Art. 27 LTar · critères de détermination

1. Les honoraires sont fixés entre un minimum et un maximum prévus par le présent chapitre, d'après la nature et l'importance de la cause, ses difficultés, l'ampleur du travail, le temps utilement consacré par le conseil juridique, et la situation financière de la partie.

2. Les honoraires sont, en règle générale, proportionnels à la valeur litigieuse.

3. Lorsque la valeur litigieuse ne peut être chiffrée, les honoraires sont fixés d'après les éléments d'appréciation mentionnés à l'alinéa 1.

4. L'autorité fixe les honoraires en chiffres ronds en se conformant, pour le surplus, aux dispositions spéciales des diverses lois de procédure.

5. Les dépens s'entendent TVA comprise. Si le taux de TVA existant au moment de l'entrée en vigueur de la présente loi est modifié, le Conseil d'Etat procède par voie réglementaire à l'adaptation des honoraires prévus dans la présente loi.
