"Eesti Vabariigi valitsuse ja Horvaatia Vabariigi valitsuse lennunduskokkuleppe" eelnõu heakskiitmine Teadaanne välislepingu jõustumise kohta Alla kirjutatud 31. märtsil 2004. a Zagrebis, jõustus 15. märtsil 2007. a Eesti Vabariigi valitsus ja Horvaatia Vabariigi valitsus, edaspidi «lepingupooled», olles 7. detsembril 1944. a Chicagos allakirjutamiseks avatud rahvusvahelise tsiviillennunduse konventsiooni osalised; soovides edendada vastastikuseid tsiviillennundusalaseid suhteid ning sõlmida kokkulepe lennuliinide rajamiseks oma territooriumide vahel ja väljaspool neid, on kokku leppinud järgmises. Artikkel 1. Mõisted 1. Kui kontekstist ei tulene teisiti, kasutatakse kokkuleppes järgmisi mõisteid: a) «konventsioon» tähendab 7. detsembril 1944. a Chicagos allakirjutamiseks avatud rahvusvahelise tsiviillennunduse konventsiooni ja selle lisasid, mis on vastu võetud konventsiooni artikli 90 kohaselt, ning lisade või konventsiooni muudatusi, mis on tehtud kooskõlas konventsiooni artiklitega 90 ja 94 ning mille on mõlemad lepingupooled vastu võtnud; b) «lennundusvõimud» tähendab Eesti Vabariigi puhul Majandus- ja Kommunikatsiooniministeeriumi ning isikuid ja asutusi, kellel on volitus täita nimetatud ministeeriumi ülesandeid, ning Horvaatia Vabariigi puhul Mere-, Turismi-, Transpordi- ja Arenguministeeriumi ning isikuid või asutusi, kellel on volitus täita nimetatud ministeeriumi ülesandeid; c) «määratud lennuettevõtja» tähendab käesoleva kokkuleppe artikli 3 kohaselt määratud ja volitatud lennuettevõtjat; d) «territoorium» on konventsiooni artiklis 2 esitatud tähenduses; e) «lennuliin», «rahvusvaheline lennuliin», «lennuettevõtja» ja «peatus mittekaubanduslikel eesmärkidel» on konventsiooni artiklis 96 esitatud tähenduses; f) «maht» tähendab: – õhusõiduki puhul õhusõiduki veomahtu, mille ulatuses laadungit võib ta marsruudil peale võtta; – lennuliini puhul liinil kasutatava õhusõiduki veomahtu, mis korrutatakse õhusõiduki lennusagedusega teatud ajavahemikul teatud marsruudil; g) «tariif» tähendab tasu, mida võetakse reisijate ja lasti veo eest, ning tasu kohaldamise tingimusi, kaasa arvatud vahenduse ja muude lisateenuste tasu ja tingimusi, kuid välja arvatud postiveo tasu ja tingimused; h) «vedu» tähendab reisijate, pagasi, lasti ja posti vedu. 2. Käesoleva kokkuleppe lisa on kokkuleppe lahutamatu osa. Artikkel 2. Veoõigused 1. Lepingupool tagab teisele lepingupoolele käesolevas kokkuleppes sätestatud õigused, et luua kokkuleppe lisas esitatud marsruutidel regulaarsed rahvusvahelised lennuliinid. Lepingupoolte määratud lennuettevõtjal on järgmised õigused: a) lennata üle teise lepingupoole territooriumi ilma maandumiseta; b) teha nimetatud territooriumil peatusi mittekaubanduslikel eesmärkidel, ning c) teha marsruudil lennates peatusi selle marsruudi jaoks kokkuleppe lisas ettenähtud kohtades, et panna maha ja võtta peale rahvusvahelisi reisijaid, pagasit, lasti ja posti. 2. Ka teistel lepingupoolte lennuettevõtjatel peale nende, mis on määratud kokkuleppe artikli 3 kohaselt, on käesoleva artikli lõike 1 punktides a ja b nimetatud õigused. 3. Käesoleva artikli lõige 1 ei tähenda, et lepingupoole kindlaksmääratud lennuettevõtjale võib anda eesõiguse võtta teise lepingupoole territooriumilt tasu või hüvitise eest peale reisijaid, pagasit, lasti või posti, mille sihtkoht asub samuti teise lepingupoole territooriumil. Artikkel 3. Lennutegevusload 1. Lepingupoolel on õigus määrata kokkulepitud marsruutidel kokkulepitud lennuliine käitav lennuettevõtja ning ta teatab sellest kirjalikult teisele lepingupoolele. 2. Teate saamise järel väljastab teine lepingupool määratud lennuettevõtjale viivitamata käesoleva artikli lõigete 3 ja 4 kohaselt lennutegevusloa. 3. Lepingupoole lennundusvõimud võivad nõuda, et teise lepingupoole määratud lennuettevõtja tõendaks oma suutlikkust täita õigusakte, mida nimetatud lennundusvõimud konventsiooni kohaselt rahvusvaheliste lennuliinide käitamisele tavaliselt ja mõistlikult kohaldavad. 4. Artikkel 6. Sertifikaatide ja litsentside tunnustamine 1. Lepingupoole väljastatud või kehtivaks tunnistatud lennukõlblikkussertifikaate, pädevustunnistusi ning litsentse arvestab teine lepingupool nende kehtivusajal kehtivate dokumentidena, eeldusel et tingimused, mille alusel sellised sertifikaadid või litsentsid on välja antud või kehtivaks tunnistatud, on võrdsed käesoleva konventsiooni alusel kehtestatavate miinimumstandarditega või on neist rangemad. 2. Artikkel 9. Otsetransiit Kui reisijaid, pagasit ja lasti veetakse otsetransiidil üle lepingupoole territooriumi ja need ei lahku peatusteks ettenähtud lennujaama territooriumilt, kohaldatakse nende suhtes peale abinõude, mida rakendatakse tsiviillennunduse turvalisuse heaks ja narkootiliste ainete leidmiseks, ainult lihtsustatud kontrolli. Otsetransiidil veetavad pagas ja last on vabastatud tolli- ja muudest maksudest. Artikkel 10. Esindus 1. Artikkel 12. Mahusätted 1. Lepingupoolte määratud lennuettevõtjatel on kahe riigi vahelistel kindlaksmääratud marsruutidel kokkulepitud lennuliinide käitamisel õiglased ja võrdsed võimalused. 