Riigikogu — Tööstusdisainilahenduste rahvusvahelise klassifikatsiooni Locarno kokkulepe — RT II, 1996, 23, 87

(õ) 1.12.2008 17:20 Kokkuleppega ühinemise seadus Välisministeeriumi teadaanne välislepingu jõustumise kohta Mitteametlik tõlge Alla kirjutatud Locarnos 8. oktoobril 1968, parandatud 28. septembril 1979 Artikkel 1. Spetsiaalse Liidu moodustamine; rahvusvahelise klassifikatsiooni vastuvõtmine (1) Riigid, kelle suhtes käesolev kokkulepe rakendub, moodustavad Spetsiaalse Liidu. (2) Nad võtavad vastu ühtse tööstusdisainilahenduste rahvusvahelise klassifikatsiooni (edaspidi klassifikatsioon). (3) Klassifikatsioon sisaldab: (i) klasside ja alaklasside loendi; (ii) tööstusdisainilahendusi sisaldavate kaupade alfabeetilise loendi, kus on ära näidatud klassid ja alaklassid; (iii) selgitused. (4) Klasside ja alaklasside loend on käesolevale kokkuleppele lisatud nimekiri, kus on arvestatud muudatusi ja täiendusi, mida võib teha vastavalt artiklile 3 asutatud Ekspertide Komitee (edaspidi Ekspertide Komitee). (5) Kaupade alfabeetilise loendi ja selgitused võtab vastu Ekspertide Komitee artiklis 3 kehtestatud protseduurireeglite järgi. (6) Ekspertide Komitee võib klassifikatsiooni muuta või täiendada vastavalt artiklis 3 kehtestatud protseduurireeglitele. (7) (a) Klassifikatsioon koostatakse inglise ja prantsuse keeles. (b) Klassifikatsiooni ametliku teksti teistes keeltes, mida artiklis 5 nimetatud Assamblee võib vajalikuks pidada, koostab pärast konsulteerimist huvitatud valitsustega Intellektuaalse Omandi Rahvusvaheline Büroo (edaspidi Rahvusvaheline Büroo), kellele on viidatud Ülemaailmse Intellektuaalse Omandi Organisatsiooni (edaspidi Organisatsioon) asutamise konventsioonis. Artikkel 2. Artikkel 3. Ekspertide Komitee (1) Ekspertide Komitee kohustus on täita artiklites 1(4), 1(5), 1(6) nimetatud ülesandeid. (5) Igal eksperdil on õigus hääletada kirja teel. Artikkel 5. Spetsiaalse Liidu Assamblee (1) (a) Spetsiaalsel Liidul on Assamblee, mis koosneb Spetsiaalse Liidu liikmesriikidest. (b) Iga Spetsiaalse Liidu liikmesriigi valitsust esindab üks delegaat, keda võivad abistada asetäitjad, nõuandjad ja eksperdid. (c) Iga delegatsiooni kulud katab delegatsiooni moodustanud valitsus. (3) (a) Assamblee igal liikmesriigil on üks hääl. (b) Kvoorumi moodustab pool Assamblee liikmesriikidest. (d) Vastavalt artikli 8(2) sätetele on Assamblee otsuste puhul vajalik kahekolmandikuline häälteenamus. (e) Erapooletuks jäämist ei loeta hääleks. (f) Üks delegaat võib esindada ainult üht riiki ja hääletada ainult selle riigi nimel. (4) (a) Assamblee koguneb korralisele istungjärgule igal teisel kalendriaastal peadirektori kutsel samal ajal ning samas kohas Organisatsiooni Peaassambleega, välja arvatud erandjuhud. (b) Assamblee koguneb peadirektori kutsel erakorralisele istungjärgule Assamblee ühe neljandiku liikmesriikide nõudmisel. (c) Iga istungjärgu päevakorra valmistab ette peadirektor. (5) Assamblee kehtestab ise oma protseduurireeglid. Artikkel 6. Rahvusvaheline Büroo (1) (a) Spetsiaalse Liidu administratiivülesandeid