Vabariigi Valitsus — Eesti Vabariigi ja Sloveenia Vabariigi viisaküsimustes Montenegro Vabariigis esindamise kokkulepe — RT II, 2008, 16, 47

Välisministeeriumi teadaanne välislepingu jõustumise kohta Kokkuleppe muutmise kokkulepe Vabariigi Valitsuse 27.03.2008 korraldus nr 158 kokkuleppe eelnõu heakskiitmise kohta Sõlmitud nootide vahetamise teel, jõustus 1. juunil 2008. a VERBAALNOOT Eesti Vabariigi Välisministeerium avaldab oma lugupidamist Sloveenia Vabariigi Välisministeeriumile ning tal on au teatada järgmist. Ministeeriumil on au kooskõlas ühiste konsulaarjuhiste sätetega, mis käsitlevad Schengeni riikide esindamist kolmandates riikides, teha ettepanek, et Sloveenia esindaks Eestit Montenegros (Podgorica). Sellise esindamise aluseks on Schengeni õigustik ja käesolev kokkulepe. Kokkuleppe praktilistes rakendustingimustes võidakse kokku leppida mitteametlikult. Viisa Kokkulepe käsitleb viisataotluste menetlemist, nagu on kindlaks määratud Schengeni õigustikus. Kui Sloveenia suursaatkond leiab, et taotlus vastab kõikidele viisa väljastamise nõuetele ega ole ebaseadusliku sisserände ega avaliku korra rikkumise ohtu, väljastab ta viisa. Kui Sloveenia suursaatkonnal ei ole ega ole võimalik saada taotleja/viidatud allikate või reisieesmärgi kohta vajalikku teavet või kui suursaatkond leiab, et viisat ei peaks väljastama, või kui ta kahtleb, kas viisat peaks väljastama, palutakse viisataotlejal pöörduda Eesti suursaatkonda Sofias. Statistika Sloveenia teavitab konkreetse või üldise taotluse alusel Eestit väljastatud viisadest. Viisatasu Viisataotluste tasu nõutakse Schengeni õigustikust juhindudes. Sloveeniale laekuvad kõik viisatasu. Eesti ei anna Sloveeniale peale selle mingit rahalist hüvitist viisataotluste menetlemise eest. See puudutab üldkulusid, nagu rent, personali- ja IT-seadmete kulud, samuti konkreetseid kulusid, nagu postikulud, kulleritasud ja faksikulud. Lõppsätted Kokkulepet saab muuta nootide vahetamise teel. Kui olukord nõuab, saab kumbki pool verbaalnoodiga kokkuleppe peatada või selle kohe lõpetada. Eesti Vabariigi Välisministeerium kasutab avanenud võimalust, et veel kord avaldada Sloveenia Vabariigi Välisministeeriumile oma sügavaimat austust. 1. aprillil 2008 Tallinnas VERBAALNOOT Sloveenia Vabariigi Välisministeerium avaldab oma lugupidamist Eesti Vabariigi Välisministeeriumile ning – viidates verbaalnoodile nr 8.2/3617 – on tal au tänada Eesti Vabariigi Välisministeeriumi esindamise eest viisade väljastamisel Sofias. Sellele lisaks annab Sloveenia Vabariigi Välisministeerium Eesti Vabariigi Välisministeeriumile teada, et Sloveenia Vabariigi Välisministeerium nõustub ettepanekuga esindada Eestit viisaküsimustes Montenegros (Podgoricas) alates 1. juunist 2008. Sloveenia Vabariigi Välisministeerium kasutab avanenud võimalust, et veel kord avaldada Eesti Vabariigi Välisministeeriumile oma sügavaimat austust. 16. mail 2008 Ljubljanas VERBAL NOTE The Ministry of Foreign Affairs of the Republic of Estonia presents its compliments to the Ministry of Foreign Affairs of the Republic of Slovenia and has the honour to convey the following. The Ministry has the honour to propose, in accordance with the provisions of the Common Consular Instructions (CCI) concerning the representation of Schengen States in third countries that Slovenia represents Estonia in matters relating to the issue of visas in Montenegro (Podgorica). The basis for this representation is the Schengen acquis and this arrangement. The practical conditions of implementing this arrangement may be agreed upon informally. Visa The arrangement regards the handling of visa applications as defined in the Schengen acquis. If the Embassy of Slovenia finds that all the conditions for issuing a visa are met and that there is no risk of illegal immigration or disturbance of the public order, the Embassy will issue a visa. If Embassy of Slovenia does not have, and cannot obtain, the necessary information about the applicant/the references or the purpose of the visit, or if it finds that a visa should not be issued, or if it is in doubt whether or not a visa should be issued, the visa applicant will be asked to appear at the Embassy of Estonia in Sofia. Statistics Slovenia will, after a specific or general request, inform Estonia regarding the visas that have been issued. Fees Fees for visa applications will be charged in accordance with the Schengen acquis. Slovenia is entitled to all visa fees. Besides that, Estonia will not give any financial compensation to Slovenia for handling visa applications. This applies to general expenses such as rent, staff and IT equipment as well as to specific expenses like postage, courier fees and fax. Final clauses This arrangement enters into force on April 14, 2008. This arrangement may be amended by exchange of notes. If the circumstances so indicate, both sides may immediately suspend or terminate the arrangement by a verbal note. The Ministry of Foreign Affairs of the Republic of Estonia avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Slovenia the assurances of its highest consideration. Tallinn, April 1, 2008 VERBAL NOTE The Ministry of Foreign Affairs of the Republic of Slovenia presents its compliments to the Ministry of Foreign Affairs of the Republic of Estonia and has the honour – further to the Note Verbal Nr. 8.2/3617 – to thank the Ministry of Foreign Affairs of the Republic of Estonia for the offered representation for the delivery of visas in Sofia. In addition the Ministry of Foreign Affairs of the Republic of Slovenia informs the Ministry of Foreign Affairs of the Republic of Estonia that the Ministry of Foreign Affairs of the Republic of Slovenia accepts the proposal to represent Estonia in Montenegro (Podgorica) in matters relating to the issue of visas starting from June 1, 2008. The Ministry of Foreign Affairs of the Republic of Slovenia avails itself of this opportunity to renew the Ministry of Foreign Affairs of the Republic of Estonia of its highest consideration.
