1. Si des prestations d'aide immédiate, d'aide à plus long terme, des indemnités ou des réparations morales sont accordées par l'Etat en vertu de la LAVI, celui-ci est subrogé dans les prétentions de même nature que l'ayant droit peut faire valoir envers l'auteur de l'infraction ou un tiers.