2. Kokkulepitud lennuliinide käitamisel võtab lepingupoole määratud lennuettevõtja arvesse teise lepingupoole määratud lennuettevõtja huve, hoidudes põhjendamatult mõjutamast teise lepingupoole tegevust täielikult või osaliselt kattuvatel marsruutidel. 3. Lepingupoole määratud lennuettevõtja peab osutama kokkulepitud teenuseid vastavalt kindlaksmääratud marsruutidel toimuva veo nõudlusele ja esmajoones pakkuma mõistliku koormuse juures veomahtu, mis vastab lennuettevõtja määranud lepingupoole territooriumilt lahkuvate või territooriumile suunduvate reisijate, pagasi, lasti ja posti veo suhtes eksisteerivale ja mõistlikult prognoositavale nõudlusele. 4. Lepingupoole määratud lennuettevõtja võib kokku leppida kindlaksmääratud marsruutidel käitatavatel lennuliinidel toimuvate lendude sageduse ja mahu. Kokkulepitud sageduse ja mahu peavad heaks kiitma mõlema lepingupoole lennundusvõimud. Kindlaksmääratud mahtu võib mõlema lepingupoole lennundusvõimude heakskiidul ja sõltuvalt veonõudlusest aeg-ajalt korrigeerida. 5. Artikkel 16. Lennundusjulgestus 1. Järgides oma õigusi ja kohustusi rahvusvahelise õiguse alusel, kinnitavad lepingupooled veel kord, et nende kohustus üksteise suhtes – kaitsta tsiviillennunduse julgeolekut ebaseadusliku sekkumisaktide vastu – on kokkuleppe lahutamatu osa. Piiramata rahvusvahelise õiguse kohaste õiguste ja kohustuste üldkehtivust, tegutsevad lepingupooled kooskõlas 14. septembril 1963. a Tokyos allakirjutatud konventsiooniga kuritegude ja mõningate teiste tegude kohta õhusõiduki pardal, 16. detsembril 1970. a Haagis allakirjutatud õhusõiduki ebaseadusliku hõivamise vastu võitlemise konventsiooniga ning 23. septembril 1971. a Montrealis allakirjutatud tsiviillennunduse ohutuse vastu suunatud ebaseaduslike tegude tõkestamise konventsiooniga ja 24. veebruaril 1988. a Montrealis allakirjutatud protokolliga ebaseaduslike vägivallaaktide vastu võitlemise kohta rahvusvahelist lennuliiklust teenindavates lennujaamades ning kõigi teiste sama valdkonna rahvusvaheliste dokumentidega, mille osalisriigiks võivad lepingupooled saada. 2. 3. Lepingupooled järgivad Rahvusvahelise Tsiviillennunduse Organisatsiooni kehtestatud ning rahvusvahelise tsiviillennunduse konventsiooni lisades kindlaksmääratud lennundusjulgestust reguleerivaid norme lepingupoolte suhtes kohaldatavas ulatuses; lepingupooled nõuavad, et nende riigis registreeritud õhusõidukite käitajad või õhusõidukite käitajad, kelle peamine tegutsemiskoht või alaline elukoht on nende territooriumil ning nende territooriumil asuvate lennujaamade käitajad tegutseksid kooskõlas nimetatud lennundusjulgestusnormidega. 4. Lepingupooled lepivad kokku, et õhusõiduki käitajatelt võib nõuda selliste lõikes 3 nimetatud lennundusjulgestusnormide järgimist, mida teine lepingupool nõuab tema territooriumile sisenemisel, seal viibimisel või sealt lahkumisel. 5. 8. Kui ühel lepingupoolel on probleeme seoses käesoleva artikli lennundusjulgestussätete täitmisega, võivad ükskõik kumma lepingupoole lennundusvõimud taotleda viivitamatuid konsultatsioone teise lepingupoole lennundusvõimudega. Artikkel 17. Teave ja statistika 1. Lepingupoole lennundusvõimud tagavad, et nende määratud lennuettevõtja edastaks teise lepingupoole lennundusvõimudele nende taotlusel perioodilisi materjale või muid statistilisi aruandeid, mida võib mõistlikult nõuda esimese lepingupoole määratud lennuettevõtja lennuliinide mahu ülevaatamise eesmärgil. Aruanded peavad sisaldama mõistlikus ulatuses kogu taotletud teabe, mis aitab kindlaks määrata nimetatud lennuettevõtjate poolt kokkulepitud lennuliinidel veetud reisijate, pagasi, lasti ja posti mahtu. 2. Artikkel 18. Konsultatsioonid ja muudatused 1. Lepingupool võib igal ajal nõuda konsultatsioone kokkuleppe rakendamise, tõlgendamise, kohaldamise või muutmise küsimuses. Konsultatsioonid, mida võib pidada lennundusvõimude vahel kas diskussioonide või kirjavahetuse vormis, peavad algama kuuekümne (60) päeva jooksul arvates päevast, mil teine lepingupool on kätte saanud kirjaliku taotluse. 2. Kokkulepitud muudatused jõustuvad pärast nende kinnitamist kokkuleppe artikli 22 kohaselt vahetatud diplomaatiliste nootidega. 3. Lisasse võib muudatusi teha lepingupoolte lennundusvõimude otsekokkuleppega. Artikkel 19. Mitmepoolsete konventsioonide kohaldatavus 1. Kokkuleppe alusel loodud lennuliinide suhtes jääb konventsioon lepingupoolte vahel jõusse kokkuleppe kestuse ajaks kokkuleppe allakirjutamise ajal kehtivas redaktsioonis, nagu konventsioon oleks kokkuleppe lahutamatu osa, välja arvatud juhul, kui mõlemad lepingupooled ratifitseerivad konventsiooni muudatusettepaneku, mis jõustub nõuetekohaselt – sel juhul kehtib kokkuleppe suhtes konventsioon muudetud kujul. 2. 