(õ) 12.04.10 17:10 Lepingu ratifitseerimise seadus Välisministeeriumi teadaanne vabakaubanduslepingu lõppemise kohta Eesti Vabariigi valitsus ühelt poolt ja Taani valitsus ja Fääri saarte kohalik omavalitsus teiselt poolt, edaspidi «pooled», meenutades Fääri saarte omavalitsuslikku staatust Taani osana, meenutades 27. novembril 1997. a Tórshavnis allakirjutatud Eesti Vabariigi valitsuse ning Taani valitsuse ja Fääri saarte kohaliku omavalitsuse vahelist vabakaubanduslepingut, mis jõustus 1. detsembril 1998. a, meenutades, et vastavalt vabakaubanduslepingu artiklile 31 saab kumbki lepingupool 12-kuulise kirjaliku etteteatamisega vabakaubanduslepingu lõpetada, arvestades Eesti Vabariigi tulevast ühinemist Euroopa Liiduga, mis peaks 16. aprillil 2003. a Ateenas allakirjutatud ühinemislepingu kohaselt jõustuma 1. mail 2004. a, meenutades ühelt poolt Euroopa Ühenduse ja teiselt poolt Taani valitsuse ja Fääri saarte kohaliku omavalitsuse 6. detsembri 1996. a kokkulepet, mis reguleerib Fääri saarte ja Euroopa Ühenduse vahelist kaubandust, arvestades Eesti vajadust alates Euroopa Liiduga ühinemise kuupäevast pidada Fääri saartega kaubavahetust Fääri saarte ja Euroopa Ühenduse vahelise kaubanduskokkuleppe alusel, tunnistades vajadust lõpetada Eesti Vabariigi valitsuse ning Taani valitsuse ja Fääri saarte kohaliku omavalitsuse vaheline vabakaubandusleping päeval, mil Eesti Vabariik ühineb Euroopa Liiduga, vaatamata vabakaubanduslepingu artiklis 31 sätestatud 12-kuulise etteteatamise nõudele, on kokku leppinud järgmises. Artikkel 1 Eesti Vabariigi valitsuse ning Taani valitsuse ja Fääri saarte kohaliku omavalitsuse vaheline vabakaubandusleping lõpetatakse kuupäeval, mil Eesti Vabariik ühineb Euroopa Liiduga. Artikkel 2 Käesolev leping jõustub kuupäeval, mil lepingupooled on vahetanud lepingu jõustumiseks vajalike siseriiklike nõuete täitmist kinnitavad diplomaatilised noodid. Koostatud 11. märtsil kahe tuhande neljandal aastal Kopenhaagenis kolmes eksemplaris inglise keeles. Eesti Vabariigi valitsuse nimel Taani valitsuse nimel Fääri saarte kohaliku omavalitsuse nimel Taavi TOOM Karsten SØNDERGAARD Tryggvi JOHANSEN AGREEMENT ON THE TERMINATION OF THE FREE TRADE AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF ESTONIA AND THE GOVERNMENT OF DENMARK AND THE HOME GOVERNMENT OF THE FAROE ISLANDS Done at Copenhagen on the 11 of March, 2004 The Government of the Republic of Estonia, of the one part, and the Government of Denmark and the Home Government of the Faroe Islands, of the other part, hereinafter referred to as “the Parties”, Recalling the status of the Faroe Islands as a self-governing part of Denmark, Recalling the Free Trade Agreement between the Government of the Republic of Estonia and the Government of Denmark and the Home Government of the Faroe Islands, signed at Tórshavn on 27 November 1997, which entered into force on 1 December 1998, Recalling that according to its Article 31 the Free Trade Agreement can be terminated by written notification by either Contracting Party with 12 months’ notice, Considering the forthcoming accession of the Republic of Estonia to the European Union, expected to take effect on 1 May 2004 in conformity with the Accession Treaty, signed at Athens on 16 April 2003, Recalling the Agreement of 6 December 1996 between the European Community, of the one part, and the Government of Denmark and the Home Government of the Faroe Islands, of the other part, regulating trade between the Faroe Islands and the European Community, Considering the need for Estonia to be able to conduct its trade with the Faroe Islands in accordance with the Agreement on trade between the Faroe Islands and the European Community from the date of its accession to the European Union, Acknowledging the need to terminate the Free Trade Agreement between the Government of the Republic of Estonia and the Government of Denmark and the Home Government of the Faroe Islands on the date of the accession of the Republic of Estonia to the European Union, notwithstanding the 12 months’ notice laid down in Article 31 of the Free Trade Agreement. Have agreed as follows: Article 1 The Free Trade Agreement between the Government of the Republic of Estonia and the Government of Denmark and the Home Government of the Faroe Islands shall be terminated with effect from the date of Estonia’s accession to the European Union. Article 2 This Agreement shall enter into force on the day on which the Parties have exchanged diplomatic notes confirming the completion of their respective procedures necessary for the entry into force of this Agreement.
