(õ) 1.12.09 16:45 Lisaprotokolli ratifitseerimise seadus Välisministeeriumi teadaanne välislepingu jõustumise kohta Välisministeeriumi teadaanne välislepingu lõppemise kohta Koostatud 20. detsembril 2001. a Brüsselis Euroopa ühendus (edaspidi ühendus) ühelt poolt ja Eesti Vabariigi Valitsus teiselt poolt, võttes arvesse 12. juunil 1995 Brüsselis allakirjutatud ja 1998. aasta veebruaris jõustunud Euroopa ühenduste ja nende liikmesriikide ning Eesti Vabariigi vahelist assotsieerumislepingut (edaspidi Euroopa leping); arvestades, et Euroopa lepingu artikli 19 lõikel 4 ja artiklil 22 põhinevad läbirääkimised tehnilistes küsimustes on ühenduse ja Eesti Vabariigi vahel toimunud ja edukalt lõpule viidud ning on kokku lepitud vastastikuste tariifsete soodustuste andmine kalandussektoris; arvestades, et kokkulepitud soodustused kalandussektoris mõjutavad Euroopa lepingu alusel kehtestatud kahepoolseid soodustusi, mida tuleks seetõttu muuta lepingu kaubanduslikke aspekte kohandava protokolliga; arvestades, et ühendus ja Eesti Vabariik on samuti kokku leppinud rakendada tariifseid soodustusi järkjärgult ja administratiivselt lihtsa protseduuriga niipea kui võimalik; on kokku leppinud järgmises: Artikkel 1 Kala ja kalandustooted on määratletud nõukogu määruse (EÜ) nr 104/2000 artiklis 1; nimetatud määrus asendab ja tunnistab kehtetuks Euroopa lepingu artiklis 21 osutatud nõukogu määruse (EÜ) nr 3759/92. Mõiste «kalandustooted» hõlmab allpool loetletud merest või siseveekogudest püütud saadusi ja akvakultuuritooteid: CN-kood Kauba kirjeldus a) 0301 Eluskala 0302 Värske või jahutatud kala, v.a rubriiki 0304 kuuluv kalafilee ja muu kalaliha 0303 Külmutatud kala, v.a rubriiki 0304 kuuluv kalafilee ja muu kalaliha 0304 Kalafilee ja muu kalaliha (sh kalahakkliha), värske, jahutatud või külmutatud b) 0305 Kuivatatud, soolatud või soolvees kala; külm- või kuumsuitsukala; inimtoiduks kõlblik kalajahu, -pulber ja -graanulid c) 0306 Vähilaadsed, puhastatud või puhastamata, elusad, värsked, jahutatud, külmutatud, kuivatatud, soolatud või soolvees; vees või aurus keedetud vähilaadsed (puhastamata), sh jahutatud, külmutatud, kuivatatud, soolatud või soolvees; inimtoiduks kõlblik kalajahu, -pulber ja -graanulid 0307 Molluskid, puhastatud või puhastamata, elusad, värsked, jahutatud, külmutatud, kuivatatud, soolatud või soolvees; veeselgrootud (v.a vähilaadsed ja molluskid), elusad, värsked, jahutatud, külmutatud, kuivatatud, soolatud või soolvees; inimtoiduks kõlblik jahu, pulber ja graanulid muudest veeselgrootutest peale vähilaadsete d) Loomsed tooted, mujal nimetamata; gruppi 1 või 3 kuuluvad surnud, inimtoiduks kõlbmatud loomad: – muud: 0511 91 10 – – Kalast, vähilaadsetest, molluskitest ja muudest veeselgrootutest valmistatud tooted; gruppi 3 kuuluvad surnud loomad: 0511 91 90 – – – Kalajäätmed – – – Muu e) 1604 Kalatooted ja -konservid; kalamarjast valmistatud kaaviar ja kaaviari asendajad f) 1605 Vähilaadsetest, molluskitest ja muudest veeselgrootutest valmistatud tooted või konservid g) Pastatooted, sh keedetud või muul viisil toiduks valmistatud, täidisega (nt liha- või muu täidisega) või ilma, spagetid, makaronid, nuudlid, lasanje; gnocchi, ravioolid, canneloni; kuskuss, valmistoiduna või mitte: – Täidiseta pastatooted, keetmata või muul viisil valmistoiduks töötlemata: 1902 20 – Täidisega pastatooted, sh keedetud või muul viisil valmistoiduks töödeldud: 1902 20 10 – – mis sisaldavad rohkem kui 20% massist kala, vähilaadseid, molluskeid või muid veeselgrootuid h) Inimtoiduks kõlbmatu pulber, jahu või graanulid kala või vähilaadsete, molluskite või muude veeselgrootute lihast või rupsist; rasvakõrned: 2301 20 00 – Pulber, jahu ja graanulid kalast, vähilaadsetest, molluskitest või muudest veeselgrootutest Artikkel 2 Alates käesoleva protokolli jõustumisest kohaldavad mõlemad pooled kõigi Euroopa lepingu VI lisaga hõlmatud toodete suhtes täielikku vabakaubandust ning muid kala ja kalandustoodete suhtes kehtivaid soodustusi, kui neid kehtestatakse. Alates käesoleva protokolli jõustumisest vähendavad mõlemad pooled vastavalt ühenduses ja Eesti Vabariigis kohaldatavaid tollimakse ühe kolmandiku võrra ülejäänud kala ja kalandustoodete suhtes, mis on kindlaks määratud käesoleva protokolli artiklis 1. Üks aasta pärast käesoleva protokolli jõustumist vähendavad mõlemad pooled tollimakse veel kolmandiku võrra sellest määrast, mis kehtis käesoleva protokolli jõustumise hetkel. Kaks aastat pärast käesoleva protokolli jõustumist või ühise