Vabariigi Valitsuse 22.04.2010 korraldus nr 150 kokkuleppe eelnõu heakskiitmise kohta Välisministeeriumi teadaanne välislepingu jõustumise kohta Välisministeeriumi teadaanne välislepingu lõppemise kohta Sõlmitud nootide vahetamise teel, jõustunud 6. jaanuaril 2011. a Rootsi Kuningriigi Välisministeeriumile STOCKHOLM Nr 8.2-1/4614-3 VERBAALNOOT Eesti Vabariigi Välisministeerium avaldab lugupidamist Rootsi Kuningriigi Välisministeeriumile ning viidates Euroopa Parlamendi ja nõukogu 13. juuli 2009 määrusele (EÜ) nr 810/2009, millega kehtestatakse ühenduse viisaeeskiri (viisaeeskiri), on tal au paluda, et Rootsi esindaks Eestit Schengeni viisade väljastamisel järgmistel tingimustel. 1. Esindamise ulatus Rootsi hakkab Eestit esindama järgmistes kohtades: Havanna (Kuuba); Pretoria (Lõuna-Aafrika Vabariik). Esindamine hõlmab viisataotluste vastuvõtmist ja menetlemist, viisa andmist, viisa andmisest keeldumist juhul, kui Rootsi diplomaatiline esindus või konsulaarasutus leiab, et viisat ei peaks väljastama, ning viisa andmisest keeldumise kaebuste menetlemist kooskõlas Rootsi õigusega. Kokkuleppe rakendustingimustes võidakse kokku leppida mitteametlikult. 2. Esindamise tingimused Rootsi diplomaatiline esindus või konsulaarasutus võib nõuda lisadokumentide tõlget diplomaatilise esinduse või konsulaarasutuse kasutatavasse keelde. Vajaduse korral võib Rootsi diplomaatiline esindus või konsulaarasutus võtta ühendust lähima Eesti diplomaatilise esinduse või konsulaarasutusega (kontaktandmed lisatud). Kui kolmandate riikide kodanike suhtes on nõutav eelnev konsulteerimine, korraldab seda Eesti. Rootsi diplomaatiline esindus või konsulaarasutus menetleb tema jurisdiktsioonis seaduslikult viibivate kolmandate riikide kodanike viisataotlusi. Viisataotluste tasu võetakse Schengeni õigustikust juhindudes. Kõik viisatasud laekuvad Rootsi diplomaatilisele esindusele või konsulaarasutusele. Eesti ei anna Rootsile peale selle mingit rahalist hüvitist viisataotluste menetlemise eest. See puudutab üldkulusid, nagu rent, personali- ja IT-seadmete kulud, samuti konkreetseid kulusid, nagu postikulud, kulleritasud ja faksikulud. 3. Lõppsätted Kokkulepe jõustub 1. mail 2010. Kokkulepet saab muuta nootide vahetamise teel. Kokkulepe on sõlmitud määramata ajaks. Selle võib igal ajal lõpetada nootide vahetamise teel. Kokkuleppe kohaldamise võib alati täielikult või osaliselt peatada. Peatamise algus- ja lõppkuupäevast teavitatakse diplomaatiliste kanalite kaudu. Kui eelnev ettepanek on Rootsi Kuningriigi Välisministeeriumile vastuvõetav, siis Eesti Vabariigi Välisministeeriumil on au teha ettepanek, et käesolev noot ja Rootsi Kuningriigi Välisministeeriumi vastusnoot moodustavad kahe riigi valitsustevahelise viisaküsimustes esindamise kokkuleppe. Eesti Vabariigi Välisministeerium kasutab avanenud võimalust, et veel kord avaldada Rootsi Kuningriigi Välisministeeriumile sügavaimat austust. Esindamise tingimused Rootsi diplomaatiline esindus või konsulaarasutus võib nõuda lisadokumentide tõlget diplomaatilise esinduse või konsulaarasutuse kasutatavasse keelde. Ministry of Foreign Affairs of the Kingdom of Sweden STOCKHOLM No. 8.2-1/4614-3 NOTE VERBALE The Ministry of Foreign Affairs of the Republic of Estonia presents its compliments to the Ministry of Foreign Affairs of the Kingdom of Sweden and, with reference to Regulation (EC) No. 810/2009 of the European Parliament and of the Council of 13 July 2009 establishing a Community Code on Visas (Visa Code), has the honour to request that Sweden represents Estonia in matters relating to the issue of Schengen visas according to the following conditions. 1. Extent of representation Sweden will represent Estonia at the following locations: Havana (Cuba); Pretoria (South Africa). Representation covers receiving and processing visa applications, issuing visas when appropriate, refusing the visa if the diplomatic mission or consular post of Sweden finds that a visa should not be issued and dealing with appeals according to the national legislation of Sweden. The practical conditions of implementing this arrangement may be agreed upon informally. 2. Conditions of the representation The diplomatic mission or consular post of Sweden may request that all supporting documents be translated into the language(s) used by the diplomatic mission or consular post of Sweden. In case of need, diplomatic mission or consular post of Sweden may contact the nearest diplomatic mission or consular post of Estonia (contact information enclosed). For nationalities for which prior consultation is required, the consultation will be executed by Estonia. The diplomatic mission or consular post of Sweden shall process visa applications of third country nationals legally present in the jurisdiction of the diplomatic mission or consular post. Fees for visa applications will be charged in accordance with the Schengen acquis. The diplomatic missions or consular posts of Sweden are entitled to all visa fees. Besides from that, Estonia will not give any financial compensation to Sweden for handling visa applications. This applies to general expenses such as rent, staff and IT equipment as well as to specific expenses like postage, courier fees and fax. 3. Final clauses This Agreement enters into force on 1 May 2010. This Agreement can be changed by exchange of diplomatic notes. This Agreement is concluded for an unlimited period. It may be terminated at any time by the exchange of diplomatic notes. The application of this agreement may be suspended wholly or partly at any time. The starting and closing date of the suspension shall be notified through diplomatic channels. If the foregoing proposal is acceptable to the Ministry of Foreign Affairs of the Kingdom of Sweden, the Ministry of Foreign Affairs of Estonia has the honour to propose that this Note and the reply from the Ministry of Foreign Affairs of the Kingdom of Sweden to that effect shall constitute an Agreement between our two Governments on visa representation.
