Vabariigi Valitsus — Euroopa Ühenduse ja Eesti Vabariigi vastastikuse mõistmise memorandum, mis käsitleb Eesti Vabariigi osalust «ühenduse mehhanismis tugevdatud koostöö soodustamiseks kodanikukaitse abimissioonidel» — RT II, 2003, 4, 13

"Euroopa Ühenduse ja Eesti Vabariigi vastastikuse mõistmise memorandumi, mis käsitleb Eesti Vabariigi osalust ühenduse mehhanismis tugevdatud koostöö soodustamiseks kodanikukaitse abimissioonidel" eelnõu heakskiitmine ja volituste andmine Teadaanne välislepingu jõustumise kohta Alla kirjutatud 18. detsembril 2002. a Brüsselis, jõustunud 1. jaanuaril 2003. a Euroopa Ühenduste Komisjon (edaspidi komisjon), kes tegutseb Euroopa Ühenduse nimel, ühelt poolt ja Eesti Vabariigi valitsus (edaspidi Eesti) teiselt poolt, arvestades, et: 1) nõukogu 23. oktoobri 2001. aasta otsusega 2001/792/EÜ, EURATOM1 loodi «ühenduse mehhanism tugevdatud koostöö soodustamiseks kodanikukaitse abimissioonidel», 2) EL–Eesti assotsiatsiooninõukogu 27. veebruari 2002. aasta otsusega nr 3/20022 on kehtestatud üldpõhimõtted, mille alusel Eesti osaleb ühenduse programmides, ning jäetud komisjonile ja Eesti pädevatele asutustele õigus kindlaks määrata igas konkreetses programmis osalemise eritingimused, sealhulgas osamaksu küsimused, on kokku leppinud järgmises. Artikkel 1. Programm Eesti osaleb «ühenduse mehhanismis tugevdatud koostöö soodustamiseks kodanikukaitse abimissioonidel» (edaspidi mehhanism) vastavalt tingimustele, mis on sätestatud EL–Eesti assotsiatsiooninõukogu 27. veebruari 2002. aasta otsuses nr 3/2002, millega võetakse vastu Eesti Vabariigi osalemist ühenduse programmides käsitlevad üldtingimused, samuti kooskõlas käesoleva vastastikuse mõistmise memorandumi artiklites 2–4 osutatud tingimustega. Artikkel 2. Mehhanismis osalemise tingimused Eesti osaleb kõnealuses mehhanismis alates 1. jaanuarist 2003 vastavalt neile eesmärkidele, kriteeriumidele ja korrale, mis on kindlaks määratud nõukogu otsuses 2001/792/EÜ, EURATOM. Tuleb märkida, et käesoleva memorandumi reguleerimisalast on välja jäetud nõukogu otsusega 2001/264/EÜ3 (millega võetakse vastu turvaeeskirjad) ettenähtud Euroopa Komisjoni turvasätete alusel tehtavad toimingud. Nõuetele vastavate Eesti institutsioonide, organisatsioonide ja üksikisikute taotluste esitamise, hindamise ja valiku tingimused on samad, mida kohaldatakse Euroopa Liidu liikmesriikide nõuetele vastavate institutsioonide, organisatsioonide ja üksikisikute suhtes. Mehhanismis osalemiseks tasub Eesti igal aastal Euroopa Liidu üldeelarvesse osamaksu vastavalt artiklile 3 allpool. Eesti osamaks seoses mehhanismis osalemise ja selle rakendamisega lisatakse summale, mis on igal aastal Euroopa Liidu üldeelarves ette nähtud kulukohustuste assigneeringutena, selleks et täita rahalisi kohustusi, mis tulenevad mitmesugustest mehhanismi rakendamiseks, haldamiseks ja toimimiseks vajalikest meetmetest. Taotluste, lepingute ja aruannetega seotud toimingute ning mehhanismi muude haldusaspektide puhul kasutatakse üht ühenduse ametlikest keeltest. Artikkel 3. Osamaks Eriprogrammide täitmisel määratakse osalemisest tulenev Eesti osamaks kindlaks võrdeliselt summadega ja lisaks summadele, mis on igal aastal Euroopa Liidu üldeelarves ette nähtud kulukohustuste assigneeringutena, selleks et täita komisjoni rahalisi kohustusi, mis tulenevad kõnealuse mehhanismi elluviimiseks, juhtimiseks ja toimimiseks vajalikus vormis tehtavast tööst. Eesti osamaksu reguleerivad eeskirjad on esitatud I lisas. Osa nimetatud osamaksust võidakse rahastada ühenduse välisabi vahenditest, kui Eesti seda taotleb. Artikkel 4. Aruandlus ja hindamine Ilma et see piiraks komisjoni ja Euroopa Ühenduste Kontrollikoja kohustusi seoses