Artikkel 1. Programm Eesti osaleb aastatel 2003–2008 ühenduse elanikkonna rahvatervise alases tegevusprogrammis (edaspidi Programm) vastavalt EÜ ja Eesti assotsiatsiooninõukogu 27. veebruari 2002. a otsusega nr 3/2002 sätestatud tingimustele Eesti osalemise kohta ühenduse programmides ning vastavalt käesoleva vastastikuse mõistmise memorandumi artiklites 2–4 sätestatud tingimustele. Artikkel 2. Programmis osalemise tingimused 1. Eesti osaleb Programmiga seotud tegevuses vastavalt Euroopa Parlamendi ja nõukogu 23. septembri 2002. a otsusega nr 1786/2002/EÜ määratletud eesmärkidele, kriteeriumidele, protseduurireeglitele ning tähtaegadele ja vastavalt järgmistele tingimustele. 2. Programmis osalemiseks maksab Eesti igal aastal Euroopa Liidu üldeelarvesse osalustasu vastavalt käesoleva memorandumi 3. artiklile. 4. Eesti-poolne osalustasu Programmis osalemiseks ning selle täitmiseks lisatakse summale, mis eraldatakse igal aastal sihtotstarbeliselt Euroopa Liidu üldeelarvest finantskohustuste täitmiseks ning Programmi täitmist, juhtimist ja teenindamist puudutavate mitmesuguste vajalike meetmete rakendamiseks. 5. Aruandlus ja hindamine Ilma et see piiraks Euroopa komisjoni ja ühenduse audiitorite kohtu ülesandeid seoses Programmi täitmise järelevalve ning hindamisega, teostatakse Eesti osaluse üle Programmis partnerluse põhimõtetest lähtudes pidevat järelevalvet, kaasates sellesse Euroopa Komisjoni ja Eesti. Eesti pool kohustub esitama asjakohased aruanded ning osalema antud kontekstis Komisjoni poolt osundatud muudes tegevustes. Artikkel 5. Lõppsätted Käesoleva memorandumi sätteid kohaldatakse Programmi kestel. Juhul kui Euroopa ühendused otsustavad Programmi kehtivusaega ilma selles olulisi muudatusi tegemata pikendada, pikeneb käesoleva memorandumi kehtivusaeg automaatselt sama perioodi võrra, kui kumbki osapool memorandumit ei denonsseeri. Memorandumi lisa moodustab selle lahutamatu osa. Käesolevas vastastikuse mõistmise memorandumis võib muudatusi teha üksnes poolte kirjalikul nõusolekul. Memorandum jõustub selle allakirjutamise kuupäeval. Tallinn, 14. jaanuar 2003 Brüssel, 6. veebruar 2003 Eesti Vabariigi valitsuse nimel Euroopa Ühenduste Komisjoni nimel Siiri OVIIR David BYRNE Eesti Vabariigi sotsiaalminister Tervise- ja Tarbijakaitsekomisjoni liige Lisa I ÜHENDUSE TEGEVUS ELANIKKONNA RAHVATERVISE ALASE PROGRAMMI RAKENDAMISEL AASTATEL 2003–2008 EESTI VABARIIGI FINANTSOSALUST REGULEERIV EESKIRI 1. Euroopa Liidu üldarvesse Eesti poolt makstava iga-aastase finantsosaluse suurus Programmis osalemiseks on 40.893 EUR. 2. Eesti poolt makstav summa katab ühistes huvides läbiviidavate projektide ettevalmistus-, teostus-, arendus- ja rakenduskulud ning samuti Programmis ettenähtud horisontaalmeetmete rakendamise kulud. 3. Otsuse 9. artiklis viidatud Komisjoni töös ning muude Programmi rakendamisega seonduvatel kohtumistel vaatlejatena osalevate Eesti-poolsete esindajate ning ekspertide reisi- ja ülalpidamiskulud hüvitab Komisjon samadel alustel ning samade protseduurireeglite järgi, mis on hetkel kehtivad Euroopa Liidu liikmesriikide esindajate suhtes. 4. Euroopa Liidu üldeelarve suhtes kehtiv finantseeskiri kehtib ka Eesti osalustasu käsitamisel. 5. Käesoleva vastastikuse mõistmise memorandumi jõustumisel ning iga rahandusaasta alguses saadab ühenduste komisjon Eestile käesoleva memorandumiga vastavuses oleva osalustasu kohta rahastamisnõude. 6. Nimetatud osalustasu tuleb maksta eurodes ühenduste komisjoni euroarvele. 7. Eesti on kohustatud maksma iga-aastase osalustasu rahastamisnõudel märgitud ulatuses kolme kuu jooksul nõude kuupäevast. Mis tahes makseviivituse korral tuleb Eestil maksta maksetähtajaks tasumata summalt viivist. Viivise summa arvutatakse Euroopa Keskpanga peamistes operatsioonides kasutatava refinantseerimistariifi järgi, millele lisatakse 1,5 protsenti. Juhul kui osalustasu maksmine on viibinud sedavõrd kaua, et see võib olulisel määral ohustada Programmi täitmist ja juhtimist ning kui makset ei teostata 20 tööpäeva jooksul pärast Eestile sellekohase ametliku meeldetuletuskirja saatmist, peatatakse Eesti osalus Programmis kõnesolevaks aastaks.
