S.I. No. 115/1977 - Imposition of Duties (Dumping and Subsidies) (Provisional Duty on Refrigerators) (No. 2) Order, 1977.

1. This Order may be cited as the Imposition of Duties (Dumping and Subsidies) (Provisional Duty on Refrigerators) (No. 2) Order, 1977.

2. A provisional duty at the rate of £7 per refrigerator shall be charged, levied and paid on goods of the following description that are imported into the State between the 23rd day of April, 1977, and the 22nd day of October, 1977, that is to say on domestic electrical refrigerators the storage volume of the food compartment of which exceeds 3 cubic feet and does not exceed 12 cubic feet which are classified at tariff code numbers 8415-043 or 8415-047 in the Schedule to the Imposition of Duties (No. 200) (Customs and Excise Duties and Form of Tariff) Order, 1972 (

), and which originate in Czechoslovakia or are exported from Czechoslovakia.

3. For the purposes of this Order, the country of origin of goods shall be determined in accordance with the rules of origin contained in Council Regulations (EEC) 802/68

4. For the purpose of this Order, the internal capacity of the type of refrigerator specified in Article 2 of this Order shall be determined in accordance with the standards prescribed by the International Organisation of Standardisation.

5. The duty imposed by this order is hereby placed under the care and management of the Revenue Commissioners.

EXPLANATORY NOTE.

This Order provides for the imposition for a period of six months of provisional duties of £7 each on certain refrigerators originating in Czechoslovakia.

WHEREAS during an investigation by An Coimisiún Dumpála under

section 7

of the

Imposition of Duties (Dumping and Subsidies) Act, 1968

(No. 11 of 1968), in relation to goods of the kind specified in Article 2 of the Order following, that Commission recommended to the Minister for Industry and Commerce that a provisional duty at the rates specified in the said Article 2 be imposed for a period of six months on goods of the kind aforesaid
