Artikkel 2. Erimissiooni saatmine Riik võib erimissiooni teise riiki saata ainult viimase nõusolekul, mis peab olema saadud diplomaatilisi või muid mõlemale poolele vastuvõetavaid kanaleid kaudu. Artikkel 3. Erimissiooni ülesanded Erimissiooni ülesanded määravad vastastikusel kokkuleppel lähetajariik ja asukohariik. Artikkel 4. Sama erimissiooni saatmine kahte või enamasse riiki Riik, kes soovib saata sama erimissiooni kahte või enamasse riiki, peab riigi nõusoleku küsimisel teavitama sellest eraldi iga asukohariiki. Artikkel 5. Kahe või enama riigi ühise erimissiooni saatmine Kaks või enam riiki, kes soovivad saata teise riiki ühise erimissiooni, peavad riigi nõusoleku küsimisel viimast sellest teavitama. Artikkel 6. Kahe või enama riigi ühise erimissiooni saatmine ühist huvi pakkuvas küsimuses Kaks või enam riiki võivad igaüks ühel ajal saata erimissiooni teise riiki, kui selleks on artikli 2 kohaselt saavutatud viimase nõusolek. Erimissioonid võivad kõigi asjaomaste riikide nõusolekul tegeleda ühist huvi pakkuva küsimusega. Artikkel 7. Artikkel 23. Hooned ja majutus Asukohariik aitab erimissiooni viimase taotlusel vajalike hoonete muretsemises ning erimissiooni liikmetele sobivate majutusvõimaluste leidmises. Artikkel 24. Erimissiooni hoonete vabastamine maksudest 1. Vastavalt erimissiooni tegevuse kestusele ja iseloomule vabastatakse lähetajariik ja erimissiooni nimel tegutsevad erimissiooni liikmed kõigist riiklikest, piirkondlikest või kohalikest maksudest, mida võetakse erimissiooni kasutuses olevatelt hoonetelt, välja arvatud tasu osutatud teenuste eest. 2. 3. Erimissiooni hooneid, sisseseadet, muud omandit, mida kasutatakse erimissiooni töös, ning erimissiooni transpordivahendeid ei tohi läbi otsida, rekvireerida, ära võtta ega neile täitenõuet pöörata. Artikkel 26. Arhiivi ja dokumentide puutumatus Erimissiooni arhiiv ja dokumendid on alati ja igal pool puutumatud. Kui vajalik, peaks neil olema nähtavad välised tunnusmärgid. Artikkel 27. Liikumisvabadus Asukohariik tagab kõigile erimissiooni liikmetele oma territooriumil reisimis- ja muu liikumisvabaduse, mis on vajalik erimissiooni ülesannete täitmiseks, arvestades siiski eeskirju niisuguste tsoonide kohta, millesse sisenemine on riigi julgeoleku huvides keelatud või piiratud. Artikkel 28. Sidepidamisvabadus 1. 2. Erimissiooni ametlik kirjavahetus on puutumatu. 3. Võimaluse korral kasutab erimissioon lähetajariigi alalise diplomaatilise esinduse sidepidamisvahendeid, kaasa arvatud postikotti ja kullerit. 4. Erimissiooni postikotti ei avata ega peeta kinni. 5. Erimissiooni postikotis olevatel pakkidel peab olema selgesti nähtav märge nende olemuse kohta ning nad võivad sisaldada ainult dokumente või muid erimissioonile ametlikuks kasutamiseks mõeldud asju. 6. 8. Erimissiooni postikoti võib anda ametlikus sisenemispunktis maabuva laeva või kaubanduslikul eesmärgil käitatava õhusõiduki kapteni kätte. Talle antakse ametlik dokument postikotis olevate saadetiste arvu kohta, kuid teda ei peeta erimissiooni kulleriks. Pädevate asutustega võib kokku leppida, et üks erimissiooni liige võtab postikoti vabalt vastu otse laeva või õhusõiduki kaptenilt. Artikkel 29. 2. Erimissioonis lähetajariiki esindavatel isikutel ja erimissiooni diplomaatilisel personalil on immuniteet asukohariigi kriminaaljurisdiktsiooni suhtes. 2. Neil on immuniteet ka tsiviil- ja haldusjurisdiktsiooni suhtes, välja arvatud järgmistes asjades: a) kinnisvaratehing, mis on seotud asukohariigi territooriumil asuva erakinnisvaraga, mis ei ole isiku käsutuses lähetajariigi nimel erimissiooni huvides; b) pärimine, millega seoses asjaomane isik eraisikuna ja mitte lähetajariigi nimel on testamenditäitja, haldaja, pärija või annakusaaja; c) kutse- või äritegevus asukohariigis väljaspool asjaomase isiku ametiülesandeid; d) avarii, mille asjaomane isik sooritas sõiduvahendiga väljaspool ametiülesandeid ja mille tulemusel tekitati kahju. 