S.I. No. 402/1998 - District Court Districts and Areas (Amendment) and Variation of Days (No. 13) Order, 1998

1. (1) This Order may be cited as the District Court Districts and Areas (Amendment) and Variation of Days (No. 13) Order, 1998.

(2) This Order shall come into operation on the 19 day of October, 1998.

2. In this Order "The Principal Order" means the District Court (Areas) Order, 1961 (

S.I. No. 5 of 1961

).

3. The First Schedule to the Principal Order is hereby amended by -

(a) the deletion of the matter in columns (2), (3), (4) and (5) at reference number 139,

(b) the substitution for the matter in column (5) at reference number 134 of the following

"The area comprising the District Electoral Divisions of Aghmacart, Ballybrophy, Borris-in-Ossory, Clonmore, Cullahill, Donaghmore, Errill, Grantstown, Kilcoke, Kildellig, Kilnaseer, Kyle South, Moneenalassa, Rathdowney, Rathsaran, Abbeyleix, Ballinakill, Ballyroan, Blandsfort, Clash, Colt, Cuffsborough, Cullenagh, Dunmore, Durrow, Dysartgallen and Killermogh in the county of Laoighis.", and

(c) the substitution for the matter in column (4) at reference number 134 of the following

"Abbeyleix -

Second Thursday in each month at 11.00 a.m.

Fourth Friday in each month at 11.00 a.m.".

4. The Second Schedule to the Principal Order is hereby amended by -

(a) the deletion of the matter in columns (2), (3), (4) and (5) at reference number 123,

(b) the substitution for the matter in column (5) at reference number 118 of the following

"The area comprising the District Electoral Divisions of Aghmacart, Ballybrophy, Borris-in-Ossory, Clonmore, Cullahill, Donaghmore, Errill, Grantstown, Kilcoke, Kildellig, Kilnaseer, Kyle South, Moneenalassa, Rathdowney, Rathsaran, Abbeyleix, Ballinakill, Ballyroan, Blandsfort, Clash, Colt, Cuffsborough, Cullenagh, Dunmore, Durrow, Dysartgallen and Killermogh in the county of Laoighis", and

5. The Schedule to the District Court Areas (Amendment) Order, 1970 (

S.I. No. 161 of 1970

), is hereby amended in column (4) at reference number 15 by the deletion of -

(a) "Rathdowney,", and

(b) "139,".

6. Business transacted in the District Court which is initiated and not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business had been initiated.

EXPLANATORY NOTE

This Order provides for the abolition of the District Court Area of Rathdowney and the amalgamation of the District Electoral Divisions which comprised that Area with the District Court Area of Abbeyleix.
