Dear Director General,
Hr.
generaldirektør,
I have the honour to refer to the following
Recalling that the Kingdom of Denmark and the International Organization for Migration (IOM) signed the ‘Agreement between the Government of the Kingdom of Denmark and the International Organization for Migration on the Legal Status, Privileges and Immunities of the Organization in Denmark’ on 13 July 2006;
Considering that on 19 September 2016, IOM and the United Nations signed a relationship agreement, approved by the General Assembly in Resolution 70/296, and by the IOM Council in Resolution No.
1317, and that IOM is thereby a related organization of the United Nations;
Acknowledging that on 22 September 2022, Denmark and the United Nations signed the ‘Agreement between the United Nations and the Kingdom of Denmark concerning the Status of the Offices of the United Nations in the Kingdom of Denmark’ (the “Agreement”), as well as supplementary agreements pursuant to Article 26 of the Agreement, including the ‘Exchange of Letters on Immunity of Danish Nationals’, the ‘Exchange of Letters on EU Law’ and the ‘Exchange of Letters on Transitional Arrangements’ relating to the Agreement (collectively, the “underlying legal documents”, including the guidance document ‘Supplementary Paper on Operational Guidelines’), to ensure that the various entities of the United Nations in Denmark are operating under the same legal framework;
I have further the honour to propose that the Kingdom of Denmark and the International Organization for Migration agree as follows
The Agreement and the underlying legal documents between Denmark and the United Nations shall apply mutatis mutandis to IOM in Denmark, subject to the present Exchange of Letters, in accordance with Article 28 (6) of the Agreement stating that the ‘Agreement shall apply to other Offices, including Specialized Agencies and related organizations of the United Nations system, that have concluded an exchange of letters with Denmark applying the Agreement mutatis mutandis to such entity, and terminating any relevant existing host country agreement between Denmark and such entity, which shall enter into force as at the date of signature of the relevant exchange of letters’.
The International Organization for Migration, as well as the Director General and the Deputy Directors General of IOM, and the staff of the Organization, shall continue to enjoy in the Kingdom of Denmark, the same privileges and immunities as those granted to specialized agencies of the United Nations and as those granted to executive heads and to the staff of the Organization in Denmark respectively by virtue of the Convention on the Privileges and Immunities of the Specialized Agencies adopted by the General Assembly on 21 November 1947, to which Denmark acceded on 25 January 1950, without reservation.
With respect to Article 21 of the Agreement, the Director General of IOM has the right and the duty to waive the immunity of any of the persons referred to in Articles 11 to 16 of the Agreement in any case where, in his or her opinion, such immunity impedes the course of justice and can be waived without prejudice to the interests of IOM.
If the International Organization for Migration agrees to this proposal, I propose that this letter and a letter of confirmation in response from the IOM shall constitute an agreement between the IOM and the Kingdom of Denmark pursuant to Article 28 of the Agreement, which shall enter into force on the date of signature of your response to this letter, and that on the same date, the Agreement on the Legal Status, Privileges and Immunities of the Organization in Denmark signed on 13 July 2006 will be terminated.
Please accept, Excellency, the assurances of my highest consideration.
Modtag venligst, hr.
generaldirektør, forsikringen om min mest udmærkede højagtelse
