S.I. No. 43/1941 - Street Trading (County Borough of Cork) Order, 1941.

1. This Order may be cited as the Street Trading (County Borough of Cork) Order, 1941.

2. The

Interpretation Act, 1937

(No. 38 of 1937), applies to this Order.

3. In this Order—

the expression " the Act " means the

Street Trading Act, 1926

(No. 15 of 1926),

the expression " the borough " means the county borough of Cork.

4. Every street-trader's certificate granted under the Act in respect of the borough shall be in the form contained in the First Schedule to this Order.

5. Where the holder of a street-trader's certificate granted under the Act in respect of the borough offers, exposes, or carries for sale in any street in the borough any goods of any description actually carried by him by means of a tray, bag, basket, or other like receptacle, such tray bag, basket, or other like receptacle shall not exceed eighteen inches in width and twenty-four inches in length.

6. Every street-trader's stall licence granted under the Act in respect of the borough shall be in the form contained in Part I or Part II (as may be appropriate) of the Second Schedule to this Order.

7. Street-trading, other than the sale of newspapers, is prohibited in each of the following streets in the borough, that is to say, Castle Street, North Main Street and South Main Street.

8. The register to be kept by the principal officer of the Gárda Síochána in the borough of all grants by him under the Act of street traders' certificates shall be in the form contained in the Third Schedule to this Order and the particulars to be entered in such register shall be those indicated in the said form.

9. The register to be kept by the Lord Mayor, Aldermen, and Burgesses of Cork of all grants by them under the Act of street-traders' stall licences shall be in the form contained in the Fourth Schedule to this Order and the particulars to be entered in such register shall be those indicated in the said form.

The person mentioned in the Schedule to this certificate is hereby authorised to sell, and to offer, expose, and carry for sale in any street in the county borough of Cork any goods of any description actually carried by such person either directly in such person's hands or by means of a tray, bag, basket, or other like receptacle not exceeding eighteen inches in width and twenty-four inches in length, but subject to the provisions of the Street Trading Act. 1926 (No. 15 of 1926), and the regulations made thereunder.

Street Trading Act, 1926

(No. 15 of 1926), and the bye-laws and regulations made thereunder and in particular subject to any bye-law or regulation prohibiting stall-trading in particular streets.

WHEREAS the

Street Trading Act, 1926

(No. 15 of 1926), has been duly adopted by the Lord Mayor, Aldermen and Burgesses of Cork and applies to the county borough of Cork

AND WHEREAS it is enacted by Section 13 of the said Act that the Minister for Justice may by order make regulations for certain purposes therein specified
