III. Folgen enteignungsähnlicher Eigentumsbeschränkungen
Art. 53 EntG · Verfahren
1. Die Schätzungskommission entscheidet auf Antrag eines Beteiligten, ob eine Eigentumsbeschränkung einer Enteignung gleichkommt und setzt gleichzeitig die Entschädigung fest.
2. Sie kann auf Antrag eines Beteiligten den Entscheid auf die Frage beschränken, ob die Eigentumsbeschränkung einer Enteignung gleichkommt.
3. Kommt die Eigentumsbeschränkung einer Enteignung gleich, so trägt das Gemeinwesen die Kosten. Art. 47 bis 49 dieses Gesetzes werden sachgemäss angewendet.
