Ligebehandlingsnævnets afgørelse om national oprindelse - chikane - kommuner - afvisning

KEN#LOKDOK23 2024 9641 Valid

J.nr. 22-4500

Nævnet afviste derfor at behandle klagen.

Klager

”… In about two minutes, I am going to get a phone call on my cellphone from a government official from Denmark.

…

I am filming for posterity and to show the world the kind of policies that Denmark has put in place in regards to foreign people, like myself, regardless of the fact that my lady, my partner, she is Danish.

I have a son, who is Danish.

We are expecting a child in three months, a girl, who is going to be a Danish citizen.

The government will still call me to “they are obliged to call me and tell me about my rights to repatriation”, and I consider it a form of psychological harassment against foreigners.

Especially when I came to Denmark, they invited me to this country because of my literature, my work, which criticizes the dictatorship in my, you know, where I was born, and they know that I was not safe.

They didn’t even get me from my own country they got me from another country where I was also not safe, and they gave me sanctuary[…] of years later, due to some of these racist policies, that are well known in the world.

I am actually privileged to show this to the world, when this official is going to call me, any minute now.

…

My lady, I didn’t have to tell her about the, you know, these people are calling me about repatriation.

I mean, think about it, she is pregnant, she is doing her thesis, the final exam, imagine the pressure, imagine if I have to tell her: “And by the way honey, the government is saying ‘oh by the way, we have this wonderful repatriation package’” You want to separate me from my kids, or what?

You know, from my family, I mean.

I think it is a bit absurd, in the form of harassment.

But they’re doing this to probably a whole bunch of foreign people in this country, who are subjected to this form of psychological harassment.

Because I know about the Repatriation Act in Denmark, I’ve read it, I mean, they do this several times a year, they have to send me this information and talk.

But because of the Corona virus, you know, normally I would have to be in a physical meeting to hear this, and normally I’d always, you know, tear those papers literally, so.

…”

Sagsbehandler hos kommunen

“I am just calling you today.

Have you seen in your e-boks that you have, I have wrote, that we should talk now?

”

Klager

“Yes.

What exactly is the subject matter?

”

Sagsbehandler hos kommunen

“Yeah, yeah.

It’s something we should call out to inform all citizens about.

So it’s not specific to you.

”

Klager

“Okay, when you say “all citizens” does that also imply, for example, my partner, my Danish lady, she is a Danish-“

Sagsbehandler hos kommunen

“No, no, no, no.

Just one that has a, a, you know.

Øh, en sag i center for kontanthjælp.

So if you.

I-.

Yeah.

”

Klager

”What about my son, for example?

He is a Danish citizen, he is five years old, he is in kindergarten.

”

Sagsbehandler hos kommunen

“No, only.

Just you.

”

Klager

”So because-”

Sagsbehandler hos kommunen

”I’m calling you fordi-.

Because.

To inform you about a law that is called ‘repatriering’.

”

Klager

“Yes, Repatriation Act, I’ve read it countless of times, I am very familiar with it.

”

Sagsbehandler hos kommunen

“Yeah, and we should call right now and tell it again.

”

Klager

“How many times do you have to call me to let me know in a year about this law?

”

Sagsbehandler hos kommunen

“We have many times to every conversation, we should have.

So three months.

But from now, I tell you now, and now there goes two years before I should inform you again.

If you have a case in the Jobcenter.

”

Klager

”Okay but.

Can, can you explain to me, the.

I know that you’re doing your job, so you understand, and.

There are many laws in this country, right?

”

Sagsbehandler hos kommuen

“Yeah, I would tell you a little bit about it now.

”

Klager

“Okay, then you tell me.

”

Sagsbehandler hos kommunen

“Yeah, this means that you can get a financial support to travel back to your home country or your previous country of residence.

”

Klager

“But do you know how I came to Denmark?

”

Sagsbehandler hos kommunen

“No, no.

Because we don’t.

