Art. 164

1 Nach Abklärung des Sachverhalts wird der inhaftierten

Person Gelegenheit zur Stellungnahme gegeben. Sachverhalt und Stel-

lungnahme sind schriftlich festzuhalten.

2 Der Disziplinarentscheid erfolgt aufgrund einer umfassenden Wür-

digung, insbesondere der objektiven Schwere des Disziplinarvergehens,

des bisherigen Verhaltens im Vollzug und der Beweggründe. Die Mass-

nahme soll zum begangenen Disziplinarvergehen in Beziehung stehen

und geeignet sein, künftige Verstösse gegen die Anstaltsdisziplin zu ver-

hindern.

3 Der Disziplinarentscheid wird mit kurzer Begründung und Rechts-

mittelbelehrung schriftlich mitgeteilt und der inhaftierten Person in einer

verständlichen Sprache erläutert. Bei zeitlicher Dringlichkeit wird der

Entscheid mündlich eröffnet und sobald als möglich schriftlich bestä-

tigt.

4 Mit Ausnahme von leichten Fällen im Sinne von § 23 b Abs. 4

StJVG5 wird die einweisende Behörde über Disziplinarvergehen benach-

richtigt.20
