No Visa with Limited Territorial Validity (VLTV) can be issued without authorization from the Icelandic authorities.

However, this does not apply if the limitation is solely due to the fact that not all Schengen Member States recognize the travel document, unless it is the represented country that does not recognize the travel document.

The representing country is authorized to affix visas to all travel documents recognized by Icelandic authorities.

3.

Supporting documents for the visa application must be translated, if necessary, into one of the working languages used by the issuing mission.

The visa applicant will cover the costs of the translation.

3.

In the event of questions, in particular related to the inviting party or sponsor , the mission of the representing country may contact the Icelandic authorities requesting further investigation.

Contact points are listed in Annex C.

For nationalities for which consultation is required, the consultation will be carried out by the representing country.

The Foreign mission, in line with the general practice of the Foreign Mission and on equal terms with the Mission’s other visa applicants will consider if the applicant is eligible for a facilitated procedure.

Facilitation may relate to the provision of easy access for submission of applications, the duration of a visa, leniency concerning supporting documents (in accordance with the approved lists in the framework of the Local Schengen co-operation) and the granting of a multiple entry visa with a period of validity ranging from six months to five years.

The representing country may work with an External Service Provider (ESP) at one or more locations, in accordance with and under the conditions stipulated by Visa Code Article 8 (9).

The representing country will inform the represented country in case of planned cooperation with an external service provider where representation agreements are affected.

4.

Statistics

4.

Statistik

The representing country will, upon request, inform the represented country of the number of visas that have been applied for, issued or refused.

5.

Fees

5.

Gebyr

Visa fees are charged in accordance with the Schengen Acquis.

The representing country is entitled to all fees.

At locations where the number of visa applications to Iceland exceeds 1.500 and the Danish missions incur costs not covered by the fixed visa fee, Iceland will compensate Denmark accordingly.

A special arrangement about such compensation is formalised in the form of an annex to this agreement, titled “Annex B Compensation for additional cost.

” The annex shall form an integral part of this agreement.

6.

Amendments and termination

6.

Ændringer og ophør

This agreement can be amended or terminated with the exchange of notes.

This will be done in close cooperation between the two parties.

The termination of this agreement, whereas Denmark cancels the entire agreement or cancels representation simultaneously in more than 7 locations, comes into effect 24 months from the date of receipt of the verbal note notifying Iceland of the termination.

Should successive partial terminations of this agreement within any 12 month period amount to a termination of representation in more than 7 locations, the verbal note triggering the 7 location limit, will come into effect 24 months from the date of receipt of the verbal note.

The termination of up to 7 locations in any 12 month period of this agreement by Denmark comes into effect 90 days from the date of receipt of the verbal note(s) notifying Iceland of the termination.

The termination of this agreement or parts of this agreement by Iceland shall be notified to the Ministry of Foreign Affairs of Denmark according to the following

i) at least six months prior to termination concerning representations with less than 800 applications for Iceland per year, unless both parties have explicitly agreed on a shorter period.

ii) at least one year prior to termination concerning representations with more than 800 applications for Iceland per year, unless both parties have explicitly agreed on a shorter period.

In case of special circumstances or resource constraints, Denmark may limit the number of applications accepted per day at any representation.

The limitation must be notified to the Ministry for Foreign Affairs of Iceland at least 30 days before the limitation is applied.

In such cases the parties will jointly seek to identify solutions to assure the best possible conditions for the reception of visa applications in accordance with this agreement.

7.

Final clauses

7.

Afsluttende bestemmelser

Further practical conditions of implementation of this agreement may be added in annexes to this agreement, if the parties agree on special terms e.g.

maximum number of applications to be handle by Denmark in specific locations.

This agreement enters provisionally into force with effect from the date of signature, except for Article 5 and Annex B which enter provisionally into force at the date of signature with effect from 1 January 2018.

This agreement shall be approved in accordance with the legal procedures of each of the Contracting States and shall enter finally into force on the thirtieth day after the date of exchange of diplomatic notes indicating such approval.

This agreement replaces all previous representation agreements between the Republic of Iceland and the Kingdom of Denmark.

IN WITNESS WHEREOF, the undersigned, being duly authorized thereto, have signed the present Agreement.

Processing of residence permits (D-visa)

Behandling af opholdstilladelser (D-visum)

Processing of applications for a residence permit (D-visa applications) to Iceland are only applicable to applicants with permanent stay in the country of the representing mission.

The Icelandic Directorate of Immigration (DoI) receives, processes, and makes decisions on all applications for a residence permit in Iceland (D-visa applications).

Applicants for a residence permit must send their applications directly to the DoI in Iceland, according to the procedure available on their website.

Given that the DoI approves the application, the DoI is responsible for informing the applicant of the decision.

An e-mail including a copy of the passport of the applicant is sent to the Danish diplomatic mission, giving a permission for the issuance of a D-visa.

The applicant will contact VFS and make an appointment to deposit his/her passport, including documentation of grant of residence permit from DoI and a passport size photo.

VFS will obtain biometrics (photo only) and will transfer the case to the mission for finalisation/issuance of the D-visa.

The applicant will make a payment to the mission for this service using the webshop as well as a service fee to VFS.

We kindly ask the Danish mission to check the applicant’s ID against the original passport, the passport copy received from DoI and the photo taken at VFS.

Compensation for additional cost

Godtgørelse for meromkostninger

At the signing of the Representation Agreement between the Republic of Iceland and the Kingdom of Denmark, the contracting parties have, in accordance with article five of the agreement, agreed upon the following provisions, which shall form an integral part of the agreement.

1.

Compensation for additional cost

1.

Godtgørelse for meromkostninger

At locations where the number of visa applications to Iceland exceeds 1.500 and the Danish missions incur costs not covered by the fixed visa fee, Iceland will compensate Denmark accordingly.

1.500 out of the total number of visa applications at each location will not be subject to compensation.

Compensation will be retroactive and calculated annually based on fee income, number of visa applications and costs for the previous year.

The compensation level is based on the average net cost pr. visa application at locations where the number of visa applications to Iceland exceeds 1.500.

The net cost is the difference between the cost of handling applications to Iceland and income from the fixed fee.

The cost of handling is based on direct and indirect costs in relation to visa applications to Iceland, including rent of locations, salaries, IT and central overhead.

The average net cost is calculated as the difference between costs and fee income divided by the number of applications.

The average net cost pr. visa application will be multiplied by the number of visa applications to Iceland minus 1.500 to calculate the total compensation level for a given year.

The average net cost pr. visa application is calculated annually based on actual cost for a given year.

2.

Annual payment

2.

Årlig betaling

Payment will be on an annual basis.

The Ministry of Foreign Affairs of Denmark will forward an invoice, based on the calculation method in article one of this annex, to the Ministry for Foreign Affairs of Iceland in May regarding the payment of compensation for the previous year.

As an example, the compensation for 2018 is based on the average net cost of DKK 21,2 per visa application.

IN WITNESS WHEREOF the undersigned, being duly authorised thereto by their respective Governments, have signed this Annex.