We don’t see the, you know, the case individually, we just should say this to all people because all people should have the-“

Klager

“When you say “all people”, you mean people with a foreign background?

”

Sagsbehandler hos kommunen

“No, people that don’t have dansk statsborgerskab”

Klager

“What does that mean in English?

”

Sagsbehandler hos kommunen

“No Danish… Øhm … What can you say?

”

Klager

“Citizenship?

”

Sagsbehandler hos kommunen

“Yeah, yes, yes.

Citizenship.

”

Klager

”Okay, so anyone who is not a Danish citizen, the government.

You.

The Danish government is obliged to call them and tell them;

here is the Repatriation Act, you can get money in order to get out of Denmark and repatriate back to where you came from.

”

Sagsbehandler hos kommunen

“Yeah.

”

Klager

“Okay.

”

Sagsbehandler hos kommunen

“And we, we.

We say it because some people are sitting out there and don’t know about the option, they have.

So if they’re somebody who don’t know they have the option.

”

Klager

”Yeah, but, but.

If you.

If you have been informing me.

I mean, I have been getting informed about this for several years, several times, months, you know-“

Sagsbehandler hos kommunen

“But the law says-“

Klager

“Yes?

The law says-”

Sagsbehandler hos kommunen

”Yeah, the law says I should do it right now, for example.

”

Klager

“Yes.

Because it is your job, of course.

”

Sagsbehandler hos kommunen

“Yeah, yeah.

So I have to do it.

And I also think it is.

You know.

Not nice to call people to say it, beacuse-”

Klager

”Because I just told you, my wife, in case you didn’t know, she’s pregnant, my lady, you know.

She is-“

Sagsbehandler hos kommunen

“Oh, congratulations.

”

Klager

”Thank you.

We already have a son, who is five years and is Danish.

We are going to have a daughter in about three months, who is a Danish citizen.

”

Sagsbehandler hos kommunen

“Yeah, okay.

”

Klager

“And both of them have never been to either, you know, my former country of residence or to [land], and I was invited here by the Danish state, this is in the newspapers.

They gave me sanctuary because freedom of speech, because of my writings, and then the government is calling me again to say “repatriate”.

I mean, repatriate, what, you want to separate me from my–.

I am not talking about you, when I say “you”, remember, I am not talking about you as an individual, I am talking about the state.

[…]

And I look at this as a form of the government saying we want to separate you A: from your family B: we want to send you back to a place, where you are politically threatened because of your political ideologies, because of my writings, because of my freedom of speech and expression, which they gave me.

”

Sagsbehandler hos kommunen

“You should not see it in this way – in that way.

”

Klager

“Yeah, but that is how I look at it.

”

Sagsbehandler hos kommunen

“Yeah, yeah, but is a, a, it’s a.

What can you say.

It’s an opportunity that you get, and you can say no or yes to it.

”

Klager

“I’ve already said no.

”

Sagsbehandler hos kommunen

“Yeah, yeah.

”

Klager

”I’ve said no very clearly to this, if you, if you, if you look at the previous record.

But I don’t see a reason why I have to-.

If I say no to you-.

Look, you are a woman, you are familiar in Denmark, there’s a new law out against rape, for example.

It is with consent, where they define rape as in, if there’s no consent, then it is a form of rape, right?

We are talking rape;

I am just using it as an example.

Now I do not consent, for example, to the government calling me, or sending people to call me, to tell me several times a year-.

I mean, I’m saying, I am a fairly intelligent person, I know about this law.

If I wanted to repatriate, I would do it myself, you know, or I would-.

I know where to get the help, but the fact that it is such a consistent pestering and it’s not consensual on my part, that is infringing on my freedom of choice, for example.

Because, it’s like, I’m not being given a choice to say “I don’t to want to have this talk, I already know about this law.

” For example, why doesn’t the government call me and tell me about my rights, for example, when the state is violating my rights, like in this case.

What should I do, for example, if I don’t consent to you calling me and telling me these things?

Is there a law that can protect me from being harassed by the state, for example?

