1. These Regulations may be cited for all purposes as the

Forestry Act, 1928

, Regulations, 1930, and shall come into operation immediately on the commencement of the

Forestry Act, 1928

.

2. In these Regulations the expression " the Act " means the

Forestry Act, 1928

(No. 34 of 1928), and the expression " the Minister " means the Minister for Agriculture.

3. The

Interpretation Act, 1923

(No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

4. Every felling notice under section 5 of the Act shall be in the Form No. 1 in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in that form.

5. For the purposes of sub-section (5) of section 5 of the Act, the particulars of a contract for the sale of a tree made before the 1st day of April, 1928, shall be verified in the manner following, that is to say, the particulars relating to such contract shall be set out in writing in the Form No. 2 in the Schedule hereto, and such particulars shall be signed by each of the parties to such contract in the presence of a witness who shall affix his signature thereto.

6. A prohibition order under section 7 of the Act shall be in the Form No. 3 in the Schedule hereto.

7. An application for a licence under section 8 of the Act shall be in the Form No. 4 in the Schedule hereto and shall be made by sending an application in the said form, duly completed, by prepaid post to the Secretary, Department of Agriculture, Dublin.

8. A licence under section 8 of the Act shall be in the Form No. 5 in the Schedule hereto.

9. For the purposes of section 10 of the Act,

(

a

) a requisition under sub-section (1) of the said section shall be in the Form No. 6 in the Schedule hereto,

(

b

) such requisition shall be sent to the Minister by sending the same by post to the Secretary, Department of Agriculture, Dublin,

(

c

) such requisition may be so sent at any time after the refusal to which the requisition relates,

(

d

) the prescribed fee shall be the sum of one pound.

FORESTRY ACT, 1928, REGULATIONS, 1930.

WHEREAS the

Forestry Act, 1928

(No. 34 of 1928), will come into operation on the 1st day of April, 1930, by virtue of an order entitled the

Forestry Act, 1928

(Commencement) Order, 1930, made on the 19th day of February, 1930, by the Minister for Agriculture under sub-section (2) of section 20 of that Act

AND WHEREAS it is enacted by section 16 of the said

Forestry Act, 1928

, that the Minister for Agriculture may by order make regulations prescribing any matter or thing referred to in that Act as prescribed

AND WHEREAS the several matters and things intended to be prescribed by these regulations are in the said Act referred to as prescribed

AND WHEREAS the making of these regulations before the commencement of the said Act is expedient for the bringing of the said Act into operation at the date of the commencement thereof

NOW I, PATRICK HOGAN, Minister for Agriculture, in exercise of the powers conferred on me by the joint operation of the

Forestry Act, 1928

(No. 34 of 1928), and sub-section (3) of

section 11

of the

Interpretation Act, 1923

(No. 46 of 1923), and of every and any other power me in this behalf enabling, do by this Order make the following Regulations, that is to say:—
