Art. 4 RES · Autorisation d'exploiter
1. L'autorisation d'exploiter est accordée à une personne physique ou morale qui remplit les conditions cumulatives de l'article 147, alinéa 1 LSP [C] .
2. Dans le cas où un établissement est exploité en raison individuelle, l'autorisation est attribuée nommément à la personne exploitante.
3. Si le titulaire de l'autorisation d'exploiter est une personne morale, son conseil de fondation, son comité ou son conseil d'administration assument les responsabilités fixées par le droit fédéral.