mehhanismi järelevalve ja hindamisega, kontrollitakse Eesti osalemist mehhanismis pidevalt partnerluse alusel, kaasates sellesse komisjoni ja Eesti. Eesti esitab komisjonile vastavad aruanded ja võtab osa teistest konkreetsetest meetmetest, mida ühendus näeb ette seoses programmiga. Artikkel 5. Lõppsätted Käesolevat vastastikuse mõistmise memorandumit kohaldatakse mehhanismi kehtivuse ajal. Lisa moodustab käesoleva vastastikuse mõistmise memorandumi lahutamatu osa. Käesolevat vastastikuse mõistmise memorandumit võib muuta ainult kirjalikult poolte kokkuleppe alusel. Käesolev vastastikuse mõistmise memorandum jõustub 1. jaanuaril 2003. 1 EÜT L 297, 15.11.2001; otsuse 2001/792/EÜ EURATOM tõlge on avaldatud Siseministeeriumi veebilehel http://www.sisemin.gov.ee. 2 EÜT L 299, 01.11.2002. 3 Nõukogu 19. märtsi 2001. aasta otsus 2001/264/EÜ (EÜT 101, 11.04.2001, lk 1), millega võetakse vastu nõukogu turvasätted. Brüssel, 18. detsember 2002 Brüssel, 18. detsember 2002 Eesti valitsuse nimel Euroopa Ühenduse eest, komisjoni nimel Väino REINART Margot WALLSTRÖM Eesti Vabariigi alaline esindaja Euroopa Liidu juures, suursaadik keskkonnavolinik I lisa EESKIRJAD, MIS REGULEERIVAD EESTI VABARIIGI OSAMAKSU «ÜHENDUSE MEHHANISMIS TUGEVDATUD KOOSTÖÖ SOODUSTAMISEKS KODANIKUKAITSE ABIMISSIOONIDEL» 1. Osamaks, mille Eesti peab tasuma Euroopa Liidu üldeelarvesse, et osaleda mehhanismis, on 2003. aastal ligikaudu 4180 eurot. Alates 2004. aastast arvutatakse osamaks siinjuures esitatud valemi kohaselt protsendina mehhanismi esialgsest aastaeelarvest vastavalt korrale, mida praegu kohaldatakse Euroopa Liidu liikmesriikide esindajate suhtes. Aastamaksu arvutamine

2. Eesti osamaks läheb ühist huvi pakkuvate projektide ettevalmistamiseks, teostatavusuuringuteks, arendamiseks ja rakendamiseks, samuti mehhanismi raames ettenähtud horisontaalmeetmete arendamiseks ja rakendamiseks. 3. Lähetuskulud, mida Eesti esindajad ja eksperdid vajavad osalemiseks vaatlejana nõukogu otsuse nr 2001/792/EÜ, EURATOM artiklis 9 nimetatud komitee töös või osavõtuks teistest mehhanismi rakendamisega seotud kohtumistest, hüvitab komisjon samadel alustel ja samas korras, mida praegu kohaldatakse Euroopa Liidu liikmesriikide esindajate suhtes. 4. Eesti osamaksu haldamisel kohaldatakse Euroopa Liidu üldeelarve suhtes kehtivat finantsmäärust. 5. Komisjon esitab pärast käesoleva vastastikuse mõistmise memorandumi jõustumist ja iga järgmise eelarveaasta alguses Eestile rahastamisnõude, mis vastab Eesti osamaksule, mille suurus on arvutatud vastavalt punkti 1 teisele lõigule. 6. Osamaks makstakse eurodes komisjoni eurokontole. 7. Eesti tasub oma osamaksu iga-aastaste kulude katmiseks vastavalt rahastamisnõudele hiljemalt kolme kuu möödumisel nõude esitamisest. Osamaksu tasumisega viivitamise korral peab Eesti maksma viivist laekumata summalt maksetähtpäevast alates. Intressimäär on sama suur kui maksetähtpäeval Euroopa Keskpanga eurodes tehtavate põhiliste refinantseerimistehingute puhul kehtiv intress, pluss 1,5 protsenti. Kui osamaksu tasumisega viivitamine võib märkimisväärselt kahjustada programmi rakendamist ja haldamist ning kui maksu ei ole tasutud kahekümne tööpäeva jooksul pärast komisjoni ametliku meeldetuletuskirja saatmist Eestile, peatatakse asjaomaseks aastaks Eesti osalemise programmis. 1 AMB (Annual Provisional budget for the Mechanism): mehhanismi esialgne aastaeelarve (3 miljonit eurot) aastateks 2002 ja 2003. 2 Vaadeldava kandidaatriigi elanike arv. 3 GDPcc: vaadeldava kandidaatriigi SKT ühe elaniku kohta. 4 EUh: Euroopa Liidu elanike arv (377 073 600). 5 GDPEU: Euroopa Liidu keskmine SKT ühe elaniku kohta (21 340 eurot elaniku kohta 1999. aasta hindade alusel).
