Art. 38 : Verordnung über die Betreibungs und Gemeindeammannämter (VBG)

Art. 38

1 Erfolgt infolge Wahl oder Ernennung einer neuen Betrei- Amtsübergabe

bungsbeamtin oder eines Betreibungsbeamten ein Wechsel in der a. Organisation

Amtsleitung, findet unter der Leitung des Betreibungsinspektorats die

Übergabe des Amtes an die neue Beamtin oder den neuen Beamten

statt.

2 Das Betreibungsinspektorat legt in Absprache mit der bisherigen

und der neuen Amtsleitung, dem Bezirksgericht und der Gemeinde

das Datum und den Zeitpunkt der Übergabe fest und lädt die Beteilig-

ten zur Amtsübergabe ein.

3 Das Betreibungsinspektorat

a. führt vor der Amtsübergabe eine Inspektion durch,

b. erstellt nach durchgeführter Inspektion

1. das Verzeichnis der zu übergebenden Register und Akten,

2. das Verzeichnis der zu übergebenden Amtsgeschäfte,

3. das Protokoll für die Amtsübergabe,

c. ist für die Erledigung der weiteren für die Vorbereitung und den

Vollzug der Amtsübergabe erforderlichen Aufgaben besorgt.
