Art. 2 Vereinbarung über die Zusammenarbeit im Bereich der Informatik · Geltungsbereich

1. Diese Vereinbarung gilt für

1. die Behörden sowie die öffentlichen Verwaltungen der Kantone Obwalden und Nidwalden einschliesslich der Verwaltung der Rechtspflege;

2. die Behörden sowie die öffentlichen Verwaltungen der Gemeinden der Kantone Obwalden und Nidwalden.

2. Kirch- und Kapellgemeinden, Bürgergemeinden und Bezirksgemeinden sowie das Kantonsspital Obwalden sind dieser Vereinbarung nicht unterstellt.

3. Für Informatiksysteme, die ausschliesslich dem Schulunterricht dienen, ist diese Vereinbarung nur anwendbar, wenn der Regierungsrat des entsprechenden Kantons dies beschliesst. Die Gemeinden sind vorgängig anzuhören. Für die Schuladministration ist die Vereinbarung vollumfänglich verbindlich.

4. Für selbständige öffentlich-rechtliche Anstalten der Kantone und der Gemeinden und andere selbständige Organisationen, die mit der Wahrnehmung kantonaler oder kommunaler Aufgaben betraut sind, ist diese Vereinbarung nur anwendbar, wenn der Regierungsrat des entsprechenden Kantons die Anwendbarkeit für die jeweilige Organisation beschliesst. Die betroffenen Gemeinden und Organisationen sind anzuhören und in den Entscheid einzubeziehen. Die Anwendbarkeit kann auf bestimmte Teilbereiche beschränkt bleiben.