3. Artikkel 35. Tollimaksudest ja -läbivaatusest vabastamine 1. Vastavalt oma õigusaktidele lubab asukohariik sisse tuua ja vabastab kõigist tollimaksudest (v.a tasud ladustamise, veo ja muude sarnaste teenuste eest): a) esemed erimissiooni ametlikuks kasutamiseks; b) esemed erimissioonis lähetajariiki esindavate isikute ja erimissiooni diplomaatilise personali isiklikuks kasutamiseks. 2. 4. Immuniteedist loobumist tsiviil- või haldusjurisdiktsiooni suhtes ei saa lugeda immuniteedist loobumiseks kohtuotsuse täitmise suhtes. Viimase jaoks on vaja eraldi loobumist. Artikkel 42. 3. Erimissiooni liikme surma korral kasutavad tema perekonnaliikmed neile ettenähtud privileege ja immuniteeti küllaldaselt pika aja jooksul, mille lõppedes nad peaksid territooriumilt lahkuma. Artikkel 44. Artikkel 50. Allakirjutamine Konventsioon on kuni 31. detsembrini 1970. a ÜRO peakorteris New Yorkis avatud allakirjutamiseks kõigile ÜRO liikmesriikidele ja spetsialiseeritud asutustele, Rahvusvahelise Tuumaenergiaagentuuri liikmesriikidele, Rahvusvahelise Kohtu põhikirja osalistele ja kõigile teistele riikidele, keda ÜRO Peaassamblee on kutsunud selle konventsiooniga ühinema. Artikkel 51. Ratifitseerimine Konventsioon tuleb ratifitseerida. Ratifitseerimiskirjad deponeeritakse ÜRO peasekretäri juurde. Artikkel 52. Artikkel 54. Depositaari teated ÜRO peasekretär teavitab kõiki riike, kes kuuluvad mõnda artiklis 50 nimetatud kategooriatest, järgmisest: a) konventsiooni artiklite 50, 51 ja 52 kohane allakirjutamine ja ratifitseerimis- või ühinemiskirjade deponeerimine; b) konventsiooni artikli 53 kohase jõustumise kuupäev. Artikkel 55. Autentsed tekstid Konventsiooni originaal, mille hiina-, hispaania-, inglis-, prantsus- ja venekeelne tekst on võrdselt autentsed, deponeeritakse ÜRO peasekretäri juurde, kes saadab tõestatud koopiad riikidele, kes kuuluvad mõnda artiklis 50 nimetatud kategooriatest. Selle kinnituseks on valitsuste täievolilised esindajad 16. detsembril 1969. a New Yorgis allakirjutamiseks avatud konventsioonile alla kirjutanud. CONVENTION ON SPECIAL MISSIONS The States Parties to the present Convention, Recalling that special treatment has always been accorded to special missions, Having in mind the purposes and principles of the Charter of the United Nations concerning the sovereign equality of States, the maintenance of international peace and security and the development of friendly relations and cooperation among States, Recalling that the importance of the question of special missions was recognized during the United Nations Conference on Diplomatic Intercourse and Immunities and in resolution I adopted by the Conference on 10 April 1961, Considering that the United Nations Conference on Diplomatic Intercourse and Immunities adopted the Vienna Convention on Diplomatic Relations, which was opened for signature on 18 April 1961, Considering that the United Nations Conference on Consular Relations adopted the Vienna Convention on Consular Relations, which was opened for signature on 24 April 1963, Believing that an international convention on special missions would complement those two Conventions and would contribute to the development of friendly relations among nations, whatever their constitutional and social systems, Realizing that the purpose of privileges and immunities relating to special missions is not to benefit individuals but to ensure the efficient performance of the functions of special missions as missions representing the State, Affirming that the rules of customary international law continue to govern questions not regulated by the provisions of the present Convention, Have agreed as follows: Article 1.