täidab Rahvusvaheline Büroo. (3) (a) Rahvusvaheline Büroo valmistab vastavalt Assamblee juhtnööridele ette käesoleva kokkuleppe revideerimise konverentse, kus vaadatakse läbi kokkuleppe sätteid, välja arvatud artiklid 5–8. (b) Rahvusvaheline Büroo võib käesoleva kokkuleppe revideerimise konverentside ettevalmistamise küsimustes pidada nõu valitsustevaheliste ja rahvusvaheliste valitsusväliste organisatsioonidega. (c) Peadirektor ja tema poolt määratud isikud võtavad nimetatud konverentsidel peetavatest diskussioonidest osa ilma hääleõiguseta. (4) Rahvusvaheline Büroo täidab kõiki teisi talle antud ülesandeid. Artikkel 7. Rahalised vahendid (1) (a) Spetsiaalsel Liidul on oma eelarve. (c) Liikmemaks tuleb tasuda iga aasta 1. jaanuariks. (6) (a) Spetsiaalsel Liidul on käibekapitali fond, mis koosneb Spetsiaalse Liidu liikmesriikide ühekordsetest maksetest. (b) Punktis a nimetatud riigil ja Organisatsioonil on mõlemal õigus kirjaliku teate alusel denonsseerida ettemaksekohustus. Denonsseerimine jõustub kolme aasta möödumisel selle aasta lõppemisest, millal sellest teatati. (8) Audiitorkontrolli viib läbi üks või mitu Spetsiaalse Liidu liikmesriiki või väljastpoolt valitud audiitorit finantseeskirjades ettenähtud korras. Audiitorid määrab nende nõusolekul Assamblee. Artikkel 8. Parandused artiklites 5 kuni 8 (1) Ettepaneku teha parandused artiklites 5, 6, 7 ja käesolevas artiklis võib teha iga Spetsiaalse Liidu liikmesriik või peadirektor. Peadirektor saadab need ettepanekud Spetsiaalse Liidu liikmesriikidele vähemalt kuus kuud enne nende läbivaatamist Assamblees. Artikkel 10. (2) Denonsseerimine jõustub ühe aasta möödumisel päevast, mil peadirektor on sellekohase teate kätte saanud. (3) Käesolevas artiklis sätestatud denonsseerimisõigust ei tohi ükski riik kasutada enne viie aasta möödumist päevast, mil ta sai Spetsiaalse Liidu liikmeks. Artikkel 13. Territooriumid Käesoleva kokkuleppe suhtes rakenduvad tööstusomandi kaitse Pariisi konventsiooni artikli 24 sätted. Artikkel 14. Allakirjutamine, keeled, teated (1) (a) Käesolev kokkulepe kirjutatakse alla ühes eksemplaris inglise ja prantsuse keeles, kusjuures mõlemad tekstid on võrdselt autentsed, ning deponeeritakse Šveitsi valitsuse juures. (b) Käesolev kokkulepe on allakirjutamiseks avatud Bernis kuni 30. juunini 1969. (2) Ametlikud tekstid teistes keeltes, mida võib määrata Assamblee, valmistab ette peadirektor pärast konsulteerimist huvitatud riikide valitsustega. (3) Peadirektor saadab kaks Šveitsi valitsuse poolt kinnitatud käesoleva kokkuleppe allakirjutatud teksti koopiat kokkuleppele alla kirjutanud riikide valitsustele ja nõudmise korral mis tahes teise riigi valitsusele. (4) Peadirektor registreerib käesoleva kokkuleppe Ühinenud Rahvaste Organisatsiooni Sekretariaadis. (5) Peadirektor teatab kõigi Spetsiaalse Liidu liikmesriikide valitsustele kokkuleppe jõustumise kuupäevast, allakirjutamistest, ratifitseerimis- ja ühinemisdokumentide deponeerimistest, paranduste vastuvõtmistest, paranduste jõustumise kuupäevadest ja denonsseerimisteadetest.