kokkuleppe korral varem kohaldatakse kala ja kalandustoodete suhtes täielikku vabakaubandust. Kokkuleppeid kala ja kalandustoodete täieliku vabakaubanduse varasemaks kohaldamiseks rakendatakse artikli 5 kohaselt. Artikkel 3 Artiklis 2 osutatud vähendusi arvutatakse matemaatika üldpõhimõtete kohaselt, võttes arvesse järgmist: a) kõik arvud, millel pärast komakohta on kuni 50 sajandikku (kaasa arvatud), tuleb ümardada allapoole lähima täisarvuni; b) kõik arvud, millel pärast komakohta on üle 50 sajandiku, tuleb ümardada ülespoole lähima täisarvuni; c) mõlemad pooled kinnitavad kõik alla 2% tariifid automaatselt 0% tasemel. Pooled vahetavad informatsiooni eespool toodud põhimõtete kohaldamisjuhtude kohta. Artikkel 4 Käesolev protokoll jõustub sellele kuupäevale järgneva kuu esimesel päeval, mil pooled teatavad teineteisele oma selleks vajalike siseriiklike menetluste lõpuleviimisest. Artikkel 5 Käesolevat protokolli võib muuta assotsiatsiooninõukogu otsusega. Koostatud Brüsselis kahekümnendal detsembril kahe tuhande esimesel aastal. Eesti Vabariigi valitsuse nimel Priit KOLBRE Euroopa Ühenduse nimel Frans van DAELE ADDITIONAL PROTOCOL LAYING DOWN THE TRADE ARRANGEMENTS FOR CERTAIN FISH AND FISHERY PRODUCTS TO THE EUROPE AGREEMENT ESTABLISHING AN ASSOCIATION BETWEEN THE EUROPEAN COMMUNITIES AND THEIR MEMBER STATES, OF THE ONE PART, AND THE REPUBLIC OF ESTONIA, OF THE OTHER PART The European Community, hereinafter referred to as “the Community”, of the one part, and the Government of the Republic of Estonia, of the other part, Whereas the Europe Agreement establishing an association between the European Communities and their Member States, of the one part, and the Republic of Estonia, of the other part, hereinafter referred to as “the Europe Agreement”, was signed in Brussels on 12 June 1995 and entered into force in February 1998, Whereas technical negotiations based on Articles 19(4) and 22 of the Europe Agreement have been carried out and successfully concluded between the Community and the Republic of Estonia to agree on reciprocal tariff concessions in the fisheries sector, Whereas the negotiated concessions in the fisheries sector shall affect the bilateral concessions granted under the Europe Agreement, which should, therefore, be amended by means of a Protocol adjusting the trade aspects of that Agreement, Whereas the Community and the Republic of Estonia also agreed on an administratively simple procedure for implementing the negotiated tariff concessions as soon as possible on a gradual basis, Have agreed as follows: Article 1 Fish and fishery products are defined in Article 1 of Council Regulation (EC) No 104/2000, which repeals and replaces Council Regulation (EC) No 3759/92 that is referred to in Article 21 of the Europe Agreement. From the date of entry into force of this Protocol, both Parties shall apply a one third reduction of the tariff duties applied by the Community and the Republic of Estonia respectively for all the remaining fish and fishery products as defined in Article 1 of this Protocol. One year after the date of entry into force of this Protocol, both Parties shall apply a further one third reduction of the tariff duties as they were at the time of the entry into force of this Protocol. Two years after the date of entry into force of this Protocol, or if commonly agreed earlier, full free trade in all fish and fishery products shall be applied. Any such agreement on earlier application of full free trade in all fish and fishery products shall be implemented in accordance with Article 5. Article 3 The reductions referred to in Article 2 shall be calculated by using common mathematical principles taking into account that: (a) all the figures less than 50 (included) after the decimal point shall be rounded down to the nearest whole number; (b) all the figures more than 50 after the decimal point shall be rounded up to the nearest whole number; (c) all the tariffs below 2% shall automatically be fixed at 0% level by both Parties. The Parties will exchange information on those cases where the above principles apply. Article 4 This Protocol will enter into force on the first day of the month following the date on which the Parties have notified each other of the completion of the internal procedures necessary for that purpose. Article 5 This Protocol may be amended by decision of the Association Council. Done at Brussels on the twentieth day of December in the year two thousand and one.
