(õ) 8.06.09 12:30 Eesti Vabariigi valitsuse ja Bulgaaria Vabariigi valitsuse vahelise sõitjate ja veose rahvusvahelise autoveo alase kokkuleppe eelnõu heakskiitmine Välisministeeriumi teadaanne välislepingu jõustumise kohta Sõlmitud 18. mail 1999. a, jõustunud 12. augustil 1999. a Eesti Vabariigi valitsus ja Bulgaaria Vabariigi valitsus, edaspidi nimetatud «lepingupooled», soovides aidata kaasa oma riikide vaheliste kaubandus- ja majandussuhete arendamisele; otsustades turumajanduse raames edendada autoveo alast koostööd; huvitudes keskkonnakaitsest, energia säästlikust kasutamisest, liiklusohutusest ja sõidukijuhtide töötingimuste parandamisest; püüeldes edaspidi intermodaalsete vedude arendamisele; võttes arvesse ÜRO Euroopa Majanduskomisjoni, Euroopa Transpordiministrite Konverentsi (ECMT) ja Pan-Euroopa Konverentside raames vastu võetud otsuseid ja põhimõtteid ning Euroopa Liidu ja kolmandate riikide vahelisi kokkuleppeid; tunnistades autoveo kokkuleppe vastastikust kasulikkust ja huvi; on otsustanud ja leppinud kokku alljärgnevas: I. ÜLDSÄTTED Artikkel 1. Rakendusvaldkond 1. Käesolev kokkulepe rakendub lepingupoole territooriumil asutatud vedajate poolt ning sama lepingupoole territooriumil registreeritud sõidukitega teise lepingupoole territooriumile, territooriumilt, territooriumil või transiidina läbi selle territooriumi teostatavale autoveole. 2. 5. Kui vedu organiseeritakse mitme veopartneri vahelise kokkuleppe alusel, väljastatakse luba juhtivale firmale, kusjuures loale märgitakse kõikide kokkuleppes osalevate vedajate nimetused eeldusel, et vedu teostatakse juhtiva firma poolt. 6. Ühiskomisjon võib pendelvedude korral kehtestada rohkem liberaalsema korra. Artikkel 4. Juhuvedu 1. Võõrustaja riigi territooriumil on lubadest vabastatud järgmised juhuveoteenused: 1.1. «suletud ustega» sõidud, kus sama buss veab sama sõitjate gruppi kogu teekonna ulatuses ning toob selle lähtekohta tagasi; 1.2. veoteenused, mille korral sõit sihtkohta toimub sõitjatega ja tagasisõit tühjalt; 1.3. veoteenused, mille korral sõit sihtkohta toimub tühjalt ja tagasisõit sõitjatega tingimusel, et sõitjad: a) moodustavad grupi veolepingu alusel, mis on sõlmitud enne nende saabumist lepingupoole territooriumile, kus nad peale võetakse ja veetakse asutajariigi territooriumile; b) kes on eelnevalt sama vedaja poolt lepingupoole territooriumile toodud, uuesti peale võetakse ja veetakse asutajariigi territooriumile; c) on kutsutud asutajariigi territooriumile ning küllakutsuja kannab veokulud; 1.4. kui sõidetakse asendama avariilist bussi võõrustajariigis. 2. Juhuveoteenuste, mis ei vasta käesoleva artikli punktis 1 sätestatud tingimustele, teostamiseks bussidega võõrustajariigi territooriumil on vajalik lähte- ja sihtkoha ning vajaduse korral transiidina läbitavate riikide pädevate valitsusasutuste luba. 3. Niisugusel juhul on ühiskomisjonil õigus kehtestada liberaliseerimistingimused. 4. Artiklis 14 sätestatud ühiskomisjon määrab kindlaks lubade väljastamise korra. 5. Loanõudest vabastatud juhuveod bussidega toimuvad kontrolldokumendi alusel. Artikkel 5. 2. Kabotaažveod on lubatud ainult võõrustajariigi eriloaga. Kohalikke vedusid, mida teostatakse ainult sõitjate grupiga, kes on sama vedaja poolt sellesse asukohta toodud, ei loeta kabotaažvedudeks eeldusel, et need on kantud sõidulehele. 3. Esimene sõit äsja ostetud bussiga on loakohustusest vabastatud. III. VEOSEVEDU Artikkel 6. Lubade süsteem 1. Ühe lepingupoole territooriumil asutatud vedajad võivad kindlaks määratud lubade süsteemi alusel teostada: a) vedusid lepingupoolte territooriumide vahel ja transiidina läbi nende territooriumide; b) vedusid kolmanda riigi territooriumile ja kolmanda riigi territooriumilt. 2. Kabotaažveod on lubatud ainult võõrustajariigi eriloaga. Artikkel 7. 2. Ühiskomisjonil on õigus täiendada käesoleva artikli punktis 1 toodud loanõudest vabastatud vedude loetelu. Artikkel 8. Lubade väljastamise kord 1. Lepingupoolte pädevad valitsusasutused vahetavad igal aastal kokkulepitud arvu lubade blankette. 3. Luba saab kasutada samal ajal ainult ühele sõidukile korraga. Autorongi puhul on loa väljastamisel või sellest vabastamisel määravaks teguriks mootorsõiduk. 4. Ühiskomisjon määrab kindlaks lubade kvoodi, liigid ja mis tahes muud lubade kasutamist määravad tingimused. IV. ÜHISSÄTTED Artikkel 9. Maksusätted 1. Veod, mida teostatakse käesoleva kokkuleppe kohaselt ühe lepingupoole territooriumil registreeritud sõidukitega ajutiselt teise lepingupoole territooriumil, on vabastatud kõikidest sõiduki omamise ja registreerimisega seotud maksudest. 