5. Lepingupool kannab enda nimetatud vahekohtuniku kulud. Vahekohtu ülejäänud kulud kannavad lepingupooled võrdselt. Artikkel 21. Registreerimine Kokkulepe tuleb registreerida Rahvusvahelise Tsiviillennunduse Organisatsiooni juures. Artikkel 22. Jõustumine Kokkulepe jõustub lepingupoolte põhiseaduslike nõuete täitmist kinnitavate diplomaatiliste nootide vahetamise päeval ning seda kohaldatakse esialgu kokkuleppe allakirjutamise päevast. Artikkel 23. Denonsseerimine Lepingupool võib igal ajal diplomaatiliste kanalite kaudu teisele lepingupoolele kirjalikult teatada oma otsusest käesolev kokkulepe denonsseerida. Sel juhul lõpeb kokkulepe kaheteist (12) kuu möödumisel päevast, mil teine lepingupool on denonsseerimisteate kätte saanud, tingimusel et denonsseerimisteadet ei ole poolte kokkuleppel enne nimetatud tähtaja möödumist tagasi võetud. Denonsseerimisteade edastatakse viivitamata Rahvusvahelisele Tsiviillennunduse Organisatsioonile. The airline(s) designated by each Contracting Party shall enjoy the following rights: a) to fly without landing across the territory of the other Contracting Party, b) to make stops in the said territory for non-traffic purposes; and, c) while operating an agreed service on a specified route, to make stops in the territory at the points specified for that route in the Annex to this Agreement for the purpose of putting down and taking up international traffic. 2. The airlines of each Contracting Party, other than those designated under Article 3 of this Agreement, shall also enjoy the rights specified in paragraph 1. a) and b) of this Article. 3. Nothing in paragraph 1. of this Article shall be deemed to confer on the designated airline(s) of one Contracting Party the privilege of taking up, in the territory of the other Contracting Party, traffic carried for remuneration or hire and destined for another point in the territory of that other Contracting Party. Article 3. Operating Authorizations 1. Each Contracting Party shall have the right to designate in writing to the other Contracting Party airline(s) for the purpose of operating the agreed services on the specified routes. 2. On receipt of such designation, the other Contracting Party shall, subject to the provisions of paragraph 3. and 4. of this Article, without delay grant to the designated airline(s) the appropriate operating authorisations. 3. The aeronautical authorities of one Contracting Party may require an airline designated by the other Contracting Party to satisfy them that it is qualified to fulfil the conditions prescribed under the laws and regulations normally and reasonably applied to the operation of international air services by such authorities in conformity with the provisions of the Convention. 4. Each Contracting Party shall have the right to refuse to grant the operating authorisations referred to in paragraph 2. of this Article or to impose such conditions as it may deem necessary, in any case where the Contracting Party is not satisfied that the designated airline of the other Contracting Party: a) has its principal place of business and permanent residence in the territory of the other Contracting Party and b) has and maintains a strong link to the other Contracting Party. In judging the existence of a strong link, Contracting Parties should take into account elements such as the designated airline establishing itself and having a substantial amount of its operations and capital investment in physical facilities, paying income tax and registering its aircraft in the other Contracting Party and employing a significant number of nationals of the other Contracting Party in managerial, technical and operational positions. 5. When an airline has been so designated and authorised it may begin at any time to operate air services, provided that a tariff and flight schedules are established in accordance with the provisions of Article 13 and Article 14 of this Agreement. Article 4. Revocation and Suspension of Operating Authorizations 1. Each Contracting Party shall have the right to revoke an operating authorisation or to suspend the exercise of the rights specified in Article 2 of this Agreement to an airline designated by the other Contracting Party or to impose such conditions as it may deem necessary on the exercise of these rights in any case where it is not satisfied that the designated airline(s): a) has its principal place of business and permanent residence in the territory of the other Contracting Party, or b) has and maintains a strong link to the other Contracting Party, or c) fails to comply with the laws, regulations and/or rules of the Contracting Party granting these rights, or d) otherwise fails to operate in accordance with the conditions prescribed under this Agreement. 