I tilslutning til Udenrigsministeriets bekendtgørelse nr. 110 af 20. oktober 1994, Lovtidende C, meddeles det, at Danmark den 19. december 2006 har godkendt de i Esbjerg den 22. august 2003 vedtagne ændringer i aftalen af 17. marts 1992 om beskyttelse af små hvaler i Østersøen og Nordsøen.

Ændringerne har følgende ordlyd

Extension of the ASCOBANS Agreement Area

Udvidelse af ASCOBANS aftalens område

Noting that the range of a number of populations of species covered by ASCOBANS is known or assumed to comprise waters to the west and south-west of the current Agreement Area;

Bemærker at udbredelsen af visse bestande af arter omfattet af ASCOBANS vides eller antages at inkludere farvandene vest og sydvest for det nuværende område omfattet af aftalen.

Noting that the Agreement Areas of ASCOBANS and the Agreement on the Conservation of Cetaceans in the Black Sea, Mediterranean Sea and Contiguous Atlantic Area (ACCOBAMS) are currently not contiguous;

Bemærker at området omfattet af ASCOBANS og området omfattet af aftalen om beskyttelse af hvaler i Sortehavet, Middelhavet og det tilstødende atlantiske område (ACCOBAMS) på nuværende tidspunkt ikke støder op til hinanden.

Recalling that the Advisory Committee to ASCOBANS has repeatedly recommended the extension of the Agreement Area to the west and south-west of the current Agreement Area;

Erindrer at den rådgivende komité i ASCOBANS gentagne gange har anbefalet en udvidelse af aftalens område vest og sydvest for det nuværende aftaleområde.

Recognizing that the conservation of small cetaceans in the current ASCOBANS Agreement Area and in European wa⁠ters as a whole would benefit from the extension of the ASCOBANS Agreement Area to parts of the North Eastern Atlantic and from the establishment of a direct geographical link between the Agreement Areas of ASCOBANS and ACCOBAMS;

Erkender at beskyttelsen af små hvaler i det nuværende ASCOBANS aftaleområde og i europæisk farvand som et hele vil nyde gavn af en udvidelse af ASCOBANS aftaleområdet til at omfatte dele af Nordøstatlanten og af etableringen af en direkte geografisk forbindelse mellem aftaleområderne for ASCOBANS og ACCOBAMS.

Guided by a common will to further strengthen the Agreement;

2. Add a new subparagraph 6.5.4 to Article 6.5 reading as follows

"Any State that becomes a Party to the Agreement after the entry into force of an Amendment shall, failing an expression of a different intention by that State

”Enhver stat, der bliver part i aftalen efter ikrafttrædelsen af en ændring, skal, hvis ikke andet er udtrykt af staten

a) be considered as a Party to the Agreement as amended; and

a) betragtes som part i den ændrede aftale; og

b) be considered as a Party to the unamended Agreement in relation to any Party not bound by the Amendment."

3. Change the name of the Agreement to

Agreement on the Conservation of Small Cetaceans of the Baltic, North East Atlantic , Irish and North Seas .

4. Calls on the Executive Secretary to ASCOBANS, Parties to the Agreement and the Secretariat of the Convention of Migratory Species of Wild Animals to encourage non-Party Range States to accede to the Agreement;

4. Anmode ASCOBANS´s eksekutivsekretær, parterne i aftalen og sekretariatet for konventionen om migrerende arter af vilde dyr om at opfordre ikke-medlemslande i aftalens område til at tiltræde aftalen;

5. Requests Parties ratify the amendment contain in this resolution as soon as possible.

5. Anmode parterne om at ratificere ændringerne nævnt i denne resolution snarest muligt.

Danmarks godkendelsesinstrument deponeredes hos De Forenede Nationers generalsekretær den 19. december 2006. Ændringerne trådte i medfør af aftalens artikel 6.5.3 i kraft den 3. februar 2008.
