S.I. No. 34/1997 - District Court Districts and Areas (Section 26) (No. 9) Order, 1997.

1. (1) This Order may be cited as the District Court Districts and Areas (Section 26) (No. 9) Order, 1997.

(2) This Order shall come into operation on the 16th day of January, 1997.

2. The First Schedule to the District Court (Areas) Order, 1961 (

S.I. No. 5 of 1961

), is hereby amended by—

(

a

) the deletion of the matter in columns (2), (3), (4) and (5) at reference number 71,

(

b

) the substitution for the matter in column (5) at reference number 65 (as amended by the District Court Districts and Areas (Section 26) Order, 1997 (

S.I. No. 20 of 1997

)), of the following

"the area comprising the District Electoral Divisions of Ballymacool, Castlewray, Church Hill, Corravaddy, Edenacarnan, Gartan, Gortnavern, Killymasny, Kilmacrenan, Letterkenny Rural, Letterkenny Urban, Magheraboy, Manorcunningham, Meencargagh, Seacor, Templedouglas, Termon, Altnapaste, Cloghan, Cloghard, Dooish, Gleneely (Stranorlar), Goland, Killygordon, Knock, Lettermore, Stranorlar, Convoy, Feddyglass, Figart, Kincraigy, Raphoe, St. Johnstown, Treantaghmucklagh, Killea and Newtown Cunningham in the county of Donegal.",

and

) the substitution for the matter in column (4) at reference number 65 of the following

"Letterkenny—

First and Third Thursday at 10.30 a.m.

3. The Second Schedule to the District Court (Areas) Order, 1961, is hereby amended by—

) the deletion of the matter in columns (2), (3), (4) and (5) at reference number 63,

(

b

) the substitution for the matter in column (5) at reference number 59 (as amended by the District Court Districts and Areas (Section 26) Order, 1997 (

), of the following

) The Schedule to the District Court Areas (Amendment) Order, 1970 (

), is hereby amended in column 4 at reference number 1 by the deletion of—

(i) "Raphoe", and

(ii) "71",

) The District Court Areas (Variation of Days and Hours) Order, 1987 (

S.I. No. 11 of 1987

), is hereby amended by the deletion of paragraph 18.

5. Business transacted in the District Court which is initiated and not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business had been initiated.

6. The District Court Areas (Alteration of Place) (No. 12) Order, 1997 (

S.I. No. 17 of 1997

), is hereby revoked.

EXPLANATORY NOTE.

This Order provides for the abolition of the District Court Area of Raphoe and the amalgamation of the District Electoral Divisions which comprised that Area with the District Court Area of Letterkenny.

(No. 36 of 1971), and after consultation with the President of the District Court, hereby order as follows
