Vabariigi Valitsus — Eesti Vabariigi valitsuse ja Poola Vabariigi valitsuse vaheline organiseeritud kuritegevuse ja muu kuritegevuse vastu võitlemise koostöökokkuleppe muutmise kokkulepe — RT II, 2007, 3, 10

Vabariigi Valitsuse 24.11.2006 korraldus nr 640 kokkuleppe muutmise kokkuleppe eelnõu heakkiitmise ja volituste andmise kohta Välisministeeriumi teadaanne välislepingu jõustumise kohta Eesti Vabariigi valitsuse ja Poola Vabariigi valitsuse vaheline organiseeritud kuritegevuse ja muu kuritegevuse vastu võitlemise koostöökokkulepe Mitteametlik tõlge Eesti Vabariigi Välisministeeriumil on au teatada, et on kätte saanud Poola Vabariigi Välisministeeriumi noodi nr DPT-II-2264-32-2006/jg/141 Eesti Vabariigi valitsuse ja Poola Vabariigi valitsuse vahelise organiseeritud kuritegevuse ja muu kuritegevuse vastu võitlemise koostöökokkuleppe, allkirjastatud 26. juunil 2003, muudatuste kohta, mis sisaldas järgmist: «Poola Vabariigi Välisministeerium avaldab oma lugupidamist Eesti Vabariigi Suursaatkonnale Varssavis ning tal on au Poola Vabariigi valitsuse nimel teha ettepanek Eesti Vabariigi valitsuse ja Poola Vabariigi valitsuse vahelise organiseeritud kuritegevuse ja muu kuritegevuse vastu võitlemise koostöökokkuleppe, allkirjastatud 26. juunil 2003, artikli 2 muutmiseks: – lõikele 1, Poola pädevate asutuste loetelule, kellel on õigus luua otsesidemeid ja sõlmida koostöökokkuleppe täitmiseks lisakokkuleppeid, lisatakse punkt «7) finantsteabe peainspektor», punkti 6 lõpus olev punkt asendatakse komaga; – pärast lõiget 1 lisatakse lõige 2 järgmises sõnastuses: «Pooled teavitavad teineteist diplomaatiliste kanalite kaudu lõikes 1 nimetatud asutuste pädevuse või nimede muutmisest.», senised lõiked 2 ja 3 loetakse lõigeteks 3 ja 4. Poola Vabariigi Välisministeerium teeb ettepaneku, et käesolevat nooti ja vastusnooti sellele noodile, millega Eesti Vabariigi valitsuse nimel kinnitatakse Eesti Vabariigi valitsuse nõusolekut eeltoodud ettepanekule, käsitatakse kui Poola Vabariigi valitsuse ja Eesti Vabariigi valitsuse vahelist kokkulepet, millega muudetakse Eesti Vabariigi valitsuse ja Poola Vabariigi valitsuse vahelise organiseeritud kuritegevuse ja muu kuritegevuse vastu võitlemise koostöökokkuleppe, allkirjastatud 26. juunil 2003, artiklit 2, mis jõustub vastusnoodi saamise kuupäeval.» Välisministeeriumil on au kinnitada, et ülalmainitud ettepanek on heaks kiidetud Eesti Vabariigi valitsuse poolt. See noot ja Teie noot moodustab kokkuleppe Poola Vabariigi valitsuse ja Eesti Vabariigi valitsuse vahel, mis jõustub alates selle noodi saamise kuupäevast. Tallinnas 30. novembril 2006. The Ministry of Foreign Affairs of the Republic of Estonia have the honour to acknowledge the receipt of the note of the Ministry of Foreign Affairs of the Republic of Poland no DPT-II-2264-32-2006/jg/141 concerning the amendment of the Agreement between the Government of the Republic of Estonia and the Government of the Republic of Poland on Co-operation in Combating Organized crime and other crime signed in Warsaw 26th of June 2003, which reads as follows: “The Ministry of Foreign Affairs of the Republic of Poland presents its compliments to the Embassy of the Republic of Estonia in Warsaw and has the honour to propose on behalf of the Government of the Republic of Poland in the article 2 of the Agreement between the Government of the Republic of Poland and the Government of the Republic of Estonia on Co-operation in Combating Organized Crime and Other Crime, signed in Warsaw on 26th of June 2003: – in paragraph 1 including the competent authorities in the Republic of Poland which shall have the right to establish direct contacts and to conclude additional arrangements for the implementation of the provisions of the Agreement: to add a new point “7) General Inspector of the Financial Information”, and after the present point 6 a semicolon shall be replaced by a comma; – after paragraph 1: to add a new paragraph 2 of the purview as follows: “The Contracting Parties shall notify each other by diplomatic channel of changes of competence or names of the authorities referred to in paragraph 1.”, at the same time hitherto existing paragraphs 2 and 3 will be designated as 3 and 4. The Ministry of Foreign Affairs of the Republic of Poland proposes that in case of consent of the Government of the Republic of Estonia given to the above, the present note and the answer to this note shall proclaim the Agreement between the Government of the Republic of Poland and the Government of the Republic of Estonia on supplementation of the article 2 of the Agreement between the Government of the Republic of Poland and the Government of the Republic of Estonia on Co-operation in Combating Organized Crime and Other Crime, drawn up in Warsaw on 26th of June 2003, which shall come into force in the day of receipt the note being an answer to the above.” The Ministry of Foreign Affairs of Estonia has the honour to confirm the consent with the abovementioned amendments of the Government of the Republic of Estonia and confirms that this Note and the Note of the Polish side in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of receipt of this Note.
