Table of Provisions (19)
Statutory Text (19 Articles)
This regulation establishes the requirements for the format of the energy performance certificates of buildings with indoor climate control or their parts and the procedure for the issuance of energy performance certificates.
The terms in this regulation are defined as follows
1) energy calculation - the calculation that serves to determine the building’s weighted specific energy use under standard conditions. The input parameters for this calculation include the parameters that characterise the indoor and outdoor climate, the periods of occupation and operation of the building and its technical systems, heat gain, the building’s leakage rate and other parameters which characterise the building and which are set out in the building design documentation;
2) energy carrier conversion factors - factors that take into account the consumption of primary energy required for the generation of delivered energy and the environmental impact involved. The numerical values of the energy carrier conversion factors are specified in Regulation no. 68 of 30 August 2012 of the Minister of Economic Affairs and Communications entitled Minimum Requirements for Energy Performance;
3) energy use - the use of electricity or heat at a given point in the system. The energy use is calculated on the basis of energy need, taking into account system losses and energy conversion losses. At the end-point of a technical system (usually the connection point to an energy network), the energy use of the technical system equals the sum of delivered energy and local renewable energy;
4) weighted specific energy use - the annual energy use multiplied by energy carrier conversion factors in kilowatt-hours per square metre of heated area of a building [kWh/(m 2 y)];
5) communal electricity of a multi-apartment building - the electricity used by electrical installations (such as stairwell lighting and heating, elevators, etc.) in communal use in the multi-apartment building;
6) degree day - the parameter that characterises the difference between outdoor temperature and the indoor temperature of a building, expressed in units of one-degree temperature difference on the Celsius scale [C°] between the base indoor temperature and the average outdoor temperature calculated for a period of 24 hours;
7) number of degree days per test reference year - the average number of degree days per annum in the region of the building’s location in the period 1975–2004;
8) base temperature of the building - t he building’s indoor temperature on Celsius scale [C°] which must be attained by heating the air in the building by means of the heating system and the ventilation system considering that further heating of the air in the building up to the required indoor temperature occurs on account of heat gains (heat gain from occupants, electrical equipment, solar radiation, etc.);
9) delivered energy - the electricity obtained from power networks or the heat obtained from district heating networks in kilowatt-hours per annum (kWh/y) or the energy content (in kilowatt-hours) of fuels that are obtained from fuel suppliers and that are used to cover the building’s annual total energy use in so far as this is not covered by local renewable energy. Any fuel obtained from the building site is deemed to constitute delivered energy;
10) exported energy - the heat or electricity that is generated within the building or on the territory of the building site and that is not used in the building but is fed into energy networks;
11) local renewable energy - t he heat or electricity generated from solar, wind, water and geothermal energy sources within the building or on the building site. In the case of heat pumps, the renewable energy harvested from the energy source is taken into account according to the heat pump’s coefficient of performance;
12) full year - twelve consecutive calendar months.
(1) The energy performance certificate is issued to a building with indoor climate control or to a unit of such a building. A separate energy performance certificate may be issued to a building unit that may be used separately, provided the building lacks a common heating system.

The relevant parameters may also be taken from the building’s building design documentation provided the heating and ventilation sections of the documentation state the estimated energy need of the building in terms of its constituent units (estimated energy need for heating, ventilation, cooling).
(3) In order to calculate the expenditure of heating energy (MWh/y) for every given full year, the energy content of the fuel consumed, the thermal energy used for heating and ventilation purposes and the electricity used for heating purposes must be added up. The energy content of each fuel is calculated on the basis of its calorific value. The calorific values to be used are the lowest calorific values of the substances consumed as provided by the supplier of the substance, or the lowest calorific value of the substance consumed as provided in Regulation no. 63 of 8 October 2012 of the Minister of Economic Affairs and Communications entitled Methodology for Calculating the Energy Performance of Buildings.
(4) Where the most important source of energy used for heating is electricity or an electrically-operated heat pump and the electricity used for heating is not metered separately, the electricity used for heating household water and for other purposes (such as cooking, operating home appliances, lighting, etc.) must be subtracted from the total volume of delivered electricity. Where no information is available regarding the specific use of electricity for the heating of household water or for other purposes, the parameters set out in Annex 5 of this regulation or in Regulation no. 63 of 8 October 2012 of the Minister of Economic Affairs and Communications entitled Methodology for Calculating the Energy Performance of Buildings may be used. Where the water used as hot household water is not metered separately, the volume of electricity used for producing hot household water may be determined on the basis of the metered total use of cold household water of the building and the estimated proportion of hot household water in the building’s total use of cold household water.

where n – is the number of relevant full years.
(8) The expenditure of thermal energy for producing hot household water is calculated as the product of the specific heat of water, the difference between the average temperature of hot household water and cold water and the quantity of hot household water. The quantity of hot household water is determined, as a rule, on the basis of the read-out of the meter that measures the quantity of cold water supplied to the heat exchanger of hot household water. The heat loss of the piping of hot household water and the thermal energy released into the building by towel driers is added to the thermal energy expended for the purpose of heating household water. Where there are no metering data concerning the quantity of hot household water, the expenditure of thermal energy for the purpose of producing hot household water may be determined on the basis of the metered total volume of cold household water of the building and the estimated proportion of hot household water in the building’s total use of cold household water. In order to determine the expenditure of thermal energy for the purpose of heating household water, the parameters provided in Regulation no. 63 of 8 October 2012 of the Minister of Economic Affairs and Communications entitled Methodology for Calculating the Energy Performance of Buildings may also be used.
(9) The expenditure of thermal energy for the purpose of producing hot household water, multiplied by the energy carrier conversion factors (hereinafter, ‘the weighted expenditure of thermal energy for the purpose of producing hot household water’, MWh/y) for a given full year is calculated by means of the formula

where Akyt – is the building’s heated area which is determined in accordance with section 13 of this regulation (m²).
(16) Where energy is exported from the building and fed into energy networks, the building’s annual weighted specific energy use is determined using the calculation logic which is described with regard to the calculation of the energy performance indicator in Regulation no. 63 of 8 October 2012 of the Minister of Economic Affairs and Communications entitled Methodology for Calculating the Energy Performance of Buildings.
(1) The class of the weighted specific energy use is determined in accordance with the building’s yearly weighted specific energy use and the building’s purpose of use according to the tabulated ranges of the value of the energy performance indicator as provided in Annex 3 of this regulation.
(2) Where a building which has several purposes of use is issued a single energy performance certificate, the class of the weighted specific energy use is determined according to the purpose of use which is the largest in proportion to the heated area of the building.
Any cases in which the class of the energy performance indicator or of the weighted specific energy use is not determined in accordance with this regulation are henceforth to be marked with the corresponding observation in the national register of construction works.
Regulation no. 107 of 17 December 2008 of the Minister of Economic Affairs and Communications entitled Format of Energy Performance Certificates and Procedure of Their Issuance (RT I, 29.12.2010, 34) is hereby repealed.
This regulation enters into force in accordance with standard procedure.
