Art. 81 LATC · Constructions hors des zones à bâtir

1. Pour tous les projets de construction ou de changement de l'affectation d'une construction ou d'une installation existante situés hors de la zone à bâtir, le département décide si ceux-ci sont conformes à l'affectation de la zone ou si une dérogation peut être accordée. Cette décision ne préjuge pas de celle des autorités communales.

2. Lorsque la construction ou l'installation est conforme à l'affectation de la zone ou imposée par sa destination, cette autorisation est accordée à condition qu'aucun intérêt public prépondérant ne s'y oppose et que le terrain soit équipé.

3. Les conditions fixées dans cette autorisation spéciale sont incluses dans l'autorisation communale. Le département peut subordonner l'autorisation de construire à l'inscription d'une charge foncière ou d'une mention au registre foncier pour assurer le maintien et la destination du bâtiment ; la mention peut porter en particulier sur l'interdiction de morceler la parcelle concernée par l'autorisation.

4. Le département peut autoriser l'utilisation de bâtiments d'habitation agricoles conservés dans leur substance à des fins d'habitation sans rapport avec l'agriculture. Un agrandissement de la partie habitable peut être admis aux conditions fixées par le droit fédéral.

5. Le département en charge de l'application de la législation sur l'agriculture donne son préavis sur les projets de constructions et d'installations liées à des exploitations agricoles situées hors de la zone à bâtir. Il peut confier tout ou partie de l'examen nécessaire à l'élaboration du préavis à un professionnel qualifié.