2. Unless immediate revocation, suspension or imposition of the conditions mentioned in paragraph 1. of this Article is essential to prevent further infringements of laws, regulations and/or rules, such right shall be exercised only after consultation between the aeronautical authorities of the Contracting Parties. Article 5. Application of Laws and Regulations 1. The laws and regulations of a Contracting Party relating to the admission into, stay in, or departure from its territory of aircraft engaged in international air navigation, or to the operation and navigation of such aircraft while within its territory, shall be applied to the aircraft of both Contracting Parties without distinction as to nationality, and shall be complied with by such aircraft upon entering or departing from or while within the territory of that Contracting Party. 2. The laws and regulations of a Contracting Party relating to the admission into, stay in, or departure from its territory of passengers, crew, cargo and mail transported on board the aircraft, such as regulations relating to entry, clearance, immigration, passports, customs and sanitary control shall apply to passengers, crew, cargo and mail upon entry into or departure from or while within the territory of that Contracting Party. Article 6. Recognition of Certificates and Licences 1. Certificates of airworthiness, certificates of competency and licences issued or rendered valid by one Contracting Party shall, during the period of their validity, be recognised as valid by the other Contracting Party, provided that the requirements under which such certificates or licences were issued or rendered valid are equal to or above the minimum standards which may be established pursuant to the Convention. 2. Each Contracting Party reserves the right, however, to refuse to recognise as valid, for the purpose of flights over its own territory, certificates of competency and licences granted to or rendered valid for its own nationals by the other Contracting Party or by any other State. Article 7. Exemption from Customs and Other Duties and Taxes 1. Aircraft operated on international air services by the designated airline(s) of one Contracting Party, as well as their regular equipment, spare parts, supplies of fuel and lubricants, aircraft stores (including food, beverages, and tobacco) on board such aircraft shall be exempt from all customs duties, inspection fees and other similar charges according to the provisions of the Convention on Temporary Admission, concluded on June 26, 1990 in Istanbul, on arriving in the territory of the other Contracting Party, provided such equipment, spare parts, supplies and stores are re-exported or are used or consumed by such aircraft on flight over the territory. 2. The same treatment as in paragraph 1. of this Article shall be accorded to spare parts entered into the territory of either Contracting Party for maintenance or repair of aircraft used on international services by the designated airline(s) of the other Contracting Party. Such spare parts may be required to be kept under Customs supervision or control. 3. Necessary airline documents, such as timetables, printed promotional materials, air tickets and air waybills, intended for the use of designated airline(s) of one Contracting Party and introduced into the territory of the other Contracting Party, shall be exempted from customs duties, fees and other similar charges not based on the cost of services on arrival or departure according to the national legislation of the Contracting Party to whose territory the documents are introduced. 4. The regular airborne equipment as well as the materials and supplies retained on board the aircraft of either Contracting Party may be unloaded in the territory of the other Contracting Party only with the approval of the Customs authorities of such territory. In such case, they may be placed under the supervision of said authorities up to such time as they are re-exported or otherwise disposed of in accordance with customs regulations. Article 8. User Charges 1. Neither Contracting Party shall impose or permit to be imposed on the designated airline(s) of the other Contracting Party user charges higher than those imposed on their own airlines operating similar international air services. 2. Each Contracting Party shall encourage consultations on user charges between its competent charging authorities and airlines using the services and facilities provided by those charging authorities, where practicable, through those airlines’ representative organisations. Reasonable notice of any proposals for changes in user charges may be given to such users to enable them to express their views before changes are made. Article 9. Direct Transit Traffic Passengers, baggage and cargo in direct transit across the territory of one Contracting Party and not leaving the area of the airport reserved for such purpose shall be subject to no more than a simplified control except in respect of measures relating to civil aviation security and narcotics control. Baggage and cargo in direct transit shall be exempt from customs duties and other charges. Article 10. Representation 1. Each Contracting Party shall grant the designated airline(s) of the other Contracting Party the right to bring and maintain on its territory for the performance of the agreed services, the technical and commercial personnel as may be required by the extent of such services. The above personnel shall be subject to the laws and regulations of that Contracting Party for entry into and stay in its territory, and shall, on the basis of reciprocity, and with the minimum of delay, be granted the necessary work permits, employment visas or other similar documents. 