Art. 10 LPR

[17] 1 Se con il ricorso viene chiesto l’effetto sospensivo, l’organo di esecuzione e fallimento trasmette immediatamente all’autorità di vigilanza il ricorso con l’incarto completo e il suo preavviso sull’effetto sospensivo.

2 Deciso sull’effetto sospensivo con ordinanza presidenziale, l’autorità di vigilanza retrocede l’incarto all’organo di esecuzione e fallimento per l’istruttoria preliminare.

3 È in facoltà del presidente dell’autorità di vigilanza concedere l’effetto sospensivo anche se non richiesto.