2. Kütus, mis asub valmistajatehase poolt sõidukile paigaldatud kütusepaakides ja on ette nähtud sõiduki liikumiseks ja veose kindlal temperatuuril säilitamiseks, samuti määrdeained ja varuosad, on vabastatud võõrustajariigi territooriumil impordimaksudest tingimusel, et vedaja täidab vastavaid tollieeskirju. 3. Artikkel 12. Kontroll Load, kontrolldokumendid ja muud dokumendid, mis on nõutavad lisaks käesolevale kokkuleppele, peavad asuma sõidukis ja need tuleb esitada selleks volitatud ametiisiku nõudmisel. Artikkel 13. Kohustused vedajale ja sanktsioonid õigusrikkumiste korral 1. Ühe lepingupoole vedajad on kohustatud teise lepingupoole territooriumil järgima mitmepoolsetest rahvusvahelistest kokkulepetest, milles lepingupooled osalevad, käesolevast kokkuleppest, teistest kahepoolsetest kokkulepetest ja riiklikest õigusaktidest, eeskätt liikluseeskirjadest, tollikorraldustest ja lubadega seotud tingimustest ja piirangutest tulenevaid kohustusi. 2. Raskemate ja korduvate õigusrikkumiste korral võõrustajariigi territooriumil võivad võõrustajariigi pädevate valitsusasutuste nõudmisel asutajariigi pädevad valitsusasutused kriminaalkohtumenetlust rakendamata võtta tarvitusele alljärgnevaid administratiivkaristusi: – hoiatus; – ajutine sissesõidukeeld lepingupoole territooriumile; – sissesõidukeeld lepingupoole territooriumile, kus õigusrikkumine toimus. Eriti raskete õigusrikkumiste korral võib võõrustajariigi pädev valitsusasutus keelata ajutiselt sissesõidu, oodates asutajariigi pädeva valitsusasutuse otsust. Lepingupooled informeerivad teineteist vastuvõetud otsustest. Artikkel 14. 2. Pädevateks valitsusasutusteks on: – Eesti Vabariigis: Teede- ja Sideministeerium; – Bulgaaria Vabariigis: Transpordiministeerium. 3. Käesoleva artikli punktis 1 sätestatu kohaselt moodustatakse ühiskomisjon, mis koosneb mõlema lepingupoole esindajatest. Ühiskomisjon vastutab käesoleva kokkuleppe artiklite 3, 4, 7, 8, 9 ja 11 rakendamise eest ja kõikide küsimuste, mis puudutavad lepingupoolte vahelisi autoveo alaseid suhteid, lahendamise eest, kaasa arvatud küsimused liiklusohutusest, keskkonnakaitsest, juhtide tööõigustest, tehnilistest probleemidest, ettevõtete vahelise ja intermodaalse koostöö edendamisest ning kriiside lahendamisest. V. LÕPPSÄTTED Artikkel 15. Kokkuleppe jõustumine ja kehtivus 1. Käesolev kokkulepe jõustub kuupäeval, mil lepingupooled on teise diplomaatilise noodiga teineteisele teatanud käesoleva kokkuleppe jõustamiseks vajalike põhiseaduslike nõuete täitmisest. 2. Käesolev kokkulepe jääb jõusse määramata ajaks, kuni üks lepingupool selle diplomaatiliste kanalite kaudu kirjaliku teatega lõpetab. Sellisel juhul lõpeb kokkulepe kuue kuu möödumisel teise lepingupoole poolt ülalnimetatud teate kättesaamise päevast. Eeltoodu kinnituseks on valitsuste täievolilised esindajad kirjutanud alla käesolevale kokkuleppele. Sõlmitud kahes eksemplaris Varssavis 18. mail1999. aastal eesti, bulgaaria ja inglise keeles, kõik tekstid on autentsed. Erinevate tõlgenduste korral prevaleerib ingliskeelne tekst. Eesti Vabariigi valitsuse poolt Toivo JÜRGENSON Bulgaaria Vabariigi valitsuse poolt Wilhelm KRAUSS Agreement between the Government of the Republic of Estonia and the Government of the Republic of Bulgaria on International Road Transport of Passengers and Goods The Government of the Republic of Estonia and the Government of the Republic of Bulgaria, hereinafter referred to as the “Contracting Parties”, Anxious to contribute to the development of trade and economic relations between their countries; Determined to promote co-operation in road transport within the framework of the market economy; Concerned about environment protection, the rational use of energy, road safety and the improvement of drivers’ working conditions; Aiming towards the development of transport intermodality; Taking into account the resolutions and principles adopted within the framework of the United Nations Economic Commission for Europe, the European Conference of Ministers of Transport (ECMT), the Pan-European Conferences and agreements between the European Union and third countries; Recognising the mutual advantage and interest of an agreement on road transport; Have decided and agreed as follows: I. GENERAL PROVISIONS Article 1. Scope 1. The present Agreement applies to road transport by transport operators established on the territory of a Contracting Party by means of vehicles registered on that territory and operating to, from, in or in transit through the territory of the other Contracting Party. 