Vabariigi Valitsus — Eesti Vabariigi ja Saksamaa Liitvabariigi viisaküsimustes esindamise kokkuleppe muutmise kokkulepe — RT II, 2014, 1

Vabariigi Valitsuse 16.01.2014 korraldus nr 37 kokkuleppe muutmise kokkuleppe eelnõu heakskiitmise kohta Välisministeeriumi teadaanne välislepingu jõustumise kohta Eesti Vabariigi ja Saksamaa Liitvabariigi viisaküsimustes esindamise kokkulepe Saksamaa Liitvabariigi Suursaatkond TALLINN Nr. 15.2-2/705 VERBAALNOOT Eesti Vabariigi Välisministeerium avaldab lugupidamist Saksamaa Liitvabariigi Suursaatkonnale ning viidates 16. aprillil 2008 nootide vahetamise teel sõlmitud Eesti Vabariigi ja Saksamaa Liitvabariigi viisaküsimustes esindamise kokkuleppele, on tal au teatada järgmist. Ministeeriumil on au teha ettepanek muuta viidatud kokkulepet ja asendada viisaeeskirja kohaselt jaotise ”Viisa" kolmas lõik ning sõnastada see järgmiselt: „Juhul kui Saksamaa saatkond leiab pärast viisataotluse läbivaatamist, et viisa väljastamise tingimused ei ole täidetud, on tal viisaeeskirja artikli 8 lõike 4 punkti d kohaselt õigus keelduda esindatava liikmesriigi nimel viisa andmisest. Edasikaebamise menetlust juhib esindav liikmesriik kooskõlas oma riigisisese õigusega.“ Kui Saksamaa nõustub nimetatud ettepanekuga, teeb Eesti ettepaneku, et see noot ja Saksamaa vastusnoot moodustavad 16. aprillil 2008 nootide vahetamise teel sõlmitud Eesti Vabariigi ja Saksamaa Liitvabariigi viisaküsimustes esindamise kokkuleppe muutmise kokkuleppe. Ministeerium teeb ettepaneku, et käesolev kokkulepe jõustub 1. märtsil 2014. Eesti Vabariigi Välisministeerium kasutab avanenud võimalust, et veel kord avaldada Saksamaa Liitvabariigi Suursaatkonnale sügavaimat austust. 24. jaanuaril 2014 Tallinnas Eesti Vabariigi Välisministeerium Islandi Väljak 1 TALLINN Nr. 4/2014 VERBAALNOOT Saksamaa Liitvabariigi Suursaatkond avaldab lugupidamist Eesti Vabariigi Välisministeeriumile ning tal on au kinnitada viimase 24. jaanuari. 2014 noodi Nr. 15.2-2/705 kättesaamist. Suursaatkonnal on au teatada Eesti Vabariigi Välisministeeriumile, et Liitvabariigi Välisministeerium nõustub Eesti Vabariigi Välisministeeriumi noodis sisalduva ettepanekuga. Kokkulepe jõustub 1. märtsil 2014. Kokkulepet on hiljem võimalik muuta nootide vahetamise teel ja on võimalik peatada või tühistada verbaalnoodiga kummagi poole poolt. Saksamaa Liitvabariigi Suursaatkond kasutab avanenud võimalust, et veel kord avaldada Eesti Vabariigi Välisministeeriumile sügavaimat austust. Tallinn, 4. veebruar 2014 Embassy of the Federal Republic of Germany TALLINN No. 15.2-2/705 VERBAL NOTE The Ministry of Foreign Affairs of the Republic of Estonia present their compliments to the Embassy of the Federal Republic of Germany and, with reference to the Arrangement between the Republic of Estonia and the Federal Republic of Germany on visa representation concluded by the exchange of notes on 16 April 2008, has the honour to convey the following. The Ministry have the honour to propose to amend the above-mentioned Arrangement and, to replace the third paragraph of the section “Visa” in accordance with the Visa Code to read as follows: “In cases when the Embassy of Germany considers that conditions for issuing a visa are not met after examination of the application, it is entitled to refuse to issue the visa on behalf of represented State in accordance with Article 8(4) (d) of the Visa Code. Appeals shall be conducted by the representing State according to its national legislation.” On the understanding that the German side agrees with this proposal, the Estonian side proposes that this Note and the reply Note of the German side constitute the Arrangement between the Republic of Estonia and the Federal Republic of Germany on the Amendments to the Arrangement between the Republic of Estonia and the Federal Republic of Germany on visa representation concluded by the exchange of notes on 16 April 2008. Estonian side proposes that this Arrangement enters into force on 1 March 2014. The Ministry of Foreign Affairs of the Republic of Estonia avail themselves of this opportunity to renew to the Embassy of the Federal Republic of Germany the assurance of their highest consideration. Tallinn, 24 January, 2014 Ministry of Foreign Affairs of the Republic of Estonia Islandi väljak 1 TALLINN No. 4/2014 VERBAL NOTE The Embassy of the Federal Republic of Germany presents its compliments to the Ministry of Foreign Affairs of the Republic of Estonia and has the honour to acknowledge receipt of the latter’s verbal note No. 15.2-2/705 dated January 24th, 2014. The Embassy has the honour to inform the Ministry of Foreign Affairs of the Republic of Estonia that the Federal Foreign Office accepts the proposal contained in the verbal note from the Ministry of Foreign Affairs of the Republic of Estonia. This agreement enters into force on March 1st, 2014. This agreement can be changed at a later date by exchange of notes and can be suspended or cancelled immediately by either party by way of a verbal note. The Embassy of the Federal Republic of Germany avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Estonia the assurances of its highest consideration.
