1. This Order may be cited as the Herring (Restriction on Fishing) (Amendment) Order, 1986.

2. The Herring (Restriction on Fishing) Order, 1986 (

S.I. No. 359 of 1986

), is hereby amended by the substitution for Article 3 of that Order of the following Article

"3. (1) In this Order—

the "specified area" means Division VIa) South, Division VIIb) and Division VIIc).

(2) In this Article:—

"Division VIa) South", "Division VIIb)" and "Division VIIc)" mean, respectively, the parts of the sea described in the Annex to the Communication and therein referred to as Division VIa) South, Division VIIb) and Division VIIc);

"the Communication" means the Communication from the Commission of the European Communities on the description of the I.C.E.S. Sub-areas and Divisions used for the purposes of fisheries statistics and regulations in the North East Atlantic.

(3) In any proceedings in which a contravention of this

Order is alleged

prima facie

evidence of the Communication may be given by the production of a copy of the Official Journal purporting to contain the Communication."

EXPLANATORY NOTE.

The effect of this Order is to permit fishing for herring by Irish sea-fishing boats in I.C.E.S. Divisions Vb) (E.C. zone), VIa) North and VIb) from 9th December, 1986.