2. These personnel requirements may, at the opinion of the designated airline(s), be satisfied by its own personnel or by using the services of another organisation, company or airline operating in the territory of the other Contracting Party, and authorised to perform such services in the territory of that Contracting Party. Article 11. Financial Provisions 1. Each designated airline shall have the right to sell and issue its own transportation documents in the territory of the other Contracting Party directly and, at its discretion, through its agents. Such airlines shall have the right to sell such transportation, and any person shall be free to purchase such transportation in local currency or any convertible currency, according to the laws and regulations of the said Contracting Party. 2. Each designated airline shall have the right to convert and remit to its country on demand, at the official rate of exchange, the excess of receipts over expenditures achieved in connection with the carriage of passengers, cargo and mail. The above mentioned transfer shall be made in accordance with applicable foreign exchange regulations and shall not be subject to any charges except normal service charges collected by banks for such transactions. 3. In case special arrangements ruling the settlement of payments are in force between the Contracting Parties, the provisions of such arrangements shall be applied to the transfer of funds under paragraph 2. of this Article. Article 12. Capacity Provision 1. There shall be fair and equal opportunity for the designated airline(s) of both Contracting Parties to operate the agreed services on the specified routes between their respective territories. 2. In operating the agreed services, the designated airline(s) of each Contracting Party shall take into account the interests of the designated airline(s) of the other Contracting Party so as not to affect unduly the services which the latter provides on the whole or part of the same routes. 3. The agreed services provided by the designated airline(s) of the Contracting Parties shall bear a close relationship to the requirements of the public for transportation on the specified routes and shall have as their primary objective the provision, at a reasonable load factor, of capacity adequate to carry the current and reasonably anticipated requirements for the carriage of traffic originating in or destined for the territory of the Contracting Party which has designated the airline(s). 4. The designated airline(s) of both Contracting Parties may agree on the frequency and capacity of the services to be offered on the specified routes. The frequency and capacity so agreed shall be subject to the approval of the aeronautical authorities of both Contracting Parties. Such capacity shall be adjusted from time to time depending upon the traffic demand subject to the approval of the aeronautical authorities of both Contracting Parties. 5. In case there is no agreement pursuant to paragraph 4. above, the capacity to be provided and the frequency of services to be operated by the designated airline(s) of each Contracting Party shall be agreed between the aeronautical authorities of the Contracting Parties. Article 13. Establishment of Tariffs 1. The tariffs to be charged by the designated airline(s) of one Contracting Party for carriage to or from the territory of the other Contracting Party shall be established at reasonable levels, due regard being paid to all relevant factors including cost of operation, reasonable profit and the tariffs of other airlines. 2. The tariffs referred to in the Article 1 of this Agreement and in paragraph 1. of this Article shall, wherever possible, be agreed by the designated airline(s) of both Contracting Parties after consultation with the other airlines operating over the whole or part of the route, and such agreement shall ordinarily be reached by the use of the procedures of the International Air Transport Association (hereinafter referred to as IATA) for the working out of tariffs. 3. The tariffs so agreed shall be submitted for the approval of the aeronautical authorities of both Contracting Parties at least thirty (30) days before the proposed date of their introduction. In special cases, this period may be reduced, subject to the agreement of the said authorities. 