2. The present Agreement does not affect the rights and obligations arising from other international commitments of the Contracting Parties. Article 2. Definitions In this Agreement: “Transport Operator” means any natural person or any legal person established on the territory of one of the Contracting Parties, which transports passengers or goods for which it is paid or on its own account in accordance with the requirements of the national legislation regulating the access to the occupation of transport operator and to the market. “Transport” means the operations of a vehicle, either laden or unladen even if the vehicle, trailer or semi-trailer is carried by train or boat for part of the journey. “Cabotage” means the transport operations on the territory of the Contracting Party, the host country, with the loading and unloading points being located on that territory, of a transport operator established on the territory of the other Contracting Party. The unladen runs of a vehicle within a territory between two international transport operations and the initial or terminal national legs of an international combined transport operation are not considered to be cabotage. “Combined transport” means the transport of goods whereby the lorry, trailer, semi-trailer, swap body or container, with or without tractor, use the road for the initial or terminal leg of the journey and travel by rail, waterway or sea for the rest of the journey. “Vehicle” means a motor vehicle: – on its own or a combination of vehicles; – intended for the carriage of passengers or goods by road, – at the disposal of the transport operator through being its own property or through a hiring or leasing contract. “Bus” and “Coach” mean vehicles which are built and designed specially for the transport of persons which has, in addition to the driver’s seat, more than eight seating places. “Registration” means the allocation of an identification number to the vehicle by a competent authority. In case of a combination of vehicles, the motor vehicle is the determining factor in permit issue or exemption. “Territory of a Contracting Party” means respectively the territory of the Republic of Estonia and the territory of the Republic of Bulgaria. “Country of establishment” means the territory of a Contracting Party within which the transport operator is established and the vehicle registered. “Host country” means the territory of a Contracting Party in which the vehicle is operating without being registered there and without the transport operator being established there. “Regular passenger service” means a service by bus or coach which carries passengers over a specified route according to a timetable, and for which set fares are charged. Passengers are picked up or set down at predetermined stopping points and the service is accessible to everyone notwithstanding, in some cases, the need to book. No matter who is organizing the service, the term “regular passenger service” includes also a service which carries specified categories of passengers to the exclusion of other categories of passengers in case that this service meets the above criteria. This service is called “special regular service”. “Shuttle service” means a service by bus or coach whereby, by means of repeated outward and return journeys, previously formed groups of passengers are carried from a single place of departure to a single destination. Each group, consisting of the passengers who made the outward journey, is carried back to the place of departure on a later journey. Place of departure and destination respectively mean the place where the journey begins and the place where the journey ends, together with, in each case, the surrounding locality within a 50 km radius. The first return journey and the last outward journey in a series of shuttles are made unladen. The definition of a shuttle service is not affected by the fact that some passengers make the return journey with another group, nor by the fact that the first outward journey and the last return journey are made unladen. This type of shuttle service is called “reversed shuttle”. A shuttle service which provides accommodation for at least 80 per cent of passengers