Art. 80 VRP · Massgebliche Vorschriften

1. Die Klage vor dem Verwaltungsgericht richtet sich sachgemäss nach den Vorschriften über die Beschwerde.

2. Richtet sich der Anspruch gegen ein Gemeinwesen, so kann die Klage erst erhoben werden, wenn die oberste in der Sache zuständige Verwaltungsbehörde des Gemeinwesens den Anspruch abgelehnt hat. Bei Klagen auf Gestaltung des Arbeitsvertrags treten an die Stelle der obersten Verwaltungsbehörde die Aufsichtsbehörden nach Art. 43 des Gerichtsgesetzes vom 2. April 1987 und Art. 22 des Einführungsgesetzes zur Schweizerischen Straf- und Jugendstrafprozessordnung vom 3. August 2010.