4. This approval may be given expressly. If neither of the aeronautical authorities has expressed disapproval within twenty (20) days from the date of submission, in accordance with paragraph 3. of this Article, these tariffs shall be considered as approved. In the event of the period for submission being reduced, as provided for in paragraph 3., the aeronautical authorities may agree that the period within which any disapproval must be notified shall be less than twenty (20) days. 5. If a tariff cannot be agreed in accordance with paragraph 2. of this Article, or one aeronautical authority gives the other aeronautical authority notice of its disapproval of any tariff agreed in accordance with the provisions of paragraph 2. above, the aeronautical authorities of the Contracting Parties shall endeavour to determine the tariff by mutual agreement. 6. If the aeronautical authorities cannot agree on any tariff submitted to them under paragraph 3. of this Article, or on the determination of any tariff under paragraph 5. of this Article, the dispute shall be settled in accordance with the provisions of Article 20 of this Agreement. 7. A tariff established in accordance with the provisions of this Article shall remain in force until a new tariff has been established. Nevertheless, a tariff shall not be prolonged by virtue of this paragraph for more than twelve (12) months after the date on which it otherwise would have expired. Article 14. Approval of Flight Schedules 1. The designated airline(s) of one Contracting Party shall submit its or their traffic programmes (for the summer and winter periods) for approval to aeronautical authorities of the other Contracting Party at least thirty (30) days prior to the beginning of the operations. Such submissions shall include in particular the timetables, the frequency of the services and the types of aircraft to be used. That aeronautical authorities shall give their decision on such traffic programme submissions within twenty (20) days from the date the airline concerned submits its programme for approval. Each alteration in the traffic programme as well as requests for permissions to operate additional flights shall be submitted by the designated airline(s) of one Contracting Party for approval to the aeronautical authorities of the other Contracting Party. 2. The designated airline(s) shall also furnish any other information as may be required to satisfy the aeronautical authorities of the other party that the requirements of the Agreement are being duly observed. Article 15. Aviation Safety 1. Each Contracting Party may request consultations at any time concerning safety standards in any area relating to aircrew, aircraft or their operation adopted by the other Contracting Party. Such consultations shall take place within thirty (30) days of that request. 2. If, following such consultations, one Contracting Party finds that the other Contracting Party does not effectively maintain and administer safety standards in any such area that are at least equal to the minimum standards established at that time pursuant to the Convention, the first Contracting Party shall notify the other Contracting Party of those findings and the steps considered necessary to conform with those minimum standards, and that other Contracting Party shall take appropriate corrective action. Failure by the other Contracting Party to take appropriate action within fifteen (15) days or such longer period as may be agreed, shall be grounds for the application of Article 4 of this Agreement. 3. Notwithstanding the obligations mentioned in Article 33 of the Convention it is agreed that any aircraft operated by the designated airline(s) of one Contracting Party on air services to or from the territory of the other Contracting Party may, while within the territory of the other Contracting Party, be made the subject of an examination by the authorised representatives of the other Contracting Party, on board and around the aircraft to check both the validity of the aircraft documents and those of its crew and the apparent condition of the aircraft and its equipment (in this Article called “ramp inspection”), provided this does not lead to unreasonable delay. 4. If any such ramp inspection or series of ramp inspections gives rise to: a) serious concerns that an aircraft or the operation of an aircraft does not comply with the minimum standards established at that time pursuant to the Convention; or b) serious concerns that there is a lack of effective maintenance and administration of safety standards established at that time pursuant to the Convention, the Contracting Party carrying out the inspection shall, for the purposes of Article 33 of the Convention, be free to conclude that the requirements under which the certificate or licences in respect of that aircraft or in respect of the crew of that aircraft had been issued or rendered valid, or that the requirements under which that aircraft is operated, are not equal to or above the minimum standards established pursuant to the Convention. 