1. Sous réserve du droit fédéral, la collectivité tenue au financement exige de l'assisté le remboursement de ses prestations
a) si la situation économique de ce dernier, ayant permis l'octroi de l'assistance judiciaire, s'est améliorée, notamment lorsqu'il acquiert des moyens suffisants à l'issue de la procédure;
b) si l'assistance judiciaire lui a été accordée à tort.
2. L'action en restitution se prescrit par dix ans dès l'entrée en force de la décision mettant fin à la cause.
