Vabariigi Valitsus — Eesti Vabariigi valitsuse ja Taani Kuningriigi valitsuse vaheline kokkulepe diplomaatilise esinduse, konsulaarasutuse või rahvusvahelise organisatsiooni juures asuva esinduse töötaja ülalpeetavate töötamise kohta vastuvõtvas riigis — RT II, 2003, 20, 100

(õ) 25.01.10 12:45 Vabariigi Valitsuse 14.08.2002 korraldus nr 533 kokkuleppe eelnõu heakskiitmise kohta Välisministeeriumi teadaanne välislepingu jõustumise kohta Sõlmitud nootide vahetamise teel 27. augustil 2002. a, jõustunud 27. augustil 2002. a Kuninglik Taani saatkond avaldab oma lugupidamist Eesti Vabariigi Välisministeeriumile ja tal on au teha ettepanek sõlmida järgnev kokkulepe Eesti Vabariigi valitsuse ja Taani Kuningriigi valitsuse vahel diplomaatilise esinduse, konsulaarasutuse või rahvusvahelise organisatsiooni juures asuva esinduse töötaja ülalpeetavate töötamise kohta. Kaks valitsust lepivad vastastikkuse põhimõttel kokku, et ühe valitsuse poolt teise riiki nimetatud diplomaatilise esinduse, konsulaarasutuse või rahvusvahelise organisatsiooni juures asuva esinduse töötajate ülalpeetavad võivad asuda tööle vastuvõtvas riigis. Töötamisele ei seata piiranguid töö liigi osas. Kui tööle võtmisele on kehtestatud kutsenõuded, peab ülalpeetav neile vastama. Samuti võib tööloa andmisest keelduda juhul, kui julgeolekukaalutlustel on lubatud tööle võtta ainult vastuvõtva riigi kodanikke. Tööluba vastuvõtvas riigis lõpeb töötaja lähetuse lõppedes. Kokkuleppest tulenevad ainult otseselt töötamisega seonduvad õigused. Kokkuleppes tähendab «töötaja» poole diplomaatilise, konsulaar-, haldus- või tehnilise personali liiget, kes on nimetatud täitma ametikohustusi teises riigis asuvasse diplomaatilisse esindusse, konsulaarasutusse või esindusse rahvusvahelise organisatsiooni juures. «Ülalpeetav» tähendab töötaja a) abikaasat või elukaaslast (püsiv kooselu pikema aja jooksul); b) vallalist alla 21 aasta vanust ülalpeetavat last või vallalist alla 23 aasta vanust ülalpeetavat last, kes õpib kõrgkooli päevases õppevormis; c) vallalist ülalpeetavat füüsilise või vaimse puudega last. Kokkuleppe alusel töötavad ülalpeetavad on kohustatud maksma vastuvõtvas riigis kehtestatud tulumaksu ja sotsiaalkindlustuse makseid igasuguse sellise töötamise eest saadava tasu pealt. Juhul kui ülaltoodud ettepanekud on Eesti Vabariigi valitsusele vastuvõetavad, on Taani saatkonnal au teha ettepanek, et see noot ja Eesti Vabariigi Välisministeeriumi nõusolev vastus moodustavad lepingu kahe valitsuse vahel, mis jõustub Eesti Vabariigi Välisministeeriumi vastuse kuupäeval ja jääb jõusse 90 päeva möödumiseni kirjaliku teatise laekumise kuupäevast, millega ühe riigi valitsus teatab oma soovist kokkulepe lõpetada. Kuninglik Taani saatkond kasutab võimalust avaldamaks veelkord oma sügavaimat lugupidamist Eesti Vabariigi Välisministeeriumile. [AGREEMENT BETWEEN THE GOVERNMENT OF THE KINGDOM OF DENMARK AND THE GOVERNMENT OF THE REPUBLIC OF ESTONIA FOR THE EMPLOYMENT OF DEPENDANTS OF MEMBERS OF A DIPLOMATIC MISSION, CONSULAR OFFICE OR MISSION TO AN INTERNATIONAL ORGANIZATION] To: Royal Danish Embassy Ministry of Foreign Affairs No. 012 3.Dan.2 of the Republic of Estonia Tallinn The Royal Danish Embassy presents its compliments to the Ministry of Foreign Affairs of the Republic of Estonia and has the honour to propose the conclusion of the following agreement between the Government of the Kingdom of Denmark and the Government of the Republic of Estonia for the employment of dependants of members of a diplomatic mission, consular office or mission to an international organization. The two governments agree, on the basis of reciprocity, that dependants of employees of one Government assigned to official duty in the other country as members of a diplomatic mission, consular office or mission to an international organization may receive authorization to accept paid employment in the receiving State. No restriction will be placed on the type of employment that may be undertaken. It is understood however, that in professions where particular qualifications are required, it will be necessary for the dependant to meet those qualifications. Further, authorization to accept employment may be denied in cases where, for security reasons, only nationals of the receiving State may be employed. Any Authorization to accept employment in the receiving State will be terminated at the end of assignment of the employee. The Agreement does not provide any further rights except the ones following directly from the relation of employment. For the purpose of this arrangement, “employee(s)” means diplomatic, consular, administrative and technical personnel of either one of the contracting parties appointed to carry out official duties as a member of a diplomatic mission, consular office or mission to an international organization in the other country. “Dependant(s)” means employees (a) spouses or the applicants cohabitant (regular cohabitation of a prolonged period); (b) unmarried dependant children under 21, or under 23 if in full-time attendance at a post-secondary educational institution; and (c) unmarried dependant children who are physically or mentally disabled. Before a dependant may accept employment in the receiving State, the Embassy of the sending State will make an official request to the Protocol Division of the Ministry of Foreign Affairs. Upon verification that the person in question falls within the categories defined in the arrangement, and after processing the request according to domestic legislation, the Embassy will be informed that the person may accept paid employment, subject to the applicable regulations of the receiving State. For dependants who obtain employment under this arrangement and who have immunity from jurisdiction of the receiving State in accordance with the Vienna Conventions on Diplomatic and Consular Relations or any other international instrument applicable, immunity from civil and administrative jurisdiction with respect to all matters arising out of such employment is hereby irrevocably waived by the sending State. In the event that a dependant who has immunity from criminal jurisdiction in accordance with the Vienna Convention on Diplomatic Consular Relations or any other international instrument applicable is accused of a criminal offence committed in relation to his or her employment, the sending State will give serious consideration to any written request that may be submitted by the receiving State for the waiving of such immunity. Dependants obtaining employment under this arrangement will be required to pay income tax and social security deductions levied by the receiving State on any remuneration arising from such employment. If the foregoing proposals are acceptable to the Government of the Republic of Estonia, the Danish Embassy has the honour to propose this Note and the affirmative reply of the Ministry of Foreign Affairs of the Republic of Estonia will constitute an agreement between the two Governments on this matter, which will enter into effect on the date of the reply of the Ministry of Foreign Affairs of the Republic of Estonia and will remain in effect until terminated by either Government on ninety (90) days notice in writing to the other. The Royal Danish Embassy avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Estonia the assurances of its highest consideration.