5. In the event that access for the purpose of undertaking a ramp inspection of an aircraft operated by a designated airline of one Contracting Party in accordance with paragraph 3. above is denied by the representative of that designated airline the other Contracting Party shall be free to infer that serious concerns of the type referred to in paragraph 4. above arise and draw the conclusions referred in that paragraph. 6. Each Contracting Party reserves the right to suspend or vary the operating authorisation of the designated airline of the other Contracting Party immediately in the event the first Contracting Party concludes, whether as a result of a ramp inspection, a series of ramp inspections, a denial of access for ramp inspection, consultation or otherwise, that immediate action is essential to the safety of operation of the designated airline(s). 7. Any action by one Contracting Party in accordance with paragraphs 2. or 6. above shall be discontinued once the basis for the taking of that action ceases to exist. Article 16. Aviation Security 1. Consistent with their rights and obligations under international law, the Contracting Parties reaffirm that their obligation to each other to protect the security of Civil Aviation against acts of unlawful interference forms an integral part of this Agreement. Without limiting the generality of their rights and obligations under international law, the Contracting Parties shall in particular act in conformity with the provisions of the Convention on Offences and Certain Other Acts Committed on Board Aircraft, signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at the Hague on 16 December 1970 and the Convention for the Suppression of Unlawful Acts Against the Safety of Civil Aviation, signed at Montreal on 23 September 1971 and the Protocol for the Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation, signed at Montreal on 24 February 1988 and all other international instruments in the same field which the Contracting Parties may become Parties to. 2. The Contracting Parties shall provide upon request, all necessary assistance to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passengers and crew, airports and air navigation facilities, and any other threat to the security of civil aviation. 3. The Contracting Parties shall, in their mutual relations, act in conformity with the aviation security provisions established by the International Civil Aviation Organisation and defined in Annexes to the Convention on International Civil Aviation, to the extent that such security provisions are applicable to the Contracting Parties; they shall require that operators of aircraft of their registry or operators of aircraft who have their principal place of business or permanent residence in their territory and the operators of airports in their territory act in conformity with such aviation security provisions. 4. Each Contracting Party agrees that such operators of aircraft may be required to observe the aviation security provisions referred to in paragraph 3. above, required by the other Contracting Party for entry into, departure from, or while within the territory of that other Contracting Party. 5. Each Contracting Party shall ensure that adequate measures are effectively applied within its territory to protect the aircraft and to inspect passengers, crew, carry-on items, baggage, cargo and aircraft stores prior to and during boarding or loading. Each Contracting Party shall also give positive consideration to any request from the other Contracting Party for reasonable special security measures to meet a particular threat. 6. When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful acts against the safety of such aircraft, their passengers and crew, airports or air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safely such incident or threat thereof. 7. Each Contracting Party shall take measures, as it my find practicable, to ensure that an aircraft subjected to an act of unlawful seizure or other acts of unlawful interference, which has landed in its territory is detained on the ground unless its departure is necessitated by the overriding duty to protect human life. Wherever practicable, such measures shall be taken on the basis of mutual consultations. 