Vabariigi Valitsuse 17.12.2002 korraldus nr 848 memorandumi eelnõu heakskiitmise ja volituste andmise kohta Välisministeeriumi teadaanne välislepingu jõustumise kohta Euroopa Ühenduste Komisjon, edaspidi komisjon, kes tegutseb Euroopa Ühenduse nimel, ühelt poolt ja Eesti Vabariigi valitsus, edaspidi Eesti, teiselt poolt, arvestades, et: 1) tööhõive valdkonda stimuleerivad ühenduse meetmed kehtestati Euroopa Parlamendi ja nõukogu 10. juuni 2002. aasta otsusega 1145/2002/EÜ1; 1 EÜT L 170, 29.06.2002, lk 1. Euroopa Nõukogu otsused on avaldatud Sotsiaalministeeriumi veebilehel http://www.sm.ee. 2) EL–Eesti assotsiatsiooninõukogu 27. veebruari 2002. aasta otsusega 3/2002 on kehtestatud üldtingimused Eesti osalemiseks ühenduse programmides ning antud komisjonile ja Eesti pädevatele asutustele õigus määrata igas konkreetses programmis osalemise eritingimused, sealhulgas osamaksu küsimused, on kokku leppinud järgmises. Artikkel 1. Tööhõive valdkonda stimuleerivad ühenduse meetmed Eesti osaleb tööhõive valdkonda stimuleerivates ühenduse meetmetes (edaspidi tööhõivet stimuleerivad meetmed) kooskõlas EL–Eesti assotsiatsiooninõukogu 27. veebruari 2002. aasta otsusega 3/2002, millega võetakse vastu Eesti osalemise üldtingimused ühenduse programmides, ja käesoleva vastastikuse mõistmise memorandumi artiklites 2–4 sätestatud tingimustel. Artikkel 2. Tööhõive valdkonda stimuleerivates ühenduse meetmetes osalemise tingimused Eesti osaleb tööhõivet stimuleerivates meetmetes vastavalt neile eesmärkidele, kriteeriumidele, korrale ja tähtaegadele, mis on kindlaks määratud Euroopa Parlamendi ja nõukogu 10. juuni 2002. aasta otsuses 1145/2002/EÜ. Nõuetele vastavate Eesti asutuste, organisatsioonide ja üksikisikute taotluste esitamise, hindamise ja valiku tingimused on samad, mida kohaldatakse Euroopa Liidu liikmesriikide korral nõuetele vastavate institutsioonide, organisatsioonide ja üksikisikute suhtes. Tööhõivet stimuleerivates meetmetes osalemiseks tasub Eesti igal aastal Euroopa Liidu üldeelarvesse osamaksu vastavalt allpool olevale artiklile 3. Eesti osamaks seoses tööhõivet stimuleerivates meetmetes osalemise ja nende rakendamisega lisatakse summale, mis on igal aastal Euroopa Liidu üldeelarves ette nähtud kulukohustuste assigneeringutena selleks, et täita rahalisi kohustusi, mis tulenevad mitmesugustest tööhõivet stimuleerivate meetmete rakendamiseks, haldamiseks ja toimimiseks vajalikest meetmetest. Taotluste, lepingute ja aruannetega seotud toimingute ning tööhõivet stimuleerivate meetmete muude haldusaspektide puhul kasutatakse üht ühenduse ametlikest keeltest. Artikkel 3. Osamaks Eesti osamaksu reguleerivad eeskirjad on esitatud I ja II lisas. Osa nimetatud osamaksust võidakse rahastada ühenduse välisabi vahenditest, kui Eesti esitab sellekohase taotluse. Artikkel 4. Aruandlus ja hindamine Ilma et see piiraks Euroopa Ühenduste Komisjoni ja Euroopa Ühenduste Kontrollikoja kohustusi seoses tööhõivet stimuleerivate meetmete järelevalve ja hindamisega, kontrollitakse Eesti osalemist tööhõivet stimuleerivates meetmetes pidevalt partnerluse alusel, kaasates sellesse komisjoni ja Eesti. Eesti esitab komisjonile vastavad aruanded ja võtab osa teistest ühenduse poolt sellega seoses ettenähtud konkreetsetest meetmetest. Artikkel 5. Lõppsätted Käesolevat vastastikuse mõistmise memorandumit kohaldatakse tööhõivet stimuleerivate meetmete kehtivuse ajal. Kui Euroopa Ühendus otsustab seda kehtivusaega pikendada ilma tööhõivet stimuleerivates meetmetes olulisi muudatusi tegemata, pikeneb automaatselt ka käesoleva memorandumi kohaldamisaeg, kui kumbki pool seda ei denonsseeri. Lisad moodustavad käesoleva vastastikuse mõistmise memorandumi lahutamatu osa. Käesolevat vastastikuse mõistmise memorandumit võib muuta ainult kirjalikult poolte kokkuleppe alusel. Käesolev vastastikuse mõistmise memorandum jõustub siis, kui mõlemad pooled on sellele alla kirjutanud. Tallinnas Brüsselis 14. jaanuaril 2003. a 18. veebruaril 2003. a Eesti valitsuse nimel Euroopa Ühenduse Komisjoni nimel Siiri OVIIR Anna DIAMANTOPOULOU Eesti Vabariigi sotsiaalminister tööhõive ja sotsiaalvaldkonna eest vastutav komisjoni liige I lisa EESKIRJAD, MIS REGULEERIVAD EESTI OSAMAKSU TÖÖHÕIVE VALDKONDA STIMULEERIVATES ÜHENDUSE MEETMETES OSALEMISEKS 1. Eesti poolt Euroopa Liidu üldeelarvesse makstav osamaks tööhõivet stimuleerivates meetmetes osalemiseks on järgmine: 30 000 eurot 2003. aastal, 60 000 eurot 2004. aastal, 60 000 eurot aastas järgmistel aastatel kuni ühinemiseni. 2. Eesti osamaks läheb ühist huvi pakkuvate projektide ettevalmistamiseks, teostatavusuuringuteks, arendamiseks ja rakendamiseks, samuti tööhõivet stimuleerivates meetmetes ettenähtud horisontaalmeetmete arendamiseks ja rakendamiseks. 3. Lähetuskulud, mida Eesti esindajad ja eksperdid vajavad Euroopa Parlamendi ja nõukogu 10. juuni 2002. aasta otsuse 1145/2002/EÜ artiklis 9 nimetatud komitee (tööhõivet stimuleerivate meetmete komitee) töös vaatlejatena ning teistel tööhõivet stimuleerivate meetmete rakendamisega seotud kohtumistel osalemiseks, hüvitab komisjon samadel alustel ja samas korras, mida praegu kohaldatakse Euroopa Liidu liikmesriikide esindajate suhtes. 4. Eesti osamaksu haldamisel kohaldatakse Euroopa Liidu üldeelarve suhtes kehtivat finantsmäärust. 5. Komisjon esitab pärast käesoleva vastastikuse mõistmise memorandumi jõustumist ja iga järgmise eelarveaasta alguses Eestile rahastamisnõude, mis käesoleva vastastikuse mõistmise memorandumi kohaselt vastab Eesti osamaksule programmi eelarves. 6. Osamaks makstakse eurodes komisjoni eurokontole. 7. Eesti tasub oma osamaksu iga-aastaste kulude katmiseks vastavalt rahastamisnõudele hiljemalt kolm kuud pärast nõude esitamist. Osamaksu tasumisega viivitamise korral peab Eesti maksma viivist laekumata summalt maksetähtpäevast alates. Intressimäär on sama suur kui maksetähtpäeval Euroopa Keskpanga eurodes tehtavate põhiliste refinantseerimistehingute puhul kehtiv intress, pluss 1,5 protsenti. Kui osamaksu tasumisega viivitamine võib märkimisväärselt kahjustada tööhõivet stimuleerivate meetmete rakendamist ja haldamist, peatatakse selleks aastaks Eesti osalemine tööhõivet stimuleerivates meetmetes, kui maksu ei ole tasutud kahekümne tööpäeva jooksul pärast komisjoni poolt Eestile ametliku meeldetuletuskirja saatmist.
