Eesti Vabariigi ja Sloveenia Vabariigi viisaküsimustes Montenegro Vabariigis esindamise kokkulepe Eesti Vabariigi ja Sloveenia Vabariigi viisaküsimustes Bulgaaria Vabariigis esindamise kokkulepe Eesti Vabariigi ja Sloveenia Vabariigi viisaküsimustes esindamise kokkulepete muutmise kokkuleppe eelnõu heakskiitmine Teadaanne välislepingu jõustumise kohta Sõlmitud nootide vahetamise teel, jõustunud 5. aprillil 2010. a Sloveenia Vabariigi Välisministeerium Ljubljana Nr 08.2-1/2674 VERBAALNOOT Eesti Vabariigi Välisministeerium avaldab lugupidamist Sloveenia Vabariigi Välisministeeriumile ning viidates 16. mail 2008 nootide vahetamise teel sõlmitud Eesti Vabariigi ja Sloveenia Vabariigi viisaküsimustes Montenegro Vabariigis esindamise kokkuleppele ning 27. märtsil 2009 nootide vahetamise teel sõlmitud Eesti Vabariigi ja Sloveenia Vabariigi viisaküsimustes Bulgaaria Vabariigis esindamise kokkuleppele, on tal au teatada järgmist. Ministeeriumil on au teha ettepanek muuta viidatud Montenegro Vabariigis esindamise kokkulepet järgmiselt. Ministeerium teeb ettepaneku jätta kokkuleppe esimesest lõigust välja viide viisasid käsitlevatele ühistele konsulaarjuhistele ning sõnastada esimene lõik järgmiselt: «Välisministeeriumil on au teha ettepanek, et Sloveenia esindab Eestit viisaküsimustes Montenegros (Podgorica).» Ministeerium teeb ettepaneku asendada kooskõlas viisaeeskirjaga jaotise «Viisa» kolmas lõik ja sõnastada see järgmiselt: «Kui Sloveenia suursaatkond leiab, et viisa väljastamise tingimused ei ole täidetud, on ta pärast viisataotluse läbivaatamist volitatud Eesti Vabariigi nimel keelduma viisa andmisest.» Ministeeriumil on au teha ettepanek muuta viidatud Bulgaaria Vabariigis esindamise kokkulepet järgmiselt. Ministeerium teeb ettepaneku asendada kooskõlas viisaeeskirjaga kokkuleppe viies lõik ja sõnastada see järgmiselt: «Kui Eesti Vabariigi suursaatkond Sofias leiab, et viisa väljastamise tingimused ei ole täidetud, on ta pärast viisataotluse läbivaatamist volitatud Sloveenia Vabariigi nimel keelduma viisa andmisest.» Ministeerium teeb ettepaneku jätta kokkuleppe kuuendast lõigust välja viide viisasid käsitlevatele ühistele konsulaarjuhistele ning sõnastada lõik järgmiselt: «Piiratud territoriaalse kehtivusega viisat ei saa väljastada ilma Sloveenia Vabariigi Välisministeeriumi volituseta. See nõue ei kehti, kui piiratud territoriaalne kehtivus tuleneb üksnes asjaolust, et kõik Schengeni liikmesriigid ei tunnusta reisidokumenti, kuid kehtib, kui reisidokumenti ei tunnusta Sloveenia Vabariik.» Kui Sloveenia pool nõustub nimetatud ettepanekuga, teeb Eesti pool ettepaneku, et see noot ja Sloveenia poole vastusnoot moodustavad 16. mail 2008 nootide vahetamise teel sõlmitud Eesti Vabariigi ja Sloveenia Vabariigi viisaküsimustes Montenegro Vabariigis esindamise kokkuleppe ja 27. märtsil 2009 nootide vahetamise teel sõlmitud Eesti Vabariigi ja Sloveenia Vabariigi viisaküsimustes Bulgaaria Vabariigis esindamise kokkuleppe muutmise kokkuleppe. Eesti pool teeb ettepaneku, et käesolev kokkulepe jõustub 5. aprillil 2010. Eesti Vabariigi Välisministeerium Tallinn Nr 921-92-1225/10 VERBAALNOOT Sloveenia Vabariigi Välisministeerium avaldab lugupidamist Eesti Vabariigi Välisministeeriumile ning viidates ministeeriumi 25. märtsi 2010 verbaalnoodile nr 08.2-1/2674, on tal au teatada järgmist. Sloveenia Vabariigi Välisministeerium nõustub Eesti Vabariigi Välisministeeriumi ettepanekuga, et ministeeriumi noot ja käesolev noot moodustavad 16. mail 2008 nootide vahetamise teel sõlmitud Eesti Vabariigi ja Sloveenia Vabariigi viisaküsimustes Montenegro Vabariigis esindamise kokkuleppe ja 27. märtsil 2009 nootide vahetamise teel sõlmitud Eesti Vabariigi ja Sloveenia Vabariigi viisaküsimustes Bulgaaria Vabariigis esindamise kokkuleppe muutmise kokkuleppe. Sloveenia pool on nõus, et kokkulepe jõustub kooskõlas viisaeeskirja artikli 8 lõikega 4 5. aprillil 2010. To The Ministry of Foreign Affairs of the Republic of Slovenia Ljubljana No. 08.2-1/2674 VERBAL NOTE The Ministry