§ 37 PBV · Zusammenbau
1. Bei halboffener und geschlossener Bauweise ist jeder Eigentümer berechtigt, eine Scheidmauer so zu erstellen, dass Mauermitte und Grenze zusammenfallen.
2. Die Mauer ist als Brandmauer auszugestalten und hat den Anforderungen über den Schallschutz nach Art. 32 der Lärmschutz-Verordnung (LSV) zu genügen.
3. Der Miteigentümer einer gemeinsamen Mauer ist berechtigt, diese in ihrer ganzen Stärke zu unterfangen oder zu erhöhen, sofern dies für die Baute des Nachbarn ohne Gefahr oder Schaden möglich ist
4. Über die Art der Benutzung der Scheidmauer und den Einkauf entscheidet im Streitfall die zuständige Gemeindebehörde.
