Art. 48 : Justizvollzugsverordnung (JVV)

Art. 48

1 Das Amt bietet die verurteilte Person, welche die Voraus-e. Offener und

setzungen für den Vollzug in einer besonderen Vollzugsform nicht er- geschlossener

füllt oder von dieser Vollzugsform keinen Gebrauch macht, zum offe- Vollzug

nen oder geschlossenen Vollzug der Freiheitsstrafe auf.26

2 Das Amt legt den Strafantrittstermin so fest, dass der verurteilten

Person eine angemessene Zeit für die erforderliche Regelung beruf-

licher und privater Angelegenheiten verbleibt.

3 Es kann auf Gesuch der verurteilten Person den Strafantritt auf

einen späteren Termin verschieben, wenn dadurch

a. erhebliche Gesundheitsrisiken oder andere erhebliche, nicht wieder

gutzumachende Nachteile vermieden werden und

b. weder der Vollzug der Strafe infrage gestellt noch erhöhte Risiken

für Dritte entstehen.

4 Das Gesuch um Verschiebung des Strafantrittstermins ist zu be-

gründen, Beweismittel sind genau zu bezeichnen und soweit möglich

vorzulegen. Das Gesuch ist sofort nach Kenntnis des Verschiebungs-

grundes zu stellen.19
