Art. 89 : Gesetz über die Gerichts und Behördenorganisation im Zivil und Strafprozess (GOG)
Art. 89
1 Die Verfolgung und Beurteilung von Übertretungen steht Zuständige
den Statthalterämtern zu.
2 Der Regierungsrat kann die Verfolgung und Beurteilung von
Übertretungen auf Gesuch hin einer Gemeinde übertragen, wenn
diese sicherstellt, dass sie dazu fachlich und organisatorisch in der Lage
ist. Vorbehalten bleiben besondere gesetzliche Regelungen, welche die
ausschliessliche Zuständigkeit der Statthalterämter vorsehen.
3 Die Strafbefugnis der Gemeinde beträgt höchstens Fr. 500 Busse.
Die anzuordnende Ersatzfreiheitsstrafe darf zehn Tage nicht überstei-
gen.58
