Artikkel 2. Eesmärk Kokkuleppe eesmärk on soodustada kasvuhoonegaaside heitkoguste vähendamisele suunatud projektide teostamist Eestis, tagada, et pooled rakendaksid Kyoto protokolli artikli 6 asjaomaseid sätteid ja protokolliosaliste vastuvõetud täiendavaid juhiseid ning kindlustada enne Kyoto protokolli esimese kohustusperioodi algust projektide elluviimise tulemusena saavutatud heitkoguste vähendamise ühikute ning heitkoguste vähendamisega saavutatud lubatud koguste ühikute ülekandmine Rootsile. Kokkulepe sätestab pooltevahelise koostöö üldtingimused ja menetlused. Kokkulepe kehtib ka Kyoto protokolli artikliga 6 kehtestatud ühisrakenduse üksikprojektide suhtes. Iga projekti eritingimustes ja menetlustes lepivad projekti elluviijad kokku projektikokkulepetes, näiteks heitkoguste vähendamise ühikute ostu-müügilepingus. Artikkel 3. Projektikokkuleppele peab olema lisatud Rootsi volitatud asutuse heakskiidukiri projekti kohta. Projektikokkuleppe sõlmimiseks on vajalik Eesti volitatud asutuse heakskiit. Artikkel 9. Läbivaatamine Pooled vaatavad selle kokkuleppe sätteid läbi perioodiliselt. Esimene läbivaatamine algab hiljemalt üks aasta enne Kyoto protokolli esimese kohustusperioodi algust. Artikkel 10. Muudatused Kokkulepet võib muuta poolte kirjalikul kokkuleppel. Muudatus jõustub kolmekümne päeva möödumisel päevast, mil mõlemad pooled on teineteisele teatanud muudatuse jõustumiseks vajalike põhiseaduslike nõuete täitmisest. Artikkel 11. Vaidluste lahendamine Kokkuleppe tõlgendamist või rakendamist käsitlevad vaidlused lahendatakse diplomaatiliste kanalite kaudu. Vaidlused, mida ei lahendata läbirääkimiste teel, antakse ühe poole nõudmisel vahekohtusse. Pooled lepivad kokku anda vaidlus vahekohtusse lõpliku ja poolte suhtes kohustusliku otsuse saamiseks kooskõlas alalise vahekohtu kahe riigi vaheliste vaidluste lahendamise fakultatiivkorraga, mis kehtib selle kokkuleppe sõlmimise hetkel. Vahekohtunikke on kolm ja vahekohtu menetluses kasutatav keel on inglise keel. Artikkel 12. Jõustumine Kokkulepe jõustub kolmekümnendal päeval pärast päeva, mil pooled on teineteisele teatanud kokkuleppe jõustumiseks vajalike põhiseaduslike nõuete täitmisest. Artikkel 13. Denonsseerimine Pool võib kokkuleppe denonsseerida, edastades teisele poolele diplomaatiliste kanalite kaudu sellekohase kirjaliku teate. Verification of Emission Reductions The greenhouse gas emission reductions generated by a project shall be subject to verification in accordance with the Convention on Climate Change, the Kyoto Protocol and relevant decisions, modalities, guidelines and procedures thereunder. Article 8. Information The designated focal point shall promptly inform each other of any event or situation that might affect the projects implemented jointly. They shall also ensure that all relevant authorities and organizations are informed of this Agreement, the project agreements and the implementation thereof. Article 9. Review The Parties shall periodically review the provisions set out in this Agreement. The first review shall commence no later than the year before the beginning of the first commitment period of the Kyoto Protocol. Article 10. Amendments This Agreement may be amended by a written agreement between the Parties. The amendment shall enter into force thirty days after the date when the Parties have notified each other that their respective constitutional requirements for the entry into force of the amendment have been complied with. Article 11. Settlement of Disputes Any dispute concerning interpretation or implementation of this Agreement shall be solved through diplomatic channels. Any dispute, which is not settled by negotiation, shall, at the request of one Party, be submitted to arbitration. The Parties agree to submit the dispute to final and binding arbitration in accordance with the Permanent Court of Arbitration Optional Rules for Arbitrating Disputes between Two States, as in effect on the date of this Agreement. The number of arbitrators shall be three and the language to be used in the arbitral proceedings shall be English. Article 12. Entry into Force This Agreement shall enter into force thirty days after the date when the Parties have notified each other that their respective constitutional requirements for the entry into force of the Agreement have been complied with. Article 13. Denunciation Either Party may denounce this Agreement by a written notice through diplomatic channels. The denunciation shall take effect upon expiry of six months from the date of receipt by the other party of the written notice, or at any later date specified in the notice.
