S.I. No. 236/1985 - Social Welfare (Rent Allowance) (Amendment) Regulations, 1985.

1. (1) These Regulations may be cited as the Social Welfare (Rent Allowance) (Amendment) Regulations, 1985.

(2) These Regulations and the Social Welfare (Rent Allowance) Regulations, 1982 to 1984, may be cited together as the Social Welfare (Rent Allowance) Regulations, 1982 to 1985.

2. These Regulations shall come into operation on the 3rd day of July, 1985.

3. In these Regulations—

"the Principal Regulations" means the Social Welfare (Rent Allowance) Regulations, 1982 (

S.I. No. 220 of 1982

);

"the Regulations of 1984" means the Social Welfare (Rent Allowance) (Amendment) Regulations, 1984 (

S.I. No. 171 of 1984

).

4. The Principal Regulations (as amended by the Regulations of 1984) are hereby further amended by—

(

a

) the substitution in article 5(2) of "£90" for "£84", "£51" for "£48", and of "£3.80" for "£3.50" in each case in which the latter sum appears;

(

b

) the substitution in article 5(3)(

a

) of "£90" for "£84" and "£100" for "£94" in each case in which the said sum appears;

(

c

) the substitution in article 5(3)(

b

) of "£51" for "£48" and "£56" for "£53" in each case in which the said sum appears;

(

d

) the substitution in article 6(5) of "£68.15" for "£7.70", "£9.30" for "£8.75", "£7.25" for "£6.85" and "£5.80" for "£5.45".

5. The Schedule to the Principal Regulations is hereby amended by the substitution in subsection (1) of

section 231

of the

Social Welfare (Consolidation) Act, 1981

as set out and modified in the said Schedule of "£1,000" for "£500" and "£3,000" for "£2,000", respectively.

EXPLANATORY NOTE.

These Regulations amend the conditions for receipt of a rent allowance in relation to the means test and calculation of the amount of an allowance, to take account of general increases in social welfare payments from July 1985.

They also amend provisions as to fines to correspond with amendments to similar provisions relating to other social welfare payments effected by the

Social Welfare Act, 1985

(No. 5 of 1985).

section 23

of the

Housing (Private Rented Dwellings) Act, 1982

(No. 6 of 1982) and subsections (2) and (3) of

section 3

of the

Social Welfare (Consolidation) Act, 1981

(No. 1 of 1981 ), hereby makes the following Regulations:—
