion of -

(a) "Castletownroche," and

(b) "35,".

6. Business transacted in the District Court which is initiated and not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business had been initiated.

EXPLANATORY NOTE

This Order provides for the abolition of the District Court Area of Castletownroche and the amalgamation of the District Electoral Divisions which comprised that Area with the District Court Area of Fermoy.