at destination and, if need be, on the journey, with or without meals, is called a “shuttle with accommodation”. “Occasional service” means a service by bus or coach falling neither within the definition of a regular passenger service nor within the definition of a shuttle service. The frequency or number of services does not affect their classification as an occasional service. “Control document” means the waybill for buses and coaches, the form of which is agreed upon and confirmed by the Joint Committee referred to in Article 14. II. PASSENGER TRANSPORT Article 3. Regular and shuttle services 1. Regular and shuttle services operated by bus or coach are subject to a system of authorizations issued by the competent authorities in the countries of departure, destination and transit. 2. The application for authorization should be made to the competent authority in the country of establishment of the transport operator. If the authority approves the application for authorization, the application is communicated to the competent authority of the host country. The decision to grant or refuse an authorization should be taken by the competent authority of the host country within a period of three months unless there are special circumstances. If the competent authority of the host country approves the application for authorization, the competent authority of the country of establishment communicates the application also to the competent authorities of the countries of transit. The Joint Committee set up under Article 14 of the present Agreement, hereinafter called the Joint Committee, decides on the form that the application for authorization takes and the supporting documents required. 3. The authorizations of the competent authorities of the countries of departure, destination and transit are issued to the transport operator by the competent authority of the country of establishment. Authorizations are valid for a maximum of five years. They set out the operating conditions. 4. Changes in operating conditions and the cancellation of the service are decided under the procedures set out in paragraph 2 of the present Article. If there is no longer any demand for the service, the operator can cancel it giving three months notice to both the competent authority which issued the authorizations and to customers. 5. If a service is being operated on a sub-contracted basis, a permit is issued to the leading firm in which the names of the sub-contractors are mentioned provided that the transport is carried out on behalf of the leading firm. 6. The Joint Committee can establish more liberal regime for the shuttle service. Article 4. Occasional services 1. The services listed below are exempt from any authorization system on the territory of the host country: 1.1. closed-door tours whereby the same bus or coach is used to carry the same group of passengers throughout the journey and to bring them back to the place of departure; 1.2. services which make the outward journey laden and the return journey unladen; 1.3. services which make the outward journey unladen and the return journey laden, provided that passengers: a) constitute a group formed under a contract of carriage entered into before their arrival in the territory of the Contracting Party where they are picked up and carried to the territory of the country of establishment; b) have been previously brought by the same carrier into the territory of the Contracting Party where they are picked up again and carried into the territory of the country of establishment; c) have been invited to the territory of the country of establishment, the cost of transport being borne by the person issuing the invitation; 1.4. runs by bus or coach sent to replace a bus which has broken down in the host country. 2. The occasional services not mentioned in paragraph 1 of the present Article operated by bus or coach are subject to a system of authorizations issued by the competent authority in the countries of departure and destination, and, if necessary, in the transit countries. 3. Picking up of passengers on a liberalised service journey is not permitted unless special authorisation is granted. The Joint Committee may extend the authorization exemption to other occasional services, in particular to services where passengers are picked up on the journey and to other services set out in sub-paragraph 1.3 of the paragraph 1 of the present Article.