8. Should one Contracting Party have problems with regard to the aviation security provisions of this Article, the aeronautical authorities of either Contracting Party may request immediate consultations with the aeronautical authorities of the other Contracting Party. Article 17. Information and Statistics 1. The aeronautical authorities of either Contracting Party shall cause their designated airline(s) to furnish to the aeronautical authorities of the other Contracting Party, at their request, such periodic or other statements of statistics as may be reasonably required for the purpose of reviewing the capacity provided on air services by the designated airline(s) of the first Contracting Party. Such statements shall include, at reasonable extent, all information required determining the amount of traffic carried by those airlines on agreed services. 2. Article 18. Consultations and Amendments 1. Either Contracting Party may at any time request consultations on the implementation, interpretation, application or amendment of this Agreement. Such consultation, which may be between aeronautical authorities and which may be through discussions or by correspondence, shall begin within a period of sixty (60) days of the date on which the other Contracting Party received a written request. 2. Any amendments so agreed shall come into force when they have been confirmed by an exchange of diplomatic notes pursuant to the Article 22 of this Agreement. 3. Amendments to the Annex may be made by direct agreement between the aeronautical authorities of the Contracting Parties. Article 19. Applicability of Multilateral Conventions 1. To the extent to which they are applicable to the air services established under this Agreement, the provisions of the Convention shall remain in force in their present form between the Contracting Parties for the duration of the Agreement, as if they were an integral part of the Agreement, unless both Contracting Parties ratify any amendment to the Convention, which shall have duly come into force, in which case the Convention as amended shall remain in force for the duration of this Agreement. 2. If a general multilateral air convention is or comes into force in respect of both Contracting Parties, the provisions of such convention shall prevail. Article 20. Settlement of Disputes 1. If any dispute arises between the Contracting Parties relating to the interpretation or application of this Agreement and the Annex thereto, the Contracting Parties shall, in the first place, endeavour to settle it by negotiations. 2. If the Contracting Parties fail to reach a settlement by negotiation, they may agree to refer the dispute for decision to some person or body or the dispute may, at the request of either Contracting Party, be submitted for decision to a tribunal of three arbitrators, one to be nominated by each Contracting Party and the third to be appointed by the two so nominated. Each Contracting Party shall nominate an arbitrator within a period of sixty (60) days from the date of receipt by either Contracting Party from the other of a notice through diplomatic channels requesting arbitration of the dispute and the third arbitrator shall be appointed within a further period of sixty (60) days. If either Contracting Party fails to nominate an arbitrator within the period specified, or if the third arbitrator is not appointed within the period specified, the President of the International Civil Aviation Organisation may be requested by either Contracting Party to appoint an arbitrator or arbitrators as the case requires. In such case, the third arbitrator shall be a national of a third State and shall act as president of the arbitrate tribunal. 3. The Contracting Parties undertake to comply with any decision given under paragraph 2. of this Article. 4. If and so long as either Contracting Party or the designated airline(s) of either Contracting Party fails to comply with the decision given under paragraph 2. of this Article, the other Contracting Party may limit, suspend or revoke any rights or privileges which it has granted by virtue of this Agreement to the Contracting Party in default. 5. Each Contracting Party shall pay the expenses of the arbitrator it has nominated. The remaining expenses of the tribunal arbitrate shall be shared equally by the Contracting Parties. Article 21. Registration This Agreement shall be registered with the International Civil Aviation Organisation. Article 22. Entry into Force This Agreement shall enter into force after fulfilment of the constitutional requirements by each Contracting Party, on the date of exchange of diplomatic notes to this effect and shall be provisionally applied from the date of its signature. In such case this Agreement shall terminate twelve (12) months after the date of receipt of the notice by other Contracting Party, unless the notice to denounce is withdrawn by agreement before the expiry of this period. The notice of denunciation shall be simultaneously communicated to the International Civil Aviation Organisation. In the absence of acknowledgement of receipt by the other Contracting Party, the notice shall be deemed to have been received fourteen (14) days after the receipt of the notice by the International Civil Aviation Organisation.
