Art. 3 CRF · Caractère dispositif

1. Il peut être renoncé conventionnellement aux droits des articles 40, 41, 57 à 59, 61, 63, 64 et 71 du présent code.

2. Cette renonciation ne lie pas d'autres ayants droit.

3. Pour être opposable aux tiers, cette renonciation doit être inscrite au registre foncier. Elle est passée en la forme authentique devant notaire; la forme écrite suffit toutefois s'agissant des droits prévus aux articles 63 et 64.