I would like somebody to call me and tell me that.

”

Sagsbehandler hos kommunen

“I don’t understand this, but I understand that you said no to it, but I cannot do anything about that you in two years should have the same information.

”

Klager

“I, I understand, because it is a law in place, do you understand?

”

Sagsbehandler hos kommunen

“Yeah, yeah”

Klager

”In Germany, the Nazis had a law to take the Jews, send them into gas chambers.

Some of those Jews escaped, came through Denmark, and some good Danish citizens gave them safe passage, some of them were hiding them in Denmark out of their own individual conscience, because they realized we are breaking the law of the Germans, and all that, but we are saving and helping to save these people.

But some officials, when they caught these people, they sent them back to the gas chambers.

I am just making an extreme example, to say-.

”

Sagsbehandler hos kommunen

“Yeah, yeah.

”

Klager

“There were officials in the German state who refused to carry out the orders of the government, when you can see these orders are violating these people’s, you know, psychological health, these people’s-.

Because, how do you think-.

I just told you;

I am having a baby in three months, I have a son who is five years old, I have my lady-“

Sagsbehandler hos kommunen

“We are not-“

Klager

”Yes?

”

Sagsbehandler hos kommunen

”We are not looking at individual cases, we are-“

Klager

“You, you, you don’t look at an individual, it’s designed that way, but.

Do you understand?

I have to look at my case as, as it is.

You don’t look at my case as my reality.

”

Sagsbehandler hos kommunen

“I under- I understand that, and the only thing you should say right now is ‘no I don’t want to take that, you know, opportunity.

’”

Klager

“Yes, you know-.

That one I have already stated, countless times.

What I would actually like to say is ‘no, I don’t want to receive these phone calls or these e-mails.

’”

Sagsbehandler hos kommunen

“No you-.

But you can’t do that because you are getting kontanthjælp and there is rules, you have to, when you get some pay from us, you know, you get money from us, and then we have some rules.

So, so it’s like, when every-.

”

Klager

“So is it about money then?

Let me understand this.

”

Sagsbehandler hos kommunen

“No.

No, no, it’s like-”

Klager

“It’s like, we give you money so we can harass you, because you have-“

Sagsbehandler hos kommunen

“No, no, no, no, no, we have to do, if, like-.

When I’m in-.

If, if, if I get some, you know, should take, have money from the, the, the, you know.

The state-.

”

Klager

”For example, right now I’m doing an internship, right, and the reason I was having work, and that work was paying me, I was working at a factory, but because I had a motorcycle accident, and I have a knee problem, which the doctor has actually confirmed.

I believe the doctor has actually sent this information to the, to, to you guys.

Now, I have been doing an internship in an institution, which is, is a church, I am helping them doing some work, whatever.

Now, this is not really because of my fault, that, you know, I have got this knee problem, for example.

So, now you are telling me because I am on this program, where the government is paying my salary to do this work at this church, where I am currently doing an internship.

You are saying to me, because the government is sending some money in this program, in this way, I am now under obliged to have to be harassed by these kinds of messages.

”

Sagsbehandler hos kommunen

“No, look.

No, no, no.

We have some things I should call and tell you.

Also if, when, when I, when, when you get a, what can you call it.

I, I say to you, you should come to a conversation to me, for example, it is also some rules we have in center for kontanthjælp, who all citizens there are getting kontanthjælp-“

Klager

“But, what I’m, what I’m saying is, those are the rules, but this is an inhumane rule, and I think that anyone with an ounce of decency in, in them, whether they are Danish or not Danish can see how ridiculous, or the form of psychological harassment this is to some people.

”

Sagsbehandler hos kommunen

“And it’s also okay that you think that, but I cannot say, for example, ‘[klager], I am not calling him’, I should call you.

”

Klager

“Yeah, because you have to do your job right?

”

Sagsbehandler hos kommunen

“Mmhmm.

”

Klager

“You, you have a contract-.