of Foreign Affairs of the Republic of Estonia presents its compliments to the Ministry of Foreign Affairs of the Republic of Slovenia and, with reference to the Arrangement between the Republic of Estonia and the Republic of Slovenia on visa representation in the Republic of Montenegro concluded by the exchange of notes on 16 May 2008 (hereinafter the Arrangement) and to the Agreement between the Republic of Estonia and the Republic of Slovenia on visa representation in the Republic of Bulgaria concluded by the exchange of notes on 27 March 2009 (hereinafter the Agreement), has the honour to convey the following. The Ministry has the honour to propose to amend the Arrangement as follows. The Ministry proposes to leave out the reference to Common Consular Instructions from the first paragraph of the Arrangement so that the first paragraph will read as follows: “The Ministry has the honour to propose that Slovenia represents Estonia in matters relating to the issue of visas in Montenegro (Podgorica).” The Ministry proposes to replace the third paragraph of the section “Visa” in accordance with the Visa Code to read as follows: “If the Embassy of Slovenia considers that the conditions for issuing a visa are not met, it is entitled to refuse to issue the visa on behalf of the Republic of Estonia after examination of the application.” The Ministry has the honour to propose to amend the Agreement as follows. The Ministry proposes to replace the fifth paragraph of the Agreement in accordance with the Visa Code to read as follows: “If the Embassy of the Republic of Estonia in Sofia considers that the conditions for issuing a visa are not met, it is entitled to refuse to issue the visa on behalf of the Republic of Slovenia after examination of the application.” The Ministry proposes to leave out the reference to Common Consular Instructions from the sixth paragraph of the Agreement so that the paragraph will read as follows: “No visa with the limited territorial validity (LTV) can be issued without authorisation from the Ministry of Foreign Affairs of the Republic of Slovenia. This does not, however, apply if the limitation is solely due the fact that not all Schengen Member States recognise the travel document, unless it is the Republic of Slovenia that does not recognise the travel document.” On the understanding that the Slovenian side agrees with this proposal, the Estonian side proposes that this Note and the reply Note of the Slovenian side constitute the Agreement between the Republic of Estonia and the Republic of Slovenia on the Amendments to the Arrangementbetween the Republic of Estonia and the Republic of Slovenia on visa representation in the Republic of Montenegro concluded by the exchange of notes on 16 May 2008 and to the Agreement between the Republic of Estonia and the Republic of Slovenia on visa representation in the Republic of Bulgaria concluded by the exchange of notes on 27 March 2009. Estonian side proposes that this Agreement enters into force on 5 April 2010. The Ministry of Foreign Affairs of the Republic of Estonia avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Slovenia the assurance of its highest consideration. The Ministry of Foreign Affairs of the Republic of Slovenia shall give the agreement to the proposal of the Ministry of Foreign Affairs of the Republic of Estonia that Ministry’s Note and the present note constitute the Agreement between the Republic of Slovenia and the Republic of Estonia on the Amendments to the Arrangement between the Republic of Slovenia and the Republic of Estonia on visa representation in the Republic of Montenegro concluded by the exchange of notes on 16 May 2008 and to the Agreement between the Republic of Slovenia and the Republic of Estonia on visa representation in the Republic of Bulgaria concluded by the exchange of notes on 27 March 2009. Slovenian side shall agree that this Arrangement enters into force on 5 April 2010, in accordance with Article 8.4 of the Code on Visas.
