Vabariigi Valitsuse 30.08.2010 korraldus nr 331 ja 16.09.2010 korraldus nr 361 kokkuleppe eelnõu heakskiitmise kohta Välisministeeriumi teadaanne välislepingu jõustumise kohta Välisministeeriumi teadaanne välislepingu lõppemise kohta Sõlmitud nootide vahetamise teel, jõustunud 1. oktoobril 2010. a Taani Kuningriigi Välisministeerium K O P E N H A A G E N Nr 8.2-1/9074-11 VERBAALNOOT Eesti Vabariigi Välisministeerium avaldab lugupidamist Taani Välisministeeriumile ning tal on au paluda, et Taani esindaks Eestit viisa taotluste menetlemisel järgmistes riikides: Katmandu, Nepal Maputo, Mosambiik Lusaka, Sambia järgmistel tingimustel. Eesti suursaatkond püüab võimaluse korral saada kogu vajaliku lisateabe taotleja viidatud allikatelt Eestist, kuid võib vajaduse korral paluda Taani suursaatkonnal koguda taotluse menetlemiseks vajalikku lisateavet. The basis for the representation is the Regulation (EC) No. 810/2009 of the European Parliament and of the Council of 13 July 2009 establishing a Community Code on Visas (Visa Code), the Visa Code Handbook and what is stated in this agreement. The practical conditions of implementation of this agreement may be agreed upon informally. Visa If the Embassy of Denmark finds that all conditions for issuing a visa are met in accordance with the Visa Code, the Embassy will issue a visa. In accordance with article 8, paragraph (4) point c) of the Visa Code, consultation will be executed by the represented state for nationalities for which consultation is required, and such in accordance with the procedure specified on page 19 of the Technical specifications of the Schengen Consultation Network (present document: Visa 435 COMIX 973 of 22 December 2009). A list of third country citizens where prior consultation of the Estonian central authority is required will be forwarded by the Embassy of Estonia in Copenhagen. If the Embassy of Denmark does not have, and cannot obtain, the necessary information about the applicant/hosts or the purpose of the visit, or if the Embassy finds that a visa should not be issued, or if the Embassy is in doubt whether or not a visa should be issued, the application should be submitted to the nearest Embassy of Estonia(contact information enclosed) in accordance with article 8 (2) of the Visa Code for them to take the final decision on the application within the time limits set by the Visa Code. When submitting an application the Embassy of Denmark will state the reasons leading to the submission. When submitting an application the Embassy of Denmark will forward all the information in the Common Schengen Application Form. Unless otherwise agreed upon, the following will normally be forwarded together with application: a copy of the data-page of the travel document and any appropriate documents supporting the purpose and the conditions of the planned visit. The Embassy of Estonia will, if possible, try to obtain necessary additional information from the applicant’s references in Estonia, but can, if necessary, ask the Embassy of Denmark to gather supplementary information required for handling the application. If the Embassy of Estonia decides to grant a visa, the Embassy of Denmark will be authorized to issue a visa. If the Embassy of Estonia decides to grant a visa with certain limitations compared to what has been applied for, or if the visa is issued with certain conditions or obligations for the applicant to fulfil, the Embassy of Denmark will be informed, specifying the category of visa, the number of days and entries, expiration date and, if applicable, if there are certain obligations or conditions on which the visa is granted. The decision will contain the reasons for this partial refusal. The conditions and obligations – except those directly covered by the Visa Code – will be of such a nature that the Embassy of Denmark will have no obligation to control if they are respected. The decision will formally be addressed to the applicant in English so that it can be handed over to the applicant without further formalities. If the Embassy of Estonia decides that a visa cannot be granted, the Embassy of Denmark will be informed. The refusal will be submitted in writing and – when applicable – will contain the grounds on which the decision has been made and the possibilities to appeal. The decision will formally be addressed to the applicant in English so that it can be handed over to the applicant without further formalities. No visa with limited territorial validity (LTV) can be issued without authorization from the Embassy of Estonia. This does not, however, apply if the limitation is solely due to the fact that not all Schengen Member States recognize the travel document, unless it is Estonia that does not recognize the travel document. Statistics Denmark will, after a specific or general request, inform Estonia regarding the visas that have been issued. Fees Fees for visa applications are to be charged in accordance with the Visa Code. Denmark is entitled to all visa fees. Besides that Estonia will not give any financial compensation to Denmark for handling the visa applications. Final clauses This agreement enters into force on 1 October 2010. This agreement can be changed at a later date by exchange of notes. If the circumstances so indicate, the agreement can be suspended from both sides or be cancelled immediately by a verbal note. If the foregoing proposal is acceptable to the Ministry of Foreign Affairs of Denmark, the Ministry of Foreign Affairs of the Republic of Estonia has the honour to suggest that this note and the reply from the Ministry of Foreign Affairs of Denmark shall constitute an agreement between our two Governments. The Ministry of Foreign Affairs of the Republic of Estonia avails itself of this opportunity to renew to the Ministry of Foreign Affairs of Denmark the assurances of its highest consideration.