You have a contract with the government, and the government tells you ‘here is your contract;

you have to call these foreigners under this program, and tell them this several times a year’, or whatever.

I think that is a form of harassment, for instance.

”

Sagsbehandler hos kommunen

“Mmhmm, yeah, and I’m sad that you see it like this way, but I would only, information about it.

I wrote right here that you are not taking the offer and that you are, øhm.

”

Klager

“Yeah, but I, I, actually.

I am not taking the offer, I have never taken the offer, I will never take that offer, so never, so, you know.

And here’s another thing I would like to say on record, I would like to say.

I am a fairly-.

I think-.

I understand this law, I’ve been told about so many times, there is no need for them to keep reminding me about it, as if to say ‘hey, you are forgetting, you can also repatriate’, I already told you, it is never going to happen.

So, I don’t want to be harassed, because when you are, when you continually telling me something and I am saying ‘I don’t want to hear about it’, is that not a form of harassment, then?

”

Sagsbehandler hos kommunen

“I mean-“

Klager

”I talk about consent, because-.

Because I don’t give my consent to the government to keep harassing me, because I already have this information.

I don’t see why I have to be given this-.

”

Sagsbehandler hos kommunen

“It is the same if every, to every meeting we have, I should inform you about the sanktions rule, for example, the sanctions rules, and if you think that’s, you don’t want to listen to it, I can’t, I that, I can’t say ‘okay, then I don’t tell you about it-‘.

”

Klager

“Yeah, but, but, but I don’t think it is the same, because this is a law-“

Sagsbehandler hos kommunen

“But somebody think that is also annoying-“

Klager

“Look, the sanctions rules, whether you are Danish or not Danish, those are going to everyone, but these ones are specifically targeting a group, who have a foreign background, that’s what I’m saying.

Are you calling a Danish citizen right now, and saying ‘we can repatriate you or send you to Somalia or to East Europe or whatever’.

You are not calling Danish citizens you are calling people who are not -.

”

Sagsbehandler hos kommunen

“No, no, no, no.

You should see the repatrieringslaw is actually a very big help for some people who want to get home, and these people are ‘ooh, I have never heard about that’, ‘oh, I want to do that’, ‘I want to go home, I can get the money I want’.

”

Klager

“Wow, fantastic isn’t it.

”

Sagsbehandler hos kommunen

”Yeah, yeah, but that is fantastic for some people.

”

Klager

“Yes, but I am not those people.

”

Sagsbehandler hos kommunen

“You can never-, you can never get pushed to it, you can never get pushed to it.

”

Klager

“Yeah, but what I’m saying is, I understand the law, and, and, I’m sure.

I understand many laws in this country.

”

Sagsbehandler hos kommunen

“[Klager], now-”

Klager

“All I’m saying it’s a reminder-“

Sagsbehandler hos kommunen

“[Klager] now, now I say it to you, to all the, all the people I have called to, I have heard two minutes of talking, and they have just said no, and no other things we have talked about, just that.

”

[…]

Klager

“[…] I don’t consent to have these phone calls or these e-mail, I see them as a form of harassment when the state, the state of Denmark knows my, they are the ones who invited me here.

I never got into a boat or a dinghy to come to Denmark;

they said ‘your freedom of speech, your writings, your books go and do your work’, right.

[…] And then now, I have a family, I have a kid coming in three months, I’ve got a five-year-old, and the state is saying ‘by the way, you can repatriate’, do you understand, it is absurd for me, to have that-.

”

Sagsbehandler hos kommunen

“I understand that, [klager], but it is a volunteer, you can say no and you can say yes.

”

Klager

“I already-.

Remember, I’ve said no countless times but what I am saying no to, is the government having to knock on my e-mail or call me, or want to have the-.

Because I don’t want to-.

I’ve said no, and that is final, whether it is five years from now, ten years from now, twenty, thirty, it is still no.

Do you understand what I mean.

I don’t understand why they need to send me this information every now and then when I already have the information, you know.

I can print stacks of this information that the government has been sending me, and it would be like a, like-.

