Art. 83

1 Die Aufsichtsbeschwerde ist innert zehn Tagen seit Kennt- Verfahren

nisnahme der Amtspflichtverletzung schriftlich einzureichen. Sie hat

einen Antrag und eine Begründung zu enthalten.

2 Die Aufsichtsbehörde stellt die Aufsichtsbeschwerde, wenn sie

sich nicht sofort als unbegründet erweist, den Betroffenen zur schrift-

lichen Vernehmlassung und weiteren beteiligten Personen zur schrift-

lichen Beantwortung zu.

3 Die Aufsichtsbehörde untersucht den Sachverhalt von Amtes

wegen. Die Vorschriften der Zivilprozessordnung, insbesondere über

das Beweisverfahren, sind sinngemäss anwendbar.