Why do you keep sending me the same infor-.

It is a waste of you time, for example, you could be doing actually much more productive work for the government right now, than having this conversation.

So, I look at it and say, the reason they are compelling you, because you have a contract, so I am not against you personally, I am just saying, I feel this is a form of the government harassing its people.

People, like myself, with a foreign background.

Do you understand?

”

Sagsbehandler hos kommunen

“Yeah, and I’m, I’m sad that you see it that way because, the, the, the only thing I wanted to, was to tell you and inform you about it because it is the law, and I have to do it- ”

Klager

“Yes, as I say the Nazis-“

Sagsbehandler

“It is my job.

”

Klager

“And the Nazis.

People who worked for the Nazis also some of them had to do their jobs and send people to the gas chambers, and those people didn’t want to be sent there.

So I’m just saying I came here for political reasons-.

”

Sagsbehandler hos kommunen

“Yeah, I think we have to stop here when you said the Nazis, ok?

”

Klager

“Look, I am simply saying, I came here, it’s well known, do you understand?

And I find it absurd.

How would you think I should explain this to my five-year-old?

Oh, by the way, the government is sending me this repatriation offer, you know.

I couldn’t even tell my lady today because she is writing an exam, she is pregnant, I was like, I can’t tell her that I am going to have this conversation.

”

Sagsbehandler hos kommunen

“[Klager] I think we stop the conversation right now.

”

Klager

“Okay, fine.

”

Sagsbehandler hos kommunen

“Okay, because I think right now you are taking me into something that’s much bigger than what I have to do as my job.

”

Klager

“That’s, that’s the problem, because you are saying the government is sending you to do this part of your job, but this is my life, do you understand.

And my life is bigger than your job, for example.

My reality is bigger than your job.

I don’t know the other people, maybe they are afraid to talk back to authority.

I am not afraid of the government, these are mere people, who are elected into office and they can be removed from office.

Laws can be made, it can be changed and remade, and this is one law that I think is a form of harassment against people with a foreign background, it is racist.

”

Sagsbehandler hos kommunen

“Mmmhmm, and I understand that right now.

I write that you don’t want to take the offer, and that it-”

Klager

“I don’t want to be contacted, if you could understand that.

”

Sagsbehandler hos kommunen

“Yeah, yeah-“

Klager

”I don’t want to be contacted about this, if you could put that in the file, and say I look at it as a form of harassment, like for example the next time they are gonna contact me I might have to go to the cops and say ‘look, I have told these people that-“

Sagsbehandler hos kommunen

“There is two years to-“

Klager

“It doesn’t matter whether it is two years or ten days.

I know this information, thank you very much.

We have so many laws in Denmark, that they don’t come to me every month, or every six months, or every two years to tell me about that law, there are so many laws in this country, but I am a law-abiding citizen, I have never broken-“

Sagsbehandler hos kommunen

“There is a law, when you are on kontanthjælp, there is some rules and law, we have to-“

Klager

“But some of those-.

Are you telling me that all the laws in Denmark and all the rules in Denmark are not racist?

”

Sagsbehandler hos kommunen

“… What?

I cannot.

This, this conversation I cannot have, [klager].

”

Klager

“Yes, I understand-“

Sagsbehandler hos kommunen

“You are saying racist and Nazi-“

Klager

“There are laws in this country-“

Sagsbehandler hos kommunen

“I have to stop you right now and say thank you for the conversation, okay.

”

Klager

“Well, thank you […]”

…

Sagsbehandler hos kommunen

“Okay, but [klager], [klager].

We have nothing against each other?

”

Klager

“No, no, no, no.

Remember I, you are-.

This is not personal I am talking to the government.

”

Sagsbehandler hos kommunen

“Okay.

”

Klager

“Not to you as a person.

I am sure you as a person, I would probably have coffee with you, no problem.

I am just talking to the state, and saying this is racism.

”

…

Nævnet afviser derfor at behandle klagen